BOARD OF ADJUSTMENT MEETING

MEMBERS PRESENT: Fred Joyce, Chairman; Gary Fawks, Vice Chairman; Lloyd Latta,
Art Sorenson, John Moore, Alternate #1.
MEMBERS ABSENT: Dennis Minder, Jon Michael Franks, Alternate #2.
STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary.
Agenda Item #2 Approval of the Minutes.
With no objections the chair deemed the minutes approved as amended November 30, 1995
meeting.
With no objections the chair deemed the minutes approved as amended January 11, 1996
meeting.
Agenda Item #3 Administrative Comments.
Mr. Sorenson expressed interest in reviewing ZBA procedures.
Agenda Item #4 ZBA Case # 248 Special Exception Use.
ZBA Case #248 a Special Exception Use Permit for family quarters in the "SF-lA" Single
Family Residential District per Ordinance No. 480, Section 44.12(1) for the property located
at 500 Brooks Court, being legally described as Lot 14, Block 1, Oakwood Estates Phase II
and being approximately 1.03 acres. The owner/applicant is Robert B. Spencer.
Karen Gandy, Zoning Administrator, reported that nine (9) notices were sent to property
owners within 200 feet and there were two (2) responses one (1) response in favor and one
(1) response undecided to the request.
Public Hearing.
Robert B. Spencer, owner/applicant, was present and said the request was similar to others in
the area and he presented photographs to show the similarities. Mr. Spencer also said the
request was for his mother who would be living in the structure four (4) months of the year.
Pam Rice, 455 Brooks Ct, said that the plans had been reviewed by home owners in the area
and they are in favor of the request. She presented Ms. Gandy with four (4) statements in
favor of the request.

Agenda Item #4 continued.
Debbie Clark, 1050 Summer Place, asked if the material would be the same as the primary
structure.
Mr. Spencer answered Ms. Clark's question that the materials would be the same as the
primary structure.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
A motion was made to grant ZBA Case # 248 a Special Exception Use Permit for family
quarters as requested.

Second: Latta
Ayes: Moore, Latta, Sorenson, Fawks, Joyce
Nays: None
Vote: 5 - 0 to grant
Agenda Item #5 ZBA Case #249 Special Exception Use Permit
ZBA Case #249 a Special Exception Use Permit for family quarters in the "SF-IA" Single
Family Residential District per Ordinance No. 480, Section 44.12(1) for the property located
at 331 W Highland St., being legally described as Lot 5, T. M. Hood No. 706 Addition
being approximately 8.708 acres. The owner/applicant is Kay Myers.
Karen Gandy, Zoning Administrator, reported that eleven (11) notices were sent to property
owners within 200 feet and there was one (1) written response in favor of the request.
Ms. Kay Myers was present and said the need is a kitchen be added to the family quarters
for her eighty (80) year old father and possibly her children. Ms. Myers also said the
structure is now under construction.
Public Hearing.
There was no other person wishing to speak either in favor or in opposition of the request.

A motion was made to grant ZBA Case # 249 a Special Exception Use Permit for family
quarters as requested.

Ayes: Moore, Latta, Sorenson, Fawks, Joyce.
Nays: None
Vote: 5 - 0 to grant
Agenda Item #6 Meeting Adjourned.
With no objections the Chair deemed the meeting adjourned.
