BOARD OF ADJUSTMENT MEETING
March 16, 1995 7:00 P.M.
MEMBERS PRESENT: Fred Joyce, Chairman; William Towler, Vice Chairman; Lloyd
Latta, Richard Waltke, John Moore, Alternate #1; Arthur Sorenson, Alternate #2.
MEMBERS ABSENT: Dennis Minder

Agenda Item #2 Approval of the Minutes.
A motion was made to approve the minutes of the Special Meeting, February 16,1995. With
no objections the Chair deemed the minutes approved. A motion was made to approve the
minutes of the Regular Meeting, February 16,1995. With no objections the Chair deemed the
minutes approved. Lloyd Latta abstained from voting. Mr. Sorenson was absent from this
portion of the meeting.
Agenda Item #3 Administrative Comments.
Karen Gandy requested to defer these comments until the end of the meeting.
Agenda Item #4 ZBA Case # 228
ZBA Case #228 a request for a Special Exception Use Permit for family quarters per Ordinance
No. 480, Section 44.12 (1) for the property being legally described as Lot 1, Block 1 of the
Brewerton Addition and being approximately 3.85 acres. Location is 2507 Florence, South of
Florence Road approximately 1,000 feet west of Randol Mill Avenue. The applicants are Linda
& Ray Pekowski.
Karen Gandy, Zoning Administrator, reported that nine (9) notices were sent to property
owners within 200 feet and there were three (3) responses in favor of the request.
Public Hearing.
Mr. and Mrs. Pekowski of 500 Cherry Lane, Southlake, were both present and Mrs. Pekowski
spoke in support of her case and offered to answer any questions related to the case.
Ms. Gandy noted that the blueprints did show that the living quarters does meet the 1,000 s.f.
maximum living area requirement and is clearly defined. Mr. Joyce said that the family
quarters must have a separate leach field but that this is a septic issue and will be dealt with

through the building department.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
Mr. Towler made a findings statement: findings show that case ZBA #228 is specifically
permitted by ordinance as shown by the included concept plan and is compatible in use with
the ordinance.
Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 228 a
request for a Special Exception Use Permit per Ordinance No. 480, Sec. 44.12(1) as shown on
the plot plan and accompanying blueprints as requested.

Agenda Item #5 ZBA Case #229
ZBA Case #229 a request for variance to the 20' side yard requirement of the "SF-30" district
per Ordinance No. 480, Section 13.5(c) to allow an existing structure with a side yard of
approximately 10'. The request is for Lot 1, T. J. Thompson No. 1502 Addition being
approximately 0.9441 acres. The location is the North side of W. Continental Blvd. in the 2300
block, approximately 575' East of Davis Blvd. The owners and applicants are Larry and Denise
Overby.
Karen Gandy, Zoning Administrator, reported that nine (9) notices were sent to property
owners within 200 feet and there were no responses received.
Public Hearing.
Larry and Denise Overby were both present. Mr. and Mrs. Overby, both spoke in support of
the case and offered to answer any questions related to the case. Mrs. Overby said that the
property had been recently rezoned and a variance to the septic requirement had been recently
granted. The existing structure is not in the rear yard.

Agenda Item #5 continued.
There was no other person wishing to speak either in favor or in opposition of the request.
Mr. Sorenson noted that any additions must conform to new setbacks. Mr. and Mrs. Overby
said that no additions will be made to the structure only painting and upgrading. Mrs. Overby
added that the financing process is requiring the variance.
Public Hearing Closed.
Mr. Joyce asked for findings. Findings consisted of: variance will be granted only for
building in existence and no further encroachment into the side yard is permitted.
Pursuant to the finds set forth in this case, a motion was made to Grant ZBA Case #229 a
variance to Ordinance No. 480, Sec. 13.5(c) as requested.

Agenda Item #6 Consider Rules of Procedure for Zoning Board of Adjustment.
The Rules and Procedures for the Zoning Board of Adjustment were adopted per changes
noted during the discussion.

With no objections the Chair deemed the meeting adjourned.
