Agenda Item #2 Approval of the Minutes. With no objections the minutes of the August 27, 1998 meeting were deemed approved by the Chair as presented. With no objections the minutes of the September 14, 1998 meeting were deemed approved by the Chair as presented. Agenda Item #3 Administrative Comments. No administrative Comments reported. Agenda Item #4 ZBA Case # 299 Variance ZBA Case # 299 a request for a Variance to Ordinance No. 480, Section 34.1 (f), which requires that a swimming pool shall not be located closer than five feet (5') to another structure. The applicant is requesting to place a swimming pool within one-foot (1') of a residential structure. The location is 708 Chaucer Court, legally described as Lot 15, Block 2 of Cambridge Place, Phase I, and being approximately 0.4635 acres situated in the John A. Freeman Survey, Abstract No. 529. The current zoning is "SF-20A" Single Family Residential District. The owner/applicant is Stratford Homes, Inc. Mr. Art Wright reported that the applicant is requesting the case be considered at the next regular meeting on October 29, 1998. A motion was made to move ZBA Case No. 299 to the next regular meeting on October 29, 1998. Zoning Board of Adjustment Meeting Page 2 October 15, 1998 Agenda Item # 4 continued Motion: Minder Second: Troy Ayes: Minder, Smart, Troy, Harris Nays: None Vote: 4 - 0 to move Agenda Item #5 ZBA Case #300 Variance ZBA Case No. 300 a request for a Variance to Ordinance No. 480, Section 34.2 (6), requiring that no accessory building shall be erected within ten feet (10') of any other building, and Section 14.5(c), requiring lots in the "SF-20A" Single Family Residential District to have side yards of not less than fifteen feet (15'). The applicant is requesting to place an accessory building five and one-half feet (5'6") from a residential structure, and to have a side yard of approximately eight feet (8'). The location is 203 East Chapel Downs Drive, legally described as Lot 17, Block 4, Chapel Downs, and being approximately 0.4606 acres situated in the William W. Hall Survey Abstract No. 687. The current zoning is "SF-20A" Single Family Residential District. The owners/applicants are Chris and Judy Koh. Karen Gandy, Zoning Administrator, reported that thirteen (13) notices were sent to property owners within 200 feet and there were three (3) responses in favor and one (1) response opposed to the request. Public Hearing. Chris Koh was present and discussed the need for the variances to build the accessory building. Mr. Koh requested ZBA Case No. 300 be tabled until the next regular meeting on October 29, 1998. A motion was made to table ZBA Case No. 300. Motion: Troy Second: Minder Ayes: Minder, Smart, Troy, Harris Nays: None Vote: 4 - 0 to table Zoning Board of Adjustment Meeting Page 3 October 15, 1998 Agenda Item 46 ZBA Case # 301 Variance ZBA Case No. 301 a request for a Variance to Ordinance No. 480, Section 11.5(f), requiring the lots in the "SF-1B" Single Family residential District to have a minimum acres of forty-three thousand five hundred and sixty (43,560) square feet, and Section 11.5 (g), requiring lots in the "SF-1B" Single Family Residential District to have a minimum width of one hundred (100) feet and a minimum depth of one hundred twenty-five (125) feet. The applicant is requesting a triangular shaped lot with an area of not more than fifty (50) foot sides and a long side of approximately seventy-one (71) feet. The location is a portion of Lot 9, T. M. Hood No. 706 Addition, and being approximately 0.0287 acres situated in the "SF-1B" Single Family Residential District. The applicants are Ride with Pride, Inc. and Mr. and Mrs. Robert Seebeck. The owners are Julian and Valerie Head. Karen Gandy, Zoning Administrator, reported that seven (7) notices were sent to property owners within 200 feet and there was one (1) response opposed to the request. Public Hearing. Richard (Rick) Wilhelm, 1330 Woodbrook, was present to represent the applicants. Mr. Wilhelm said that Ride with Pride had been in operation on five acres for twenty (20) to twenty- five (25) years, made improvements (6 - 8 stall barn, riding arena, and pasture) for teaching children and adult horseback riding. Also, Mr. Wilhelm said that to get to the riding trails the riders would go through a gate onto the property of the Seaborn family. The new owners of Lot 9R1 do not want the riders to enter their property to get to the trails and have agreed to sell a triangular section of land to the applicants giving them the necessary access to the trails from the Seebeck property. Ms. Gandy stated that staff would recommend that the Seebeck tract and Lot 9R2 be combined and platted as one lot with the appropriate zoning. Mr. Wilhelm stated if the Seebeck property with Lot 9R2 were replatted and there was a fire the legal non-confirming buildings could not be rebuilt. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. Mr. Harris recapped the findings for ZBA Case # 301 with the following additional restrictions: in the event either the current lot designated the Seebeck property or Lot 9R2 were transferred or sold or conveyed to anyone other than Mr. and Mrs. Seebeck or daughter, Doreen Bruton, then Zoning Board of Adjustment Meeting Page 4 October 15, 1998 Agenda Item # 6 continued the triangular piece of property, Lot 9R2, and the Seebeck tract would need to be adjoined so that they have the same zoning and are part of the same plat.
