MEMBERS PRESENT: Fred Joyce, Chairman; Gary Fawks, Vice Chairman; Lloyd Latta,
John Moore, Alternate #1; Jon Michael Franks, Alternate #2.
MEMBERS ABSENT: Dennis Minder, Art Sorenson.
STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary.
Agenda Item #2 Approval of the Minutes.
A motion to approve the minutes of the August 10, 1995 and October 12, 1995 meetings as
presented.

With no objections the Chair deemed the minutes approved.
Agenda Item #3 Administrative Comments.
Karen Gandy, Zoning Administrator; reported on a special meeting on November 9th and
regular meeting November 16th.
A discussion was held on the Attorney's letter (an answer to Ms. Gandy's outline of Mr.
Sorrenson's letter).
Agenda Item #4 ZBA Case # 239 Special Exception Use Permit.
ZBA Case # 239 Special Exception Use Permit for family quarters in the "SF-lA" single
family residential district per Ordinance No. 480, Section 44.12(1) for the property located at
702 South White Chapel Blvd., being legally described as Lot 1, Block 1, Bull Run Lakes
Addition and being approximately 3.993 acres. The owner/applicant is George Grubbs.
Karen Gandy, Zoning Administrator, reported that 8 notices were sent to property owners
within 200 feet and there was one (1) response in favor of the request.

Timothy Piatt, designer, was present representing George Grubbs. Mr. Piatt said, Ms.
Gandy had described the family quarters well and he would answer any questions.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Fawks.
The requested exception is specifically permitted by the Zoning Ordinance, as set forth in
Section 44.12(1) per Ordinance No. 480; and pursuant to the finds set forth in this case, a
motion was made to Grant a Special Exception ZBA Case # 239 as requested.

Agenda Item #5 ZBA Case # 240 Special Exception Use Permit.
ZBA Case #240 a request for a Special Exception Use Permit per Ordinance No. 480,
Section 44.12(4) for an accessory building located in the front yard in the "SF-lA" single
family residential district to allow a 22 Ft. gazebo. The location is 702 S white Chapel
Blvd. legally described as Lot 1, Block 1, Bull Run Lakes Addition and being approximately
3.993 acres. The owner/applicant is George Grubbs.

Agenda Item #6 ZBA Case # 241 Variance.
ZBA Case # 241 request for a variance to the twenty -foot side yard requirement in the "SF-
lA" single family district per Ordinance No. 480, Section 11.5c., to allow a proposed
structure with a side yard of approximately ten feet (10') for property at 601 Garden Court,
legally described as Lot 1, Garden Addition. The owner/applicants are Ben and Cindy
Allen.
Karen Gandy, Zoning Administrator, reported that 10 notices were sent to property owners
within 200 feet and there was one (1) response in favor of the request.
Public Hearing.
Ben Allen, owner/applicant, was present and said the request for the variance was to build a
home as presented and save three to five (3-5) trees 18 to 24 inches. Mr. Allen presented
plot plans to view with the home located meeting the set back requirements and one with the
home position as to the variance request.
Cindy Allen, owner/applicant, said if the home was constructed at an angle the master
bedroom windows would view the neighbors pool area.
Steve Heitz, builder, was present asking questions of the board.
There was no other person wishing to speak either in favor or in opposition of the request.

A lenghty discussion by the board, on the posible damage to the trees with the root structure
and drip lines being so near the foundation.
There were no findings stated.
A motion was made to Grant ZBA Case # 241 a variance to Ordinance No. 480 Section 44.3
as requested.

Vote: 1 - 4 failed to approve
