Agenda Item #2 Approval of the Minutes.
With no objections the minutes of July 16, 1998 were deemed approved by the Chair as
presented.
Agenda Item #3 Administrative Comments.
Tim Woloshyn, Zoning Assistant, reported the next meeting will be August 27, 1998.
Agenda Item #4 ZBA Case # 294 Variance
ZBA Case # 294 a request for a Variance to Ordinance No. 480, Section 11.5 (a) which
requires a maximum building height of thirty-five feet (35') or 2.5 stories in the "SF-lA"
Single Family Residential District. The applicant is requesting a three (3) story building. The
location is 880 Harbor Court, legally described as Lot 6, Block 1 of Huse Homeplace, and
being approximately 3.876 acres situated in the R. Price Survey, Abstract No. 1207. The
current zoning is "SF-lA" Single Family Residential District. The owner/applicants are Ward
and Diedra W. Flora.
Tim Woloshyn, Zoning Assistant, reported that thirteen (13) notices were sent to property
owners within 200 feet and with five (5) response, four (4) in favor and one (1) opposed to the
request.
Public Hearing.
Ward Flora, owner/applicant was present requesting a variance for the height of the tower
portion of the primary structure. Mr. Flora said the construction factors necessitate an
intermediary level for access to the top floor of the tower and while the tower exceeds the
allowable number of stories its base to peak height of thirty-three feet (33') four inches (4")

meets the ordinary requirement for height. Mr. Flora further said that his elevation is lower
than surrounding area and that the third floor area is thirteen feet (13') eight inches ( 8") x
thirteen feet (13') eight inches ( 8") and one half of the area is in a staircase with windows on
all four (4) sides.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 294 a
variance to Ordinance No. 480 Section 11.5 (a) as requested.

Agenda Item #5 ZBA Case # 296 Special Exception
ZBA case # 296 a request for a Special Exception Use permit per Ordinance No. 480, Section
44.12 (3) for the construction of an accessory building of a size greater than the permitted 600
square feet in the "MH" Manufactured Housing District, to allow for an accessory building
not to exceed 1,200 square feet. The location is 1236 Woodsey Court being legally described
as Tract 1B04N of the H. Decker Survey, Abstract No. 438, and being approximately 0.5142
acres. The current zoning is "MH" Manufactured Housing District. The applicant/owner is
Mr. Lynn V. Auld.
Tim Woloshyn, Zoning Assistant, reported that nine (9) notices were sent to property owners
within 200 feet and there was no response to the request.
Public Hearing.
Lynn Auld, owner/applicant was present asking for a Special Exception Use to construct a
detached accessory building to be used as a storage area and personal workshop. Mr. Auld
said the building was to be a thirty (30) x forty (40) foot building and would house his

1997 ford van with a raised roof and a ford extended cab pickup with an eight foot (8') bed to
protect them from the industrial dust and weather.
There was no other person wishing to speak either in favor or in opposition of the request.

Pursuant to the findings set forth in this case, a motion was made to Grant a Special Exception
ZBA Case # 296 as requested.

Agenda Item #6 ZBA Case # 297 Special Exception
ZBA Case # 297 a request for a Special Exception Use permit per Ordinance No. 480, Section
44.12 (7) for a portable building to be used as temporary facilities for essential staff members.
Also to be considered are request for waivers of permanent foundation, eighty percent (80%)
masonry, and additional hard surfaced parking requirements. The location is Florence
Elementary School, 3095 Johnson Road, being legally described as Tracts IF and 1G of the J.
G. Allen Survey, Abstract No. 18, and being approximately 14.25 acres. The current zoning
is "CS" Community Service District. The owner/applicant is Keller Independent School
District.
Tim Woloshyn, Zoning Assistant, reported that eighteen (18) notices were sent to property
owners within 200 feet and there was no response to the request.
Public Hearing.
Mike Neel, Director of Facilities Services, Keller Independent School District was present
requesting a Special Exception Use to place a 64' X 24' portable building north of the school.
The building will provide temporary housing for staff during the construction of a new library
and the renovation of the office area will be underway at Florence Elementary School. Mr.
Neel further said the building would be needed at this site only for the 1998 - 1999 school
year.

Mr. Roger Zediche, 601 Overland Trail was present and said he was opposed to the request
and ask that a time limit be established for the removal of the building.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
Pursuant to the findings set forth in this case, a motion was made to Grant a Special Exception
ZBA Case # 297 as requested for the 1998-1999 school year ending the last day of July 1999.

Vote: 4 - 0 to grant
