Carroll Avenue BOARD OF ADJUSTMENT MEETING February 11, 1999 7:15 p.m. MEMBERS PRESENT: Art Sorenson, Vice Chairperson; Dennis Minder, Ron Troy, John Smart MEMBERS ABSENT: David Harris, Chairperson; Vernon Stansell, Alternate #1; George Dalton, Alternate #2 STAFF PRESENT: Arthur Wright, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. The minutes of the January 28, 1999 meeting were deemed approved by the Chair as presented. Motion: Minder Second: Smart Ayes: Minder, Smart, Troy, Sorenson Nays: None Vote: 4 - 0 to approve Agenda Item #3 Administrative Comments. Mr. Wright, Zoning Assistant, reported the next meeting would be February 25, 1999. Agenda Item #4 ZBA Case #310 Variance ZBA Case # 310 is a request for a Variance to Ordinance No. 480, Section 33.2 and Section 39.2 (e), requiring that fences shall not exceed eight feet (8') in height. The applicant is requesting to have a fence of not more than twelve feet (12') in height for a period of two years. The location is 598 Garden Court, being legally described as Lot 9 of the Garden Addition, being approximately one (1) acre and being situated in the Thomas Beedy Survey, Abstract No. 72. The current zoning is "SF-IA" Single Family Residential District. The owner/applicants are Michael L. and Victoria J. Dumont. Mr. Wright, Zoning Assistant, reported that thirteen (13) notices were sent to property owners within 200 feet and there were three (3) response in favor to the request. Public Hearing. The owner/applicants were not in attendance. Mr. Wright reported that Mrs. Dumont ask that ZBA Case No. 310 be tabled until the February 25, 1999 meeting. Mr. Moran presented to the board pictures from his backyard of the fence at 598 Garden Ct. and a typed statement of his concerns and opposition. There was no other person wishing to speak either in favor or in opposition of the request. A motion to table ZBA Case No.310 to the February 25, 1999 meeting. Motion: Sorenson Second: Minder Ayes: Minder, Smart, Troy, Sorenson Nays: None Vote: 4-0 to table to February 25, 1999 Agenda Item #5 ZBA Case # 311 Variance ZBA Case # 311 is a request for a variance to Ordinance No. 480, Section 11.5 (b); requiring lots in the "SF-IA" Single Family Residential District have front yards of not less than forty feet (40'). The applicant is requesting to have the main dwelling encroach not more than four feet, five inches (being 4.4") into the front yard setback and to have an accessory structure encroach not more than ten feet, two and one-half inches (being 10.2') into the front yard setback. The location is 3151 Hilltop Drive being legally described as Lot 16R, Hilltop Acres Addition being approximately 1.95 acres and being situated in the Reis D. Price Survey, Abstract No. 1207. The current zoning is "SF-1A" Single Family Residential District. The owner/applicants are Charles F. and Cassandra Rae Holmans. Art Wright, Zoning Assistant, reported that ten (10) notices were sent to property owners within 200 feet and there were three (3) response Two (2) in favor and one (1) opposed to the request. Public Hearing. Charles Holmans was present requesting a variance in order to bring the existing home and barn in compliance with Ordinance 480. Rae Holmans was present also requesting the variance. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. Zoning Board of Adjustment Meeting page 3 February 11, 1999 Agenda Item # 5 continued. The findings were stated by Mr. Smart. A motion subject to the findings was made to approve ZBA Case # 311 as amended (a request for a variance to Ordinance No. 480, Section 11.5 (b), to have the existing main dwelling encroach not more than four feet, five inches (being 4.4') into the front yard setback and the existing accessory structure encroach not more than ten feet, two and one-half inches (being 10.2') into the front yard setback.)
