Carroll Avenue BOARD OF ADJUSTMENT MEETING April 16, 1998 7:00 p.m. MEMBERS PRESENT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Karen Cienki, Ron Troy, John Smart, George Dalton, Alternate #2. MEMBERS ABSENT: William (Bill) Kemp, Alternate #1 STAFF PRESENT: Karen Gandy, Zoning Administrator; Tim Woloshyn, Zoning Assistant; Jean Bryson, Secretary; Charles Bloomberg, Plans Examiner. Agenda Item #2 Approval of the Minutes. With no objections the minutes of March 12, 1998 were deemed approved by the Chair as presented. Agenda Item #3 Administrative Comments. Mr. Woloshyn, Zoning Assistant, reported the next regular meeting would be April 30, 1998 with three (3) cases. Mr. Woloshyn also reported he spoke with the City Attorney and his interpretation of the Local Government Code §211.008 and §211.008(d). The attorney said his interpretation is that nothing will change concerning Alternate Board Members, precede as in the past. Agenda Item #4 ZBA Case # 287 Variance. ZBA Case # 287 request for a Variance to Ordinance No. 480, Section 11.5 (c), requiring lots in the "SF-lA" Single Family Residential District to have side yards of not less than twenty (20) feet. The applicant is requesting a side yard not less than ten (10) feet. The location is 2410 Emerald Circle, being legally described as Block 2, Lot 8 of the Emerald Estate Addition, being approximately 1.025 acres situated in the N.E. Thompson Survey, No. 1563. The current zoning is "SF-lA" Single Family Residential. The Owners/Applicants are Gary and Marilyne Monigold. Tim Woloshyn, Zoning Assistant, reported that eleven (11) notices were sent to property owners within 200 feet with three (3) response two in favor and one (1) undecided to the request. Gary Monigold was present requesting a Variance for an accessory building to be used as a carport and storage area. Mr. Monigold further said the placement of the carport is based on drainage concerns, if moved further to the rear concrete would be needed for the extension of the drive and the narrow width of the yard. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. A motion was made to Grant ZBA Case # 287 a variance to Ordinance No. 480 Section 11.5 (c) as requested. Motion: Sorenson Second: Troy Ayes: Troy Nays: Smart, Cienki, Sorenson, Joyce Vote: 1 - 4 (to deny request) Agenda Item #5 ZBA Case #288 Variance. ZBA Case# 288 a request for a Variance to Ordinance No. 480, Section 11.2 (c), requiring lots in the "SF-lA" Single Family Residential District to have side yards of not less than twenty (20) feet. The applicant is requesting a side yard not less than fifteen (15) feet. The location OS 1795 Kingswood Drive being legally described as Block 2, Lot 9 of the Randol Mill Estates Addition being approximately 1.194 acres situated in the B. Foster Survey, Abstract No. 519. The current zoning is "SF-IA" Single Family Residential District. The owner/applicant is Robert Hart. Tim Woloshyn, Zoning Assistant, reported that ten (10) notices were sent to property owners within 200 feet and with six (6) response in favor of the request. Public Hearing. Zoning Board of Adjustment Meeting Page 3 April 16, 1998 Agenda Item # 5 continued. Robert Hart was present requesting a variance to accommodate expansion of his house. Mr. Hart stated the following: 1. The house is located in a subdivision which was developed before being annexed by the City of Southlake. 2. The existing structure was a legal non-conforming use with a side yard of approximately fifteen (15) feet. 3. The building inspection was aware of these circumstances and initially approved the permit without the need for a variance. 4. Upon being brought to the attention of the Zoning Administrator, it was determined that a violation had occurred and a request for a variance was necessary. 5. The construction has been halted, but a significant portion of the expansion has been completed. Ken Trumpheller, 1793 Kingswood Drive was present saying he was not for or against the request but was asking for stipulation to be included with the request of a six (6) to eight (8) foot fence to be installed. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 288 a variance to Ordinance No. 480 Section 11.5 ° as requested. Motion: Sorenson Second: Cienki Ayes: Smart, Troy, Cienki, Sorenson, Joyce Nays: none Vote: 5 - 0 (to grant request) Agenda Item #6 Meeting Adjourned.
