Carroll Avenue BOARD OF ADJUSTMENT MEETING February 26, 1998 7:10 p.m. MEMBERS PMSBNT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Karen Cienki, Ron Troy, William (Bill) Kemp, Alternate 41. MEMBERS ABSENT: John Smart, George Dalton, Alternate #2 STAFF PRESENT: Tim Woloshyn, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the minutes of December 11, 1997 were deemed approved by the Chair as presented. Agenda Item #3 Administrative Comments. Mr. Tim Woloshyn, Zoning Assistant, reported the next regular meeting will be March 12, 1998. Mr. Woloshyn presented the board with a Local Government Code and a Board of Adjustment 1998 Submittal Schedule. The board requested that Mr. Woloshyn ask the City Attorney for his interpretation of the Local Government Code §211.008(c) and §211.008(d). Agenda Item #4 ZBA Case # ZBA-285 Variance. ZBA Case # 285 a request for a variance to Ordinance No. 480, Section 11.5 (d), requiring lots in the "SF-IA" Single Family Residential District to have rear yards no less than forty (40) feet to allow for a rear yard of approximately twenty (20") feet. The location is 1600 Burney Lane being legally described as Lot 3-R-2 of the John Childress No. 254 Addition, being approximately 1.00 acres situated in the John Childress Survey, No. 254. The current zoning is "SF-IA" Single Family Residential District. The owners are Charles K. and Tracer Miller. The applicants are Charles K. Miller, Tracy L. Miller, Ray K. Sloan and Betty J. Sloan. Tim Woloshyn, Zoning Assistant, reported that six (6) notices were sent to property owners within 200 feet and there was no response to the request. Public Hearing. Ray K. Sloan, applicant, was present and said the request for a variance was to build a single family home, they are family members who would like to live next to each other. The property was recently replatted to have more flexibility in building the new structure because previously, any new building would have been considered an accessory use. Mr. Sloan further said the placement of the new home was chosen with respect to its visual impact and the lessening of visual impacts, along with the angle of the rear property line that abuts Corp. of Engineer property are the reasons behind the request for a variance. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Troy. Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case #285, a variance to Ordinance No. 480 Section 11.5 (d) to allow a rear yard set back of twenty feet (20) for a distance of seventy-five feet (75') North East of the North West corner of the property. Motion: Sorenson Second: Cienki Ayes: Kemp, Troy, Cienki, Sorenson, Joyce Nays: None Vote: 5 - 0 to grant Agenda Item #7 Meeting Adjourned, With no objections the Chair deemed the meeting adjourned.
