Carroll Avenue BOARD OF ADJUSTMENT MEETING October 12, 2000 7:00 p.m. MEMBERS PRESENT: Ralph Evans, Chairperson; Mike Sandlin, Vice Chairperson; John Smart, Lewis Miltenberger, John Reynal, Susan Johnson, Alternate #1 MEMBERS ABSENT: Ron Troy, Alternate #2 STAFF PRESENT: Karen Gandy, Sr. Planner; Arthur Wright, Planner; Jean Bryson, Secretary Call to Order: Mr. Ralph Evans, Chairman. Agenda Item #2 Approval of the Minutes. The minutes of the September 14, 2000 meeting were deemed approved by the Chair as presented. Motion: Miltenberger Second: Smart Ayes: Reynal, Miltenberger, Smart, Evans Abstained: Sandlin Nays: None Vote: 4-1-0 to approve Agenda Item #3 Administrative Comments. Ms. Gandy, Sr. Planner, stated on the next agenda a meeting time will be considered. Mr. Art Wright, Planner, reported there would not be a meeting October 26, 2000. Agenda Item #4 ZBA Case # 356 Variance and Special Exception Case ZBA-356, Variance to Ordinance No. 480, Section 34.2(e) for the construction of an accessory building greater than one story or fourteen (14) feet in height as defined by the Uniform Building Code, and a Special Exception Use permit per Ordinance No. 480, Section 44.12 (3) for the construction of accessory buildings or structures of a size or aggregate size greater than the one thousand (1,000) square feet permitted in the "SF-IA" Single Family Residential District. The applicant is requesting to have an accessory building with a height of fifteen feet (15') as defined by the Uniform Building Code, and to have an accessory building with a total area of approximately two thousand seven hundred and thirty-five (2,735) square feet. Location: 1250 and 1274 Shady Oaks Drive, being legally described as Lots 3 & 4, T. M. Hood No. 706 Addition, and being approximately 5.89 acres. Current zoning is "SF-1 A" Single Family Residential District. Owner/applicant is Anne Dahlson. City of Southlake, Texas Zoning Board of Adjustment Meeting page 2 October 12, 2000 Agenda Item # 4 continued Mr. Wright, Zoning Assistant, reported that Sixteen (16) notices were sent to property owners within 200 feet and there were three (3) response two (2) in favor and one (1) response opposed to the request Mr. Wright stated the applicant has submitted a revised request to have an accessory building with a total area of approximately two thousand four hundred (2,400) square feet. The applicant has reduced the height of the building to comply with the fourteen (14) foot height requirement; therefore the height variance for this building will not be necessary. Public Hearing Mr. Rick Dahlson, was present requesting the Special Exception Use permit for approximately one thousand, four hundred (1,400) square feet to allow the barn to have a total area of approximately two thousand, four hundred (2,400) square feet. and presented pictures and literature to the board members. Ms. Anne Dahlson, Owner/Applicant, stated the need for the barn and presented literature on the roof. Mr. Lawrence Marshall, 905 Parkview, spoke in opposition to the request. Rick and Anne Dahlson made a rebuttal to Mr. Marshall's statements. There was no other person wishing to speak either in favor of or in opposition to the request. Public Hearing Closed. The findings were stated by Mr. Evans. A motion subject to the findings was made to approve ZBA Case No.356 Special Exception as presented. Motion: Miltenberger Second: Sandlin Ayes: Reynal, Miltenberger, Smart, Sandlin, Evans Nays: None Vote: 5-0 to approve City of Southlake, Texas Zoning Board of Adjustment Meeting page 3 October 12, 2000 Agenda Item #5 Meeting Adjourned.
