CITY OF SOUTHLAKE 1400 Main Street BOARD OF ADJUSTMENT MEETING May 10, 2001 6:41 P.M. MEMBERS PRESENT: Mike Sandlin, Chairperson; Lewis Miltenberger, John Reynal, Susan Johnson, Alternate #1. MEMBERS ABSENT: John Smart, Ron Troy, Alternate #2. STAFF PRESENT: Ben Bryner, Planner; Dennis Killough, Planner; Mardenna Gullinese, Secretary. Agenda Item #2 Approval of the Minutes. The minutes of the meeting were deemed approved by the Chair as presented. Motion: Miltenberger Second: Johnson Ayes: Johnson, Reynal, Sandlin Nays: None Abstain: Miltenberger Vote: 3-0-1 to approve Agenda Item #3 Administrative Comments. There were no Administrative Comments. Agenda Item #4 ZBA Case #367 Special Exception ZBA Case #367, Special Exception Use permit per Ordinance No. 480, Section 44.12 (1 ) for servant's quarters. The applicant is requesting a family quarters of approximately one thousand (1,000) square feet detached form the principal residential dwelling. Location: 2403 Hillside Court, being legally described as Lot 5 Hillside Estates, being approximately 1.0 acre. Current Zoning: "SF-lA" Single-Family Residential District. Owner and Applicant: Bobby Cunningham. Mr. Ben Bryner, Planner, reported that eleven (11) notices were sent to property owners within 200 feet, and there were four (4) responses (three (3) in favor, zero (0) opposed and one (1) undecided) to the request. Public Hearing. Bobby Cunningham, owner/applicant was present requesting a Special Exception Use for family quarters. Zoning Board of Adjustment Meeting page 2 May 10, 2001 Agenda Item # 4 continued. Yvette Gallagher residing at 2307 Hillside Ct., was present to oppose the Special Exception Use permit. There was no other person wishing to speak either in favor of, or in opposition to, the request. Public Hearing Closed. The findings were stated by Mr. Sandlin. A motion subject to the findings was made to approve ZBA Case #360 as presented. Motion: Johnson Second: Miltenberger Ayes: Johnson, Reynal, Miltenberger, Sandlin Vote: 4 - 0 to approve Agenda Item #5 ZBA Case #368 ZBA Case # 368, Variance to Ordinance No. 480, Section 22.5 © requiring lots in the "C-3" General Commercial District to have side yards not less than fifteen (15) feet. The applicant is requesting to have a side yard of not less than seven (7) feet. Location: 225 Kimball Avenue, being legally described as Lot 2, Block 1, Kimball / 1709 Addition, and being 0.66 acres. Current Zoning: "C-3" General Commercial District. Applicant: Panda Management Company, Inc. Mr. Bryner, Planner, reported that six (6) notices were sent to property owners within 200 feet and there was no response. Public Hearing. Rob Adams, Panda Management Inc. was present requesting a side yard variance. There were no other person wishing to speak either in favor of or in opposition to the request. Public Hearing Closed The findings were stated by Mr. Sandlin. Zoning Board of Adjustment Meeting page 3 May 10, 2001 Agenda Item # 5 continued. A motion subject to the findings was made to approve ZBA Case #368 as presented. Motion: Johnson Second: Reynal Ayes: 0 Nays: 4 Vote: 0 - 4 to deny Agenda Item #6 ZBA Case #369 ZBA Case #369, Variance to Ordinance No. 480, Section 11.5 (b) & (d), requiring lots in the " SF-IA" Single-Family Residential District to have front and rear yards not less that forty (40) feet. The applicant is requesting to have front and rear yards of not less than twenty (20) feet. Location: 1210 E. Dove Street, being approximately 2.26 acres. Current zoning: "SF-lA" Single-Family Residential District. Owner /Applicant: Allegheny Land Company. Mr. Bryner, Planner, reported that seventeen (17) notices were sent to property owners within 200 feet, and there were four (4) responses (zero (0) in favor and four (4) opposed) to the request. Public Hearing. Art Clayton was present requesting a front and back yard variance for Allegheny Land Company. Ms. Jara Mclean residing at 1301 Emerald Circle spoke in opposition to the request. Public Hearing Closed. The findings were stated by Mr. Sandlin. A motion subject to the findings was made to approve ZBA Case #369 as presented. Motion: Miltenberger Second: Reynal Ayes: Johnson, Reynal, Miltenberger, Sandlin Vote: 4 - 0 to approve Zoning Board of Adjustment Meeting page 4 May 10, 2001 Agenda Item # 7 Meeting Adjourned.
