MEMBERS PRESENT: Fred Joyce, Chairman; Gary Fawks, Vice Chairman; Lloyd Latta, Dennis Minder, Art Sorenson, John Moore, Alternate #1; Jon Michael Franks, Alternate #2. MEMBERS ABSENT: None STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the Chair deemed the minutes of the July 13, 1995 meeting approved. Agenda Item #3 Administrative Comments. To be continued after Agenda Item #5. Agenda Item #4 ZBA Case #237 Special Exception Use Permit. ZBA Case # 237 Special Exception Use Permit per Ordinance No. 480, Section 44.12(3) for an accessory building exceeding the maximum 1,000 s.f. permitted in the "SF-lA" Single Family-lA Residential District to allow a private horse stables not exceeding 4,100 s.f. with the following dimensions (48'6" x 84'6"). The location is 324 East Bob Jones Rd., being legally described as Lot 2, M. Mahaffey No. 916 Addition, being approximately 4.83 acres located on the south side of Bob Jones Road approximately 4.83 acres located on the south side of Bob Jones Road approximately 2,300 feet East of North White Chapel Blvd. The owner/applicant is Dawne Moore. Karen Gandy, Zoning Administrator, reported that five (5) notices were sent to property owners within 200 feet and there was one (1) response in favor the request. Public Hearing. Mr. Rick Martin was present to represent Dawne Moore. Mr. Martin had slides of the area and said the proposed private stables on 5 acre residence was designed to leave as many trees standing as possible. The plan is to build only a portion at this time due to the lateness in the season. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. A Motion to grant a Special Exception ZBA Case #237 pursuant to the findings set forth in this case, grants a Special Exception to the terms of the Ordinance No. 480, Section 44.12(3) as requested. Motion: Sorenson Second: Ayes: Sorenson, Minder, Latta, Fawks, Joyce Nays: None Vote: 5-0 to approve Agenda Item #5 ZBA Case # 238 Variance. ZBA Case #238, Variance to Ordinance No. 480, Section 34.2(e), which requires accessory buildings to not exceed one story or fourteen feet (14') in height. The applicant requests a twenty-three foot (23') single story building. The location is 325 East Bob Jones Road, being legally described as Lot 2, M. Mahaffey No. 916 Addition, being approximately 4.83 acres located on the south side of Bob Jones Road approximately 2,300 feet East of North White Chapel Blvd. The owner/applicant is Dawne Moore. Mr. Martin said, the proposed stable is designed with an height of 24 feet which is one story with a mezzanine loft for storage of hay, grain and bedding. Mr. Martin further said the acreage is heavily wooded throughout the East and South side with a natural opening on the West side. Through placement and 10 feet additional height are able to utilize the existing trees and provide privacy, wind protection and shade. The additional height is visually lost in the trees while allowing additional storage so that no additional buildings are needed in the future. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. Pursuant to the finds set forth in this case, a motion was made to Grant ZBA Case # 238 a variance to Ordinance No. 480, Section 34.2(e) as requested. Motion: Sorenson Second: Ayes: Sorenson, Minder, Latta, Fawks, Joyce Nays: None Vote: 5-0 to approve Agenda Item # 3 continued. A discussion was held on Mr. Sorenson, letter to Council.
