Agenda Item #2 Approval of the Minutes.
The minutes of the January 14, 1999 meeting were deemed approved by the Chair as presented.

Agenda Item #3 Administrative Comments.
There were no administrative comments.
Agenda Item #4 ZBA Case # 309 Variance
ZBA Case # 309 is a request for a Variance to Ordinance No. 480, Section 14.5 (c), requiring lots
in the "SF-20A" Single Family Residential District to have side yards of not less than fifteen feet
(15'). The applicant is requesting to have a side yard of approximately ten feet (10'). The
location is 1075 Oasis Court, being legally described as Lot 14, Block 1, Southview, Phase I,
being approximately 0.594 acres, and being situated in the William W. Hall Survey, Abstract No.
695. Current Zoning is "SF-20A" Single Family Residential District. The owner/applicants are
Donald P. and Cheryl S. Foltz.
Mr. Wright, Zoning Assistant, reported that thirteen (13) notices were sent to property owners
within 200 feet and there was one response in favor to the request.
Public Hearing.
Mr. Donald P. Foltz, owner/applicant was present requesting a variance to encroach into the side
yard setback not more than five (5') feet allowing the attached shop to be built. Mr. Foltz
presented the board with a Variance Proposal

Barry Thomas, representing Rockaway Construction Co., spoke in favor of the request.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
A motion subject to the findings was made to approve ZBA Case No. 309 as presented.

Vote: 0 - 4 to deny the request
A discussion was held on how to determine a rear yard on a five (5) sided lot.
