Action Requested: Approve an Encroachment and Joint Use Agreement for the placement of a screening wall across a sanitary sewer easement, water easement, and drainage and utility easement located at 240 N Carroll Avenue. Background Information: The purpose of this item is to seek City Council approval of an Encroachment and Joint Use Agreement for the placement of a screening wall across a 10-foot wide sanitary sewer easement, a 10- foot wide water easement, and a variable width drainage and utility easement located at 240 N Carroll Avenue. This agreement will allow the developer to place a screening wall across the existing easements along the west and east sides of the property. The sanitary sewer easement was dedicated for an 8-inch sanitary sewer pipe that extends from the residential subdivision, east into the commercial property within the Willow Tree Gardens development. The water easement was dedicated for an 8-inch water pipe that extends from the residential subdivision, east into the commercial property within the Willow Tree Gardens development. The drainage and utility easement was dedicated along the west side of the residential subdivision of Willow Tree Gardens for the detention pond and outletting storm drain pipe. The proposed screening wall will not impede drainage flow since the wall is crossing over the top of the storm pipe. Public Works Wastewater has reviewed and approved the encroachment.
