Carroll Avenue BOARD OF ADJUSTMENT October 16, 1997 7:10 p.m. MEMBERS PRESENT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Karen Cienki, Ron Troy, William (Bill) Kemp, Alternate #1; George Dalton, Alternate #2. MEMBERS ABSENT: John Smart STAFF PRESENT: Karen Gandy, Zoning Administrator; Tim Woloshyn, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the minutes of September 25, 1997 were deemed approved by the Chair. Agenda Item #3 Administrative Comments. Ms. Gandy, Zoning Administrator, reported on her conversation with the City Attorney and the Hargett property. The ZBA case history was prepared by Tim Woloshyn, Zoning Assistant. Mr. Woloshyn reported the next meeting would be November 13, 1997. Agenda Item #4 ZBA Case # 280 Variance ZBA Case # 280 a request for a Variance to Ordinance No. 480, Section 14.5 (b), requiring lots in the "SF-20A: Single Family Residential District to have front yards no less than thirty- five (35) feet. The applicant is requesting front yards of twenty (20) to twenty-five (25) feet. The location is the northwest corner of the intersection of South White Chapel Boulevard and West Continental Boulevard, being legally described as Wilmington Court and being approximately 11.383 acres situated in the Hiram Granberry Survey, No. 581. The current zoning is "SF-20A" Single Family Residential District. The owner's Alvin R. Jackson, Lannie Joe Roach and Trustees, E-Systems, Inc., Pool Trust. The Applicant is Four Peaks Development, Inc. Karen Gandy, Zoning Administrator, reported that twenty-six (26) notices were sent to property owners within 200 feet and there were five (5) response one (1) in favor, three (3) response opposed, and one (1) undecided to the request. Public Hearing. Zoning Board of Adjustment Meeting Page 2 October 16, 1997 Agenda Item # 4 continued. David McMahan, representing Four Peaks Development, Inc., was present requesting twenty (20) and twenty-five (25) foot front yard setbacks. Mr. McMahan stated the reason for the request was to help eliminate complaints in the future because of traffic noise from Continental Boulevard. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. After a lengthy discussion pursuant to the findings set forth in this ZBA Case # 280, a motion was made, that due to the particular shape of the subdivision and the hardship not self created amend the variance request to grant a decrease front yard setback not in excess of ten (10) feet with an equal and corresponding increase in the rear yard setback for each individual lot. (Maximum twenty-five (25) foot front yard setback and increase the back yard setback from forty (40) feet to fifty (50) feet.)
