BOARD OF ADJUSTMENT MEETING

MEMBERS ABSENT: William (Bill) Kemp, Alternate #1; George Dalton, Alternate #2.
STAFF PRESENT: Tim Woloshyn, Zoning Assistant; Jean Bryson, Secretary.
Agenda Item #2 Approval of the Minutes.
With no objections the minutes of April 16, 1998 meeting were deemed approved by the Chair
as presented.
Agenda Item #3 Administrative Comments.
Mr. Woloshyn, Zoning Assistant, reported the next meeting will be May 14, 1998 with 2
cases.
Agenda Item #4 ZBA Case # 289 Special Exception
ZBA Case # 289 a request for a Special Exception Use Permit per Ordinance No. 480, Section
44.12 (7) for two (2) portable buildings to be used as temporary facilities for children
attending the school. Also to be considered are requests for waivers of permanent foundation,
eighty percent (80%) masonry, and additional hard surfaced parking requirements. The
location is Carroll Middle School and located at 1101 E. Dove Street, being legally described
as Tract 2 and 2C of the J. Chivers Survey, Abstract No. 348, and being approximately 29.02
acres. The current zoning is "CS" Community Service District. The owner/applicants are
Carroll Independent School District.
Tim Woloshyn, Zoning Assistant, reported a letter was received from the applicant requesting
that ZBA Case # 289 be tabled until the next meeting.
A motion was made to table ZBA Case # 289 until May 14, 1998 meeting.

Mr. Joyce stepped down for ZBA Case # 290.
Mr. Sorenson is the acting Chairman of the Board.
Agenda Item #5 ZBA Case # 290 Variance
ZBA Case # 290 a request for a Variance to Ordinance No. 480 Section 15.1 requiring lots in
the "SF20B Single Family Residential District to have side yards of not less than fifteen (15)
feet. The applicant is requesting a side yard not less than eight (8) feet. The location is 728
Overland Trail being legally described as Block 3 Lot 24 of the Vista Trails Addition being
approximately 0.539 acres situated in the J. J. Freshour Survey, Abstract No. 521. The
current zoning is "SF-20B" Single Family Residential District. The owner/applicant is Curtis
Cowan.
Tim Woloshyn, Zoning Assistant, reported that nineteen (19) notices were sent to property
owners within 200 feet and there were two (2) written response One (1) in favor and one (1)
opposed to the request
Public Hearing.
Curtis Cowan, owner/applicant was present asking for a variance to build an attached garage
in the rear yard of his home. Mr. Cowan further said the site of the proposed garage was
chosen primarily to preserve an existing Oak Tree which is more than 100 years old and the
other factors are the potential increase of the driveway in the sideyard and the additional
construction requirements if the garage is placed elsewhere.
Mark Patterson of 2124 Overland Trail was present and stated his concern for his trees and his
opposition to the request.
Mr. Cowan's rebuttal: He questioned the construction of the garage would damage Mr.
Patterson's trees.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Smart.
A motion was made to Grant ZBA Case # 290 a variance to Ordinance No. 480 Section 51.1
as requested.

Vote: 0 - 4 to deny the request
Mr. Joyce was reseated as Chairman.

With no objections the Chair deemed the meeting adjourned.
