1997-08-04 CITY OF SOUTHLAKE 400 North White Chapel Blvd. White Chapel Room, Bicentennial Park BOARD OF ADJUSTMENT MEETING AUGUST 04, 1997 7:00 p.m. MEMBERS PRESENT: Fred Joyce, Chairperson; Art Sorenson, Vice Chairperson; Karen Cienki, Ron Troy, William (Bill) Kemp, Alternate #1 MEMBERS ABSENT: John Smart, George Dalton, Alternate #2 STAFF PRESENT: Karen Gandy, Zoning Administrator; Stefanie Sarakatis, Zoning Assistant; Jean Bryson, Secretary. Agenda Item #2 Approval of the Minutes. With no objections the minutes of June 12, 1997 were deemed approved by the Chair as amended. Agenda Item #3 Administrative Comments. Ms. Stefanie Sarakatis, Zoning Assistant reported the next meeting will be Thursday, August 14, there are three (3) cases. Agenda Item #4 ZBA Case #274, Special Exception Use Permit. ZBA Case # 274, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (7) portable buildings, for a period of three (3) years, to be used as classrooms for high school students. Also to be considered are requests for waivers of permanent foundation and eighty percent (80%) masonry requirements. The location is 519 North Kimball Avenue, being legally described as Lot 1, Block A, Saint Laurence Episcopal Church Addition, being approximately 2.894 acres situated in the S. Freeman Survey, Abstract No. 525. The current zoning is "CS" Community Service District. The owner is Saint Laurence Episcopal Church and the applicant is Grapevine-Colleyville Independent School District. Ms. Sarakatis, Zoning Assistant, presented to the board information concerning the Grapevine- Colleyville Independent School District's Bridges Learning Center and reported there were nine (9) notices sent to property owners within two hundred (200) feet. There was one written response received outside the 200' notification area opposed the request. Public Hearing. Board of Adjustment Meeting Page 2 August 04, 1997 Agenda Item # 4 Continued, Larry Oliver, Chief Operational Officer of the Grapevine-Colleyville Independent School District, was present and said the school had been meeting for one (1) year at the church with a current enrollment of fifty-four (54) students in the program that is in operation as a normal school year. Students must apply and be accepted into the program. Mr. Oliver further said, the need for the portable buildings is for two (2) years until they have a permanent building within the school district. Marilyn Rice, Bridges Learning Center, said the school had been in the Junior High School for two (2) years when the Episcopal Church offered their facility. Ms. Rice also said there were two (2) or three (3) students from the Southlake Area attending. Tom Ward, 2401 Greenbough, said he was the Spin 6 Representative and reported that at a recent spin meeting attended by thirty-five (35) property owners within the area spoke in opposition to the request. He presented Ms. Gandy with some information concerning separation of Church and State. Randy Chambers, 520 Shady Lane, spoke in opposition to the request as to the backyard view of older metal buildings and the depreciation to his property. Mr. Oliver also ask why the school district could not locate the buildings at either the Grapevine or Colleyville High School. Mr. Oliver's rebuttal - he said the district would screen if necessary and under pin the eleven (11) year old 24 X 60 foot buildings with metal siding. Mr. Oliver further said the district does not have a fall back plan. Ms. Rice's rebuttal - she said, it is for the best interest of the Bridges students not to be on the same campus with the students at Grapevine or Colleyville high schools. Melinda Chambers, 520 Shady Lane, spoke in opposition to the request. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. After a lengthy discussion, a motion was made to amend the portable buildings from three years to one year for classrooms Motion: Troy Second: Cienki Ayes: Troy, Cienki, Sorenson, Joyce Nays: Kemp Vote: 4 - 1 to amend A motion was made to grant ZBA Case # 274 a Special Exception Use permit per Ordinance No. 480, Section 44.12(7) for two (2) portable buildings, for a period of one (1) year, to be used as classrooms for high school students and waive the permanent foundation and 80% masonry requirements. Motion: Troy Second: Cienki Ayes: Troy, Cienki, Sorenson, Joyce Nays: Kemp Vote: 4 - 1 to grant for one (1) year Agenda Item #5 Meeting Adjourned.
