BOARD OF ADJUSTMENT MEETING
MAY 25, 1995 7:00 P.M.
MEMBERS PRESENT: Fred Joyce, Chairman; William Towler, Vice Chairman; Richard
Waltke, John Moore, Alternate #1; Arthur Sorenson, Alternate #2.
MEMBERS ABSENT: Lloyd Latta, Dennis Minder
STAFF PRESENT: Karen Gandy, Zoning Administrator; Jean Bryson, Secretary.
Agenda Item #2 Approval of the Minutes.
A motion was made to approve the minutes of the May 25, 1995 Meeting. With no objections
the Chair deemed the minutes approved.
Agenda Item #3 Administrative Comments.
Ms. Gandy presented pictures to the board in relation to Agenda Item #5 & Item #6 and ask
that Administrative Comments continue after Agenda Item # 6.
With no objections the Chair deemed the continuation of Agenda Item #3.
Agenda Item #4 ZBA Case #230 Variance.
ZBA Case # 230 a request for a variance to the fifteen foot (15') side yard requirement per
Ordinance No. 480 Section 29.5(1) to allow a structure with side yards of approximately six
feet (6') on the North and nine feet (9') on the South The location is 1222 Woodsey Ct.,
being legally described as approximately 0.46 acres situated in the Harrison Decker Survey,
Abstract No. 438, Tract 1114E. The owner/applicant's are Glen and Sandra Harrison.
Karen Gandy, Zoning Administrator, reported the property is zoned "MH" Manufactured
Housing and fifteen (15) notices were sent to property owners within 200 feet. There were two
(2) responses in favor of the request.
Public Hearing.
Mr. Glen Harrison, owner/applicant, was present and said due the zoning of the property as
"ME" he could not build a stick built house and their request is to replace the small existing
Single Wide 14' x 66' with a 32' x 66' Box Double Wide Manufactured home that would
enhance the area.

Agenda Item # 4 continued.
Mrs. Sandra Harrison, owner/applicant said, to sit the home at an angle on the Lot or facing a
next door neighbor's home would not look right or be attractive. She further said with their
growing family a larger home was of great need.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The finding were stated by Mr. Towler.
Pursuant to the finds set forth in this case, a motion was made to Grant ZBA Case #230 a
variance to Ordinance No. 480, Section 29.5(1) as requested.
Motion: Moore
Second: Waltke
Ayes: Moore, Towler, Waltke, Joyce
Nays: Sorenson
Vote: 4-1 to grant approval
Mr. Joyce ask to step down for Agenda Items # 5 & 6. Mr. Towler seated as Acting
Chairman.
Agenda Item #5 ZBA Case # 232 Variance.
ZBA Case #232 a request for a variance to Ordinance No. 480, Section 9.5(g) which requires
a minimum lot width of three hundred feet (300'). The applicant requests an eighty foot (80')
front lot width. The location is 1496 E. Dove St., being legally described a approximately
0.74 acres situated in the F. Throop Survey, Abstract No. 1511, being a portion of Tract 4A.
The applicant is David O. Poe.
Karen Gandy, Zoning Administrator, reported the property is Zoned AG and twelve (12)
notices were sent to property owners within 200 feet. There were two (2) response, one (1) in
favor and one (1) opposed to the request.
Ms. Gandy said the building contractor has obtained the opportunity of sanitary sewer for this
property through the public works director.

Agenda Item #5 continued.
Mr. David Poe, applicant, was present and said as to the Plat Tract #1 contains the primary
residence of the current owner, Tract 2 has been willed to a relative of the Primary owner.
Therefore, tract 2 is tied up in Estate laws and Probate, and can not currently be touched.
Tract 3 is all that remains of the attached survey, and represents the entire piece of land which
is for sale by the current owner and under contract. Mr. Poe further stated there is no further
land available in which to bring this lot in compliance with Section 13.5(g) of the current
zoning ordinance.
Mr. Poe said if the request is not granted the current owner or current applicant could not sell
or purchase the land for residential property.
Ben Stiborek of 1407 E. Dove Road was present and spoke in opposition of the request as the
adjacent property owner.
Mr. Poe requested ZBA Case # 232 an #233 be tabled to the June 29th meeting.
Mr Towler called for a vote to table ZBA Case #232 and #233 as requested by the applicant to
the June 29th meeting.
Ayes: Sorenson, Moore, Waltke, Towler
Nays: None
Vote: 4-0 to Table
Agenda Item #6 ZBA Case #233 Variance.
ZBA Case #233 a request for a variance to the side yard setback requirements per Ordinance
No. 480, Section 9.5(c) which requires a minimum of twenty five feet (25') to allow a side
yard of ten feet (10'). The location is 1496 E. Dove Street, being legally described as
approximately 0.74 acres situated in the F. Throop Survey, Abstract No. 1511, being a
portion of Tract 4A. The applicant is David O. Poe.
A request was made by David Poe to table Case #233 to June 29th meeting.
Mr. Joyce was reseated as Chairman.
The Chair ask for a break. Meeting resumed at 8:40 P. M.

Agenda Item #3 continued.
Ms. Gandy said for those that would like to attend an amortization hearing, Dallas will have
two other opportunities this summer: June 27 and August 22. The meetings begin at 1:00 p.
in. at the City Council Chambers at Dallas City Hall. The "briefings" at 11:00 a.m. in Room
5E South which are open to the public.
There was a discussion on amortization and Rules of Procedure by the Board.
