LeVrier, Alternate #2 MEMBERS ABSENT: Lewis Miltenberger, Susan Johnson, Alternate #1, & Mike Sandlin, Chairman STAFF PRESENT: Ben Bryner, Planner; Mardenna Gullinese, Secretary. Agenda Item 41 Call to Order: The Zoning Board of Appeals meeting for June 28, 2001 was called to order at 6:40 p.m. by Acting Chairman John Reynal. Agenda Item #2 Approval of the Minutes: The minutes of the meeting were deemed approved by the Chair as presented. Motion: Troy Second: Smart Ayes: Troy, LeVrier, Reynal Nays: 0 Abstain: Smart Vote: 3-0-1 to approve Agenda Item 43 Administrative Comments. Ben Bryner, Planner, stated that the next meeting would be held July 12, 2001 at the Council Chambers at 1400 Main St. Immediately following the meeting, there will be an Orientation meeting for new members. A,zenda Item #4 ZBA Case #374 Special Exception. Case ZBA-374, Renewal of an existing Special Exception Use permit per Ordinance No. 480, Section 44.12 (7) for one (1) portable building to be used as temporary facilities for children attending the school. Location: 1325 N. White Chapel Boulevard, being legally described as Lot 1, Peck Addition, being approximately 2.4 acres. Current Zoning: "CS" Community Service District. Owner: Liana Baccus Oram. Applicant: The Clariden School. Public Hearing Zoning Board of Adjustment Meeting page 2 June 28, 2001 Agenda Item #4 ZBA Case #374 (con't) Mr. Ben Bryner, Planner, reported that nine (9) notices were sent to property owners within 200 feet, and there was three (3) responses (three (3) in favor, zero (0) opposed) to the request. Johnny Campbell was present requesting a Renewal of an existing Special Exception Use Permit. There was no other person wishing to speak either in favor of, or in opposition to, the request. Public Hearing Closed. The findings were stated by John Reynal. A motion subject to the findings was made to approve ZBA Case #374 as presented. Motion: Smart Second: Troy Ayes: Smart, LeVrier, Troy, Reynal Vote: 4 - 0 to approve Agenda Item #5 ZBA Case #375 Special Exception. Case ZBA-375, Variance to Ordinance No. 480, Section 34.2a, requiring all accessory buildings having a permanent foundation to be erected no closer than ten (10) feet to a property line located in the rear yard. The applicant is requesting a variance to allow an existing storage building two and a half (2 '/2) feet from the property line. Location: 702 Gateshead Court, being legally described as Lot 6, Foxborough Addition, being approximately 0.583 acres. Current Zoning: "SF-20A" Single-Family Residential District. Owner and Applicant: Gary & Kelly DeFratus. Mr. Bryner, Planner, reported that twelve (12) notices were sent to property owners within 200 feet and there were six (6) responses. Five (5) in favor and one (1) opposed to the request. Public Hearing. Richard Cheatham, attorney for the homeowner/applicant, was present requesting a variance.
