1995-07-13 CITY OF SOUTHLAKE 667 N. Carroll Avenue BOARD OF ADJUSTMENT MEETING July 13, 1995 7:05 P.M. MEMBERS PRESENT: Fred Joyce, Chairman; Gary Fawks, Art Sorenson, John Moore, Alternate # 1. MEMBERS ABSENT: Lloyd Latta, Dennis Minder, Jon Michael Franks, Alternate #2. STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the Chair deemed the minutes of the June 29, 1995 meeting approved. Agenda Item #3 Administrative Comments. Karen Gandy, Zoning Administrator, reported on the July 31st Commissioners Workshop. Agenda Item #4 ZBA Case #235 Special Exception ZBA Case #235 Special Exception Use Permit for family quarters per Ordinance No. 480, Section 44.12(1). The location is 885 Harbor Court being legally described as Lot 3, Block 1, Harbor Oaks Subdivision and being approximately 1.695 acres. The owner/applicants are Alan and Kay Bryd. Karen Gandy, Zoning Administrator, reported the Zoning is SF1A and ten (10) notices were sent to property owners within 200 feet. Two (2) response in favor of the request were received. Public Hearing. Mr. Alan Byrd, owner/applicant was present and said the need for the Special Exception Use Permit is for family quarters for his parents when visiting. Mr. Byrd also said Kirk Fuqua, Tarrant County Registered Sanitarian, has approved the perk test for the septic system. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were state by Mr. Sorenson. A motion was made to amend the request to be in compliance with Section 44.12(1); so the residential portion of the structure not be visible from the street. Motion: Sorenson Second: Moore Ayes: Moore, Sorenson, Fawks, Joyce Nays: None Vote: 4-0 to amend A Motion to grant a special Exception ZBA Case # 235 pursuant to the findings set forth in this case, grants a Special Exception to the terms of the Ordinance No. 480 Section 44.12(1). Motion: Sorenson Second: Moore Ayes: Moore, Sorenson, Fawks, Joyce Nays: None Vote: 4-0 to approve as amended Agenda Item #5 ZBA Case #236 Special Exception ZBA Case #236, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (7) for three portable buildings to be used as temporary offices for personnel during expansion and renovation of existing office building. The location is 350 Bank Street, legally described as Lot 7, Block B, Southlake, Bank Place and being approximately 1.36 acres located on the west side of Bank Street approximately 900' South of East Southlake Blvd. The applicant is Darr Equipment. Karen Gandy, Zoning Administrator, reported the Zoning is I-1 and six (6) notices were sent to property owners within 200 feet with no response. Public Hearing. Mr. Larry Winberg, Darr Equipment, was present and said the need for the Special Exception Use Permit is for offices for personnel during construction. Mr. Winberg also said construction had been delayed and the modular units would not be on site as soon as requested. There was no other person wishing to speak either in favor or in opposition of the request. Board of Adjustment Meeting page 3 July 13 , 1995 Agenda Item #5 continued. Public Hearing Closed. The findings were state by Mr. Sorenson. A motion was made to amend the request to be in compliance with Section 44.12(7) that the modular units be removed within 30 days of issuance of a Certificated of Occupancy and not exceeding one year from time of placement and waiving the masonry and permanent foundation requirements. Motion: Sorenson Second: Moore Ayes: Moore, Sorenson, Fawks, Joyce Nays: None Vote: 4-0 to amend A Motion to grant a special Exception ZBA Case #236 pursuant to the findings set forth in this case, grants a Special Exception to the terms of the Ordinance No. 480 Section 44.12(7). Motion: Fawks Second: Sorenson Ayes: Moore, Sorenson, Fawks, Joyce Nays: None Vote: 4-0 to approve as amended Agenda Item #6 Meeting Adjourned.
