BOARD OF ADJUSTMENT MEETING
December 11, 1997 7:00 p.m.
MEMBERS PRESENT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Ron

MEMBERS ABSENT: Karen Cienki; John Smart, George Dalton, Alternate # 2

Jean Bryson, Secretary, Charles Bloomberg, City Plans Examiner.
Agenda Item #2 Approval of the Minutes.
With no objections the minutes of November 13, 1997 Regular Board of Adjustment Board
Meeting were deemed approved by the Chair as presented.
Agenda Item #3 Administrative Comments.
There was no Administrative comments. Mr. Sorenson requested a discussion on increasing
the number of Alternate Board Members from two (2) to four (4) members at the next Regular
Meeting
Agenda Item #4 ZBA Case # 283 Variance
ZBA Case # 283, a request for a Variance to Ordinance No. 480, Section 11.5 (c), requiring
lots in the "SF-lA" Single Residential District to have side yards no less than twenty (20) feet
to allow for a side yard of approximately eight (8) feet. The location is 1351 Post Oak Trail
being legally described as Lot 12 Block 2 of the Trail Creek Phase One Addition situated in
the J Childress Survey, Abstract No. 253. The current zoning is "SF-lA" Single Family
Residential District. The owner/applicant is Greg A. Metzger.
Tim Woloshyn, Zoning Assistant, reported that seven (7) notices were sent to property
owners within 200 feet. The response was six (6) within 200 feet and four (4) outside the 200
feet. There were four (4) within the 200 feet, three (3) outside the 200 feet in favor of the
request and two (2) within the 200 feet, one (1) outside the 200 feet opposed to the request

Agenda Item # 4 continued,
Mr. Greg A. Mager, Owner/applicant was present and said his request was to construct a
garage in the side yard to the south of the house. The foundation for the garage was poured
after receiving a building permit, but construction ceased when told of the encroachment into
the utility setback. Mr. Metger said he had worked closely with the city in order to meet all
regulations. The location was determined by attempting to comply with the tree preservation
ordinance. The miscommunication regarding the appropriate setback occurred between the
applicant and building officials, which led to misplacement of the garage.
Charles Bloomberg, Plans Examiner was present and stated there was miscommunication
between the city and the applicant because of the shape of the lot.
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 283 a
variance to Ordinance No. 480 Section 11.5 (c) as requested.

Ayes: Kemp, Troy, Sorenson, Joyce
Nays: None
Vote: 4 - 0 to Grant the Request
Agenda Item #4 ZBA Case # 284 Variance
ZBA Case # 284. a request for a Variance to Ordinance No. 480 Section 29.5 (c) requiring
lots in the "MH" Manufactured Housing District to have side yards of no less than fifteen (15)
feet to allow for a side yard of approximately six (6) feet on the south side of the property.
The location is 1237 Woodsey Court being approximately 0.44 acres and legally described as
Tract 1 B4A of the H. Decker Survey, Abstract No. 438. The owners/applicant is Art Willett
and Todd Willett.
Tim Woloshyn, Zoning Assistant, reported that eleven (11) notices were sent to property
owners within 200 feet and there were three (3) response in favor of the request.

Agenda Item # 5 continued.
Public Hearing.
Todd Willett, owner/applicant was present and said he had replaced their single-wide mobil
home with a double-wide unit. The new mobil home is four (4) feet longer than the previous
unit, causing an encroachment into the side yard by the field that is Zoned Industrial To
position the home any other way would cause a potential fire hazard (an emergency vehicle
would not be able to easily access the structure) or a drainage problem (the open field and the
existing water and septic).
There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Sorenson.
Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 284 a
variance to Ordinance No. 480 Section 29.5 (c) as requested.

Vote: 4 - 0 to grant as requested
Agenda Item #6 Meeting Adjourned.
With no objections the Chair deemed the meeting adjourned.
