Agenda Item #2 Approval of the Minutes.
The minutes of the April 29, 1999 meeting were deemed approved by the Chair as presented.

Agenda Item #3 Administrative Comments.
Mr. Art Wright, Zoning Assistant, reported there is not a meeting scheduled for May 27, 1999
and the next regular meeting will be June 10, 1999.
Agenda Item #4 ZBA Case # 323 Variance
ZBA Case # 323, a request for a Variance to Ordinance No. 480, Section 34.2.a, requiring that
accessory buildings having a permanent foundation shall be erected no closer than ten feet (10')
to a property line located in the rear yard. The applicant is requesting to have an accessory
building no closer than six feet (6') to the side property line in the rear yard. The location is 112
Ascot Drive, being legally described as Lot 7, Block 2, Chapel Downs, situated in the William
W. Hall Survey, Abstract No. 687, and being approximately 0.767 acres. The Current zoning is
"SF- 20A" Single Family Residential District. and the owner /applicant is David Tuttle.
Mr. Wright, Zoning Assistant, reported 15 that notices were sent to property owners within 200
feet and there were three responses (one (1) in favor, one (1) undecided and one (1) opposed to
the request).
Public Hearing.
David Tuttle, owner/applicant was present requesting a variance to the side property line set back
for an accessory building (greenhouse) that is located six (6) feet to the side property line. Mr.
Tuttle further stated information he received from staff concerning the sideyard setback and
permitting.

Mr. Tuttle said the foundation was constructed in 1992 and the building with electricity was
constructed in 1998 without a permit.
There was no other person wishing to speak either in favor of or in opposition to the request.
Public Hearing Closed.
The findings were stated by Mr. Harris
A motion subject to the findings was made to approve ZBA Case No.323 with the conditions that
all necessary inspections be carried out by the Building Department to insure that the structure
meets the applicable City Codes for safety.

Vote: 5 -0 to approve as amended
