BOARD OF ADJUSTMENT MEETING
June 25, 1998 7:10 p.m.

MEMBERS ABSENT: Dennis Minder, Ron Troy, John Smart

Agenda Item #2 Approval of the Minutes.
With no objections the minutes of June 11, 1998 were deemed approved by the Chair as
presented.
Agenda Item #3 Administrative Comments.
Mr. Woloshyn, Zoning Assistant, reported July 16, 1998 is the next meeting and the ZBA
telephone list has been updated.

Agenda Item #4 ZBA Case #293, pecial Exception Use
ZBA Case # 293 a request for a Special Exception Use permit per Ordinance No. 480, Section
44.12(3) for the construction of an accessory building of a size greater than the permitted
1,000 square feet in the "SF-1A' Single Family Residential District, to allow for an accessory
building not to exceed 7,000 square feet. The location is 825 Dove Road, being legally
described as Lot F, Block 1 of the Old Orchard Country Estates and being approximately
6.300 acres situated in the T. Beedy Survey, Abstract No. 72. The current zoning is "SF-IA"
Single Family Residential District. The request is being made by the applicant Jeff Carpenter,
Diamond Custom Homes Corporation. The owners are Wayne and Mary Ann Davis.
Tim Woloshyn, Zoning Assistant, reported that eight (8) notices were sent to property owners
within 200 feet and there were two (2) response one undecided and one (1) opposed to the
request

Public Hearing
Mr. Jeff Carpenter, Diamond Custom Homes Corporation, was present to represent the
owners, Wayne and Mary Ann Davis. Mr.Carpenter said, the owners propose to build a
7,000 Sq. Ft. climate controlled building (5,000 Sq. Ft. to be used as a storage area for the
owners custom car collection and 2,000 Sq. Ft. as covered porch). Mr. Carpenter further said
despite its size the structure will meet height requirements and all other ordinance
requirements for accessory buildings and the owner was willing to make changes such as
masonry.
Speaking in opposition to the request as follows:
Roger Hutton, 1900 Shady Oaks, said he was pleased that someone was going to build on the
vacant lot but he was concerned about his view as his home is located 500 feet from the
proposed accessory building. Mr. Hutton was concerned that the use would be commercial as
his understanding was that the owner's business was car restoration.
Mike Andrews, 1950 Shady Oaks, said his sideyard abuts the rear yard of the requested
building and there is no buffer between his home and the proposed building. Mr. Andrews
concern is the effect the building would have on the valuation of this property. Mr. Andrews
further said the pad runs from the tree line to his property.
Ed Couch, 2000 Shady Oaks, expressed his concerns that the building was too large with
bedrooms, baths and not pleasing to view.
Noyce (Nick) McGarity, 2050 Shady Oaks, spoke of his concern for the many Oak and Pecan
trees on the property. Mr McGarity said, he could except a smaller metal barn but the 7000
sq. ft. barn is too large.
Rob Carvey, 865 W. Dove Road is opposed to the building and agrees with all concerns that
have been expressed. Mr. Carvey is also concerned about the commercial appearance and the
intent use, actual use and future use of the building.
Mikee McGarity, 2050 Shady Oaks, concerns are about being a work shop and the display.
Jeff Carpenter rebuttal he stated:
1. Actual size of the building is 7,000 sq. ft.
2. The owner is General Manager of Regency Conversion on State Hwy. 35.

3. Value of Mr. Adams property should increase with over a million dollar
improvement including land cost.
4. The exterior could be brick to match the home if needed.
5. No trees to be removed.
6. 1 Single bath no bedrooms
7. Intent to store classic automobile
8. Trees would be behind the building
9. Work shop not mentioned.
10. Display personal interest (vehicles)
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
A motion was made to Grant a Special Exception ZBA Case # 293 as requested..
Motion: Dalton
Ayes: None
Nays: Dalton, Stansell, Sorenson, Harris
Vote: 0 - 4 to deny request
