Carroll Avenue BOARD OF ADJUSTMENT MEETING October 29, 1998 7:00 p.m. MEMBERS PRESENT: David Harris, Chairperson; Art Sorenson, Vice Chairperson; Dennis Minder, Ron Troy, John Smart, Vernon Stansell, Alternate #1; George Dalton, Alternate #2. MEMBERS ABSENT: none STAFF PRESENT: Greg Last, Community Development Director; Arthur Wright, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections a motion was made to approve the minutes of October 15, 1998 as presented. Motion: Troy Second: Minder Ayes: Minder, Smart, Troy, Sorenson, Harris Nays: none Vote: 5 - 0 to approve Agenda Item #3 Administrative Comments. Mr. Wright, Zoning Assistant, presented a 1999 Submittal Schedule and reported the next meetings would be November 12, 1998 and December 10, 1998. Agenda Item #4 Ratification Case ZBA #301 The findings were stated by Mr. Harris Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 301 a variance to Ordinance No. 480 Section 11.5(f) as requested with additional restrictions in the event either the current lot designated the Seebeck property or Lot 9R2 were transferred or sold or conveyed to anyone other than Mr. and Mrs. Seebeck or daughter, Doreen Bruton, then the triangular piece of property, Lot 9R2, and the Seebeck tract would need to be adjoined so that they have the same zoning and are part of the same plat.. Motion: Minder Second: Smart Ayes: Minder, Smart, Troy, Harris Nays: none Vote: 4 - 0 to grant Zoning Board of Adjustment Meeting Page 2 October 29, 1998 Agenda Item #5 ZBA Case # 299 Variance ZBA Case # 299 a request for a Variance to Ordinance No. 480, Section 34.1 (f), which requires that a swimming pool shall not be located closer than five feet (5') to another structure. The applicant is requesting to place a swimming pool within one-foot (1') of a residential structure. The location is 708 Chaucer Court, legally described as Lot 15, Block 2 of Cambridge Place, Phase I, and being approximately 0.4635 acres situated in the John A. Freeman Survey, Abstract No. 529. The current zoning is "SF-20A" Single Family Residential District. The owner/applicant is Stratford Homes, Inc. Mr. Harris reported that the applicant is requesting that the case be tabled to the next regular meeting on November 12, 1998. A motion was made to table ZBA Case # 299 to the next regular meeting on November 12, 1998. Motion: Sorenson Second: Troy Ayes: Smart, Troy, Sorenson, Harris Nays: Minder Vote: 4 - 1 to table Agenda Item #6 ZBA Case # 300 Variance ZBA Case No. 300 a request for a Variance to Ordinance No. 480, Section 34.2 (6), requiring that no accessory building shall be erected within ten feet (10') of any other building, and Section 14.5(c), requiring lots in the "SF-20A" Single Family Residential District to have side yards of not less than fifteen feet (15'). The applicant is requesting to place an accessory building five and one-half feet (5'6") from a residential structure, and to have a side yard of approximately eight feet (8'). The location is 203 East Chapel Downs Drive, legally described as Lot 17, Block 4, Chapel Downs, and being approximately 0.4606 acres situated in the William W. Hall Survey Abstract No. 687. The current zoning is "SF-20A" Single Family Residential District. The owners/applicants are Chris and Judy Koh. A letter from Mr. Koh requesting ZBA Case No. 300 be tabled until the next regular meeting, November 12, 1998. A motion was made to table ZBA Case No. 300 to the November 12, 1998 meeting. A motion was made to adjourned the meeting. Mr. Sorenson raised questions of procedure regarding the need for a motion and a second to have a valid approval, and whether or not it is appropriate to have discussion among members before a motion has been made. Mr. Harris directed Mr. Wright, Zoning Assistant, to seek the opinion of the city attorneys on Mr. Sorenson's questions.
