The Minutes of the December 16, 1999 meeting were deemed approved by the Chair as
presented.

Mr. Wright, Zoning Assistant, reported the next meetings would be February 10 and 24, 2000.
Agenda Item # 4 Continuation ZBA # 329
Consider: Case ZBA-329, Variance to Ordinance No. 480, Section 34.2(e) for the construction of
an accessory building greater than one story or fourteen (14) feet in height as defined by the
Uniform Building Code, and a Special Exception Use permit per Ordinance No. 480, Section
44.12 (3) for the construction of accessory buildings or structures of a size or aggregate size
greater than the one thousand (1,000) square feet permitted in the "SF-1A" Single Family
Residential District. The applicant is requesting to have an accessory building with a height of
fourteen and one-half feet (14'6") as defined by the Uniform Building Code, and to have
accessory buildings with a total area of one thousand six hundred and twenty (1,620) square feet.
Location: 535 Love Henry Court, being legally described as Lot 8, Block 1, Southlake Estates,
and being situated in the L.B.G. Hall Survey, Abstract No. 686, and being approximately 1.765
acres. Current zoning is "SF-IA" Single Family Residential District. Owners/Applicants:
Francis Nathan and Lisa Bailey
The owner applicant requested ZBA Case # 329 to be tabled. to the February 24 th meeting.

Agenda Item #5. ZBA Case # 336 Variance.
ZBA-336, Variance to Ordinance No. 480, Section 11.5 (b), requiring lots in the "SF-IA" Single
Family Residential District to have front yards of not less than forty feet (40'). The applicant is
requesting to have the main dwelling encroach not more than fifteen (15) feet into the front yard
setback. Location: 1420 Laurel Lane, being legally described as Lot 1, Block 1, Laurelwood Park
Addition, situated in the T. Beedy Survey, Abstract No. 72, and being approximately 1.0 acre.
Current zoning: "SF-IA" Single Family Residential District Applicant: John Parker. Owner:
Millennium Dream Homes.
Mr. Wright reported there were 10 notices sent to property owners within 200 feet and there were
5 responses (two (2) in favor three (3) in opposition to the request).
Public Hearing.
John Parker, applicant, was present requesting to encroach fifteen (15') feet into the side yard
along Peytonville Avenue; which is considered a second front yard and has a 40' setback. Mr.
Parker said there is an eight (8') foot subdivision fence on the Peytonville Avenue side.
There was no other person wishing to speak either in favor of or in opposition to the request.
Public Hearing Closed.
The findings were stated by Mr. Evans.

Agenda Item # 6 Variance
Case ZBA-337, Variance to Ordinance No. 480, Section 7.4, which requires that no more than
one dwelling shall be on a single family residential lot. The applicant is requesting a variance to
allow the existing house to remain on the lot until a new house is constructed, at which time the
existing house will be removed. The location is 4001 T.W. King Road, being legally described
as Tract 20 situated in the Reis D. Price Survey, Abstract No. 992D, and being approximately
2.0 acres. Current zoning is "AG" Agricultural District. Owner/applicant is Linnia Johnson.
Mr. Wright reported there were four (4) notices sent to property owners within 200 feet with two
(2) responses in favor to the request.
Public Hearing.
The applicant was not present.
There was no person wishing to speak either in favor of or in opposition to the request.
Public Hearing Closed
The findings were stated by Mr. Evans.
A motion to approve ZBA Case # 336 as requested with the condition a Certificate of Occupancy
is not to be issued until the existing home is demolished with a time limit of nine (9) months
after issuing a building permit.
