Agenda Item #2 Approval of the Minutes.
With no objections the minutes of October 16, 1997 Regular Board of Adjustment Meeting
were deemed approved by the Chair.
Agenda Item #3 Administrative Comments.
Ms. Gandy, Zoning Administrator, reported the next meeting would be December 11, 1997
(two cases).
Agenda Item #4 ZBA Case # 281, Special Exception Use Permit
ZBA Case # 281. a request for a Special Exception Use Permit per Ordinance No. 480,
Section 44.12(3) for the construction of an accessory building of a size greater than the
permitted 1,000 square feet to allow for an accessory building not to exceed approximately
2,368 square feet. The location is 1450 Sunshine Lane being legally described as Lot 2R of F.
Throop No. 1511 Addition, and being approximately 6.0 acres situated in the Francis Throop
Survey Abstract No. 1511. The owners/applicants are Robert and Sandra Kay.
Tim Woloshyn, Zoning Assistant, reported that fourteen (14) notices were sent to property
owners within 200 feet and there were four (4) response all in favor of the request.
Public Hearing.
Mr. Kay, owner/applicant was present and said he is making a request for a barn to be placed
in the rear of the house. Mr. Kay also said the barn would be for storage of machinery and
the mezzanine of 448 square feet would be for hay storage and finished in plywood.

There was no other person wishing to speak either in favor or in opposition of the request.
Public Hearing Closed.
The findings were stated by Mr. Joyce.
Pursuant to the findings set forth in ZBA Case # 281, a motion was made to Grant a Special
Exception Use as requested a barn of 1920 square feet with a mezzanine of 448 square feet.

Ayes: Dalton, Smart, Cienki, Joyce
Nays: None
Vote: 4 - 0 request granted
ZBA Case # 282, Variance
ZBA Case #282, a request for a Variance to Ordinance No. 480, Section 34.2 (e) for the
construction of an accessory building of a height greater than the permitted one story or
fourteen feet (24') in height, to allow for an accessory building not to exceed two stories or a
ground to peak height of twenty-six feet (26'). The location is 1450 Sunshine Lane, being
legally described as Lot 2R, F. Throop No. 1511 Addition and being approximately 6.0 acres
situated in the Francis Throop Survey, Abstract No. 1511. The owners/applicants are Robert
and Sandra Kay.
