LeVrier, Alternate #2 MEMBERS ABSENT: Susan Johnson, Alternate #1, & Mike Sandlin, Chairman STAFF PRESENT: Ben Bryner, Planner; Mardenna Gullinese, Secretary. Agenda Item #1 Call to Order: The Zoning Board of Appeals meeting for July 12, 2001 was called to order at 6:30 p.m. by Vice-Chairman Lewis Miltenberger. Agenda Item #2 Approval of the Minutes: The minutes of the June 28 h meeting were deemed approved by the Chair as presented. Motion: Reynal Second: Smart Ayes: Troy, LeVrier, Reynal, Smart Nays: 0 Abstain: Miltenberger Vote: 4-0-1 to approve Agenda Item #3 Administrative Comments. Ben Bryner, Planner, stated that the Orientation meeting would be held with the next scheduled ZBA meeting on August 16, 2001. The meeting is tentatively scheduled for 5:30 so that the City Attorneys may be present. The July 26`h meeting is cancelled due to a lack of submittals. Agenda Item #4 ZBA Case #373 Special Exception. Case ZBA-373, Special Exception Use permit per Ordinance No. 480, Section 44.12 (3) for construction of an accessory building of a size greater than permitted under the requirements of the zoning district. Location: 909 Suffolk Court, being legally described as Lot 5R, Block 3, Coventry Manor Phase II, being approximately 1.74 acres. Current Zoning: "R-PUD" Residential Planned Unit Development District. Owner/Applicant: Lynn M. Dixon. Public Hearing Zoning Board of Adjustment Meeting page 2 July 12, 2001 Agenda Item #4 ZBA Case #373 (con't) Mr. Ben Bryner, Planner, reported that fourteen (14) notices were sent to property owners within 200 feet, and there was one (1) responses (zero (0) in favor, zero (0) opposed and one (1) undecided) to the request. Lynn Dixon, homeowner, was present requesting a Special Exception Use Permit. There was no other person wishing to speak either in favor of, or in opposition to, the request. Public Hearing Closed. The findings were stated by Lewis Miltenberger. A motion subject to the findings was made to approve ZBA Case #373 as presented. Motion: Troy Second: Smart Ayes: Smart, LeVrier, Troy, Reynal , and Miltenberger Vote: 5 - 0 to approve Agenda Item # 5 Meeting Adjourned. A motion was made to adjourn the meeting.
