Evans, Chairperson; John Smart, John Raynal, Susan Johnson, Alternate # 1. Members Absent: Mike Sandlin, Vice Chairperson; , Lewis Miltenberger, Ron Troy, Alternate # 2. Staff Present: Bruce Payne, Planning Director; Tara Brooks, Planner; Jean Bryson, Secretary. Agenda Item # 2 Approval of Minutes. The minutes of the January 11, 2001 Regular Board of Adjustment meeting were deemed approved by the Chair as corrected. Motion: Smart Second: Johnson Ayes: Johnson, Smart, Evans Abstained: Reynal Nays: None Vote: 3 - 1 - 0 to approve Agenda Item # 3 Administrative Comments. There were no Administrative Comments. Agenda Item # 4 ZBA Case # 359 Appeal ZBA Case 359, Appeal of the Administrative Official's decision, per Ordinance No. 480, Section 6.9.a (1) and (2), regarding the abandonment of legal nonconforming status of a concrete batch plant. Location: 1635 Brumlow Avenue, being legally described as Tract 2A, Brumlow Industrial District, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Volume 388-113, Page 442, Plat Records, Tarrant County, Texas. Current Zoning: "I-1" Light Industrial District. Appellant is Hanson Aggregate Central, Inc. Mr. Bruce Payne requested ZBA Case # 359 be tabled to the next regular meeting or at a time all parties would be present. The applicant is requesting a servants quarters of approximately seven hundred ten (710) square feet housed within the principal residential dwelling. Location: 1825 Maranatha Way being legally described as Tracts 2A3, 2A3A, 2A3A1, 2A3B, 2A5 being approximately 18.419 acres, and being situated in the William Martin Survey, Abstract No. 1068. Current Zoning: "AG" Agricultural District and "SF-1B" Single Family Residential District. Owner and Applicant: Yin Chun Chang. Ms. Brooks stated that eight (8) notices were sent to property owners within 200 feet. There were two (2) responses in favor of the request. Public Hearing. The owner applicant/applicant was not present. Mr. Jimmy Van, 1710 Randol Mill Ave. stated his concerns and he was undecided. He submitted two (2) completed response forms. Due to the absence of the owner/applicant a motion was made to table ZBA Case No. 360 to the next regular meeting or a date when the applicants would be present. Motion: Johnson Second: Smart Ayes: Johnson, Reynal, Smart, Evans Nays: None Vote: 4 - 0 to table Zoning Board of Adjustment Meeting page 3 January 25, 2001 Agenda Item # 6 ZBA Case # 361 Variance ZBA Case # 361, Variance to Ordinance No. 480, Section 11.5 (a) which requires a maximum building height of thirty - five feet (35') or 2 -1/2 stories in the "RE" Residential Estate District. The applicant is requesting a three (3) story building. Location: Lot 11, Hiram Granberry No. 581 Addition being approximately 5.715 acres Situated in the Hiram Granberry Survey, Abstract No. 581. Applicant: Tom Struhs. Owner: John and Tyler Kuelbs. Ms. Brooks, Planner, reported that ten (10) notices were sent to property owners within 200 feet and there were two response one (1) in favor and one (1) response opposed to the request Public Hearing. Greg Mattson, representing the applicant, was present requesting a variance for the height of the primary structure and stated that by granting this variance in no way release the applicant from meeting building codes which are required for certain 3-story residential strucrtures. Tyler Kuelbs, owner, was present requesting the variance. Scott Park, 211 White Chapel Ct. was present stating his opposition and the opposition of his neighbors. Mr. Parks presented eleven (11) completed notices of opposition. C. D. Peoples, Attorney, represting the homeowners in the area stating opposition. Mr. Greg Mattson made a rebuttal. There was no other person wishing to speak either in favor of or in opposition to the request. Public Hearing Closed. The findings were stated by Mr. Evans. A motion subject to the findings was made to approve ZBA Case No. 361 as presented. Zoning Board of Adjustment Meeting page 4 January 25, 2001 Agenda Item # 6 continued.
