Carroll Avenue BOARD OF ADJUSTMENT MEETING JANUARY 14, 1999 7:00 p.m. MEMBERS PRESENT: David Harris, Chairperson; Art Sorenson, Vice Chairperson; Dennis Minder, Vernon Stansell, Alternate #1; George Dalton, Alternate #2. MEMBERS ABSENT: Ron Troy, John Smart STAFF PRESENT: Arthur Wright, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. The minutes of the December 10, 1998 were deemed approved by the Chair as presented. Motion: Minder Second: Dalton Ayes: Dalton, Minder, Sorenson, Harris Nays: None Vote: 4 - 0 to approve Mr. Stansell was seated. Mr. Sorenson asks that Agenda Item # 3 Administrative Comments be moved following Agenda Item No. 5, ZBA Case # 308. Agenda Item #4 ZBA Case # 307 Variance ZBA Case No. 307 is a request for a Variance to Ordinance No. 480, Section 30.5, which allows an applicant to request a variance of up to, but not exceeding, ten percent (10%) of the required twenty foot (20') side yard setback established by the development regulations for Residential Planned Unit Development No. 4, Myers Meadow, Ordinance No. 480-52. The applicant is requesting to encroach in the side yard setback not more than fifteen inches (15"). The location is 400 Osprey Court, being legally described as Lot 45, Block 8 Myers Meadow, Phase III, being approximately 0.364 acres and being situated in the B. J. Foster Survey, Abstract No. 519. The current zoning is "R-Pud" Residential Planned Unit Development District. The applicant is James V. Rising and the owner is Perry Homes. Mr. Wright, Zoning Assistant, reported that ten (10) notices were sent to property owners within 200 feet and there were two (2) response, one (1) in favor and one (1) opposed to the request. Zoning Board of Adjustment Meeting page 2 January 14, 1999 Agenda Item # 4 continued Mr. Rising was present requesting a variance to encroach into the side yard setback not more than fifteen inches (15") allowing the home to be build with a thirty five foot (35') setback as the other homes on Osprey Court. Mark Cotter, 1037 Hart Rd, McKinney, Texas, Construction Manger for Perry Homes was present to verify all information presented was true and correct and was in favor of the request. Rebecca Malone, 204 Oak Lane, Bedford, was present speaking in favor of the request. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Harris. A motion subject to the findings was made to approve ZBA Case # 307 as presented. Motion: Sorenson Second: Stansell Ayes: Dalton, Stansell, Minder, Sorenson, Harris Nays: None Vote: 5 -0 to grant Agenda Item #5 ZBA Case # 308 Special Exception Use Permit ZBA Case No. 308 is a request for a Special Exception Use Permit per Ordinance No. 480, Section 4.12 (1) for family quarters. The applicant is requesting a family quarters of approximately five hundred seventy-two (572) square feet to be located above a residential garage attached to the main structure. The location is 1654 Royal Oaks Court, being approximately 1.0 acres situated in the F. Throop Survey, Abstract No. 151. The current zoning is "SF-IA" Single Family Residential District. The owner and applicant is Thomas Crews. Art Wright, Zoning Assistant, reported that fifteen (15) notices were sent to property owners within 200 feet and there were three (3) response in favor to the request Public Hearing Mr. Crews, owner/applicant, was present requesting a Special Exception Use Permit for family quarters to be located above a residential garage for family quarters only. Nilson 1656 Royal Oak Lane, was present stating his property is adjacent to Mr. Crews and is in favor of the request. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Harris. Mr. Wright, Zoning Assistant, reported next meeting dates January 28, 1999 (1 case) and February 11, 1999 (2 cases). A discussion was held on the motion format. Mr. Harris asks, Mr. Wright to set a meeting for he and Mr. Sorenson to meet with the City Attorney and discuss the items in question. Agenda Item #6 Meeting Adjourned.
