Agenda Item # 1 Call to Order: Acting-Chairman Waldman called the meeting to order at 6:30:08 p.m. Agenda Item # 2 Approval of the Minutes: The minutes of the October 12, 2006 Regular Zoning Board of Adjustment meeting were deemed approved at 6:31:03 p.m. by Acting-Chairman Waldman as presented. Motion: Jain Second: Cornish Ayes: Bramley, Jain, Waldman, Cornish Nays: None Abstain: McSweeney Vote: 4-0-1 to Approve Agenda Item # 3 Administrative Comments: Mr. Bryner, Planner II, announced the next meeting will be on November 16, 2006. Acting-Chairman Waldman called for a break at 6:32:56 p.m. Acting-Chairman Waldman called the meeting to order at 6:35:20 p.m. Acting-Chairman Waldman read the meeting format outline. Agenda Item #4 ZBA Case #499, Special Exception Use Permit for a servant/family quarter. Case ZBA-499, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (1), for servant/family quarters. The applicant is requesting to have a family quarter as part of the main residence. The property is located at 2950 Burney Lane, being legally described as Lot 8, Block 2, Harbor Oaks, and being approximately 1.92 acres. Mr. Bryner reported that fifty-one (51) notices were sent within 200 feet and within the subdivision with six (6) responses, Errol & Leslie Housmans, 2970 Burney Lane, Southlake, Texas in favor, Martin & Mary O'Conner, 2965 Burney Lane, Southlake, Texas in favor, Mary & Randy Staples, 1080 Harbor Haven, Southlake, Texas in favor, Gilbert Hitchcock, 1110 Harbor Haven, Southlake, Texas in favor, Steve & Jenna Chitwood, 1070 Harbor Haven, Southlake, Texas opposed, John & Lynda Stewart, 2920 Burney Lane, Southlake, Texas in favor. The applicant Darin & Michele Winn, 429 Marshall Road, Southlake, Texas once sworn in, presented items to the Board and answered questions. Vice-Chairman Standerfer arrived at the meeting at 6:44:45 p.m. Acting-Chairman Waldman opened the public hearing at 6:50:14 p.m. John Wilson, 2930 Burney Lane, Southlake, Texas after being sworn had several questions as to what constituted a servant/family quarters and did this make a multifamily dwelling if approved? Ben responded to Mr. Wilson's concerns and at that point Mr. Wilson was not opposed to the servant/family quarters. Acting-Chairman Waldman closed the public hearing at 6:56:49 p.m. Brook Bramley made a motion to approve ZBA case # 499 as presented; noting that the quarters must be occupied by family or domestic servant and not used otherwise as a separate dwelling. Case ZBA-500, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (1), for servant/family quarters. The applicant is requesting to have a family quarter as part of an accessory building. The property is located at 1224 Wyndham Hill Lane, being legally described as Lot 37R., Block 2, Monticello Phase III, and being approximately 2.261 acres. Mr. Bryner reported that one hundred six (106) notices were sent within 200 feet and within the subdivision with eight (8) responses, Tern M. The applicant's representative Craig Rothmeier, 618 Regency Crossing, Southlake, Texas once sworn in, presented items to the Board and answered questions. Acting-Chairman Waldman opened the public hearing at 7:14:34 p.m. Jim Dawson, 1300 Concord Avenue, Southlake, Texas once sworn in opposed ZBA case # 500. He presented a hand out and audio of the Board meeting 7/14/2005 stating Mr. Disiere withdrew his request in 2005; therefore, should not be allowed to come back and reapply. Also, Mr. Dawson felt this would lead to others wanting to add servant/family quarters to their properties and this would change the dynamics of the subdivision. Acting-Chairman Waldman gave Mr. Rothmeier an opportunity for rebuttal. Mr. Cornish left the meeting at 7:41:50 p.m. Acting-Chairman Waldman closed the public hearing at 7:42:16 p.m. Mr. Cornish returned to the meeting at 7:42:41 p.m. Vice-Chairman Standerfer made a motion to approve ZBA case # 500 as presented with the stipulation that the servant/family quarters are not being used for rental purposes. Motion: Vice-Chairman Standerfer Second: Cornish Ayes: Bramley, Jain, Waldman, Standerfer, Cornish Nays: None Abstain: None Vote: 5-0-0 to Approve Mr. Cornish left the meeting at 7:50:10. Agenda Item #6 ZBA Case #501, Special Exception Use Permit for accessory buildings of an aggregate size greater than permitted in the zoning district and located in the front yard. Case ZBA-501, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (3) permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies and a Special Exception Use Permit per Ordinance No. 480, Section 44.12 (4), for accessory buildings located in the front yard. The applicant is requesting to construct a breezeway of approximately four hundred (400) square feet making the total square footage for accessory buildings to be approximately three thousand eight hundred (3,800) square feet with the accessory building being located in the front yard. The property is located at 1224 Wyndham Hill Lane, being legally described as Lot 37R, Block 2, Monticello Phase III, and being approximately 2.261 acres. Acting-Chairman Waldman opened the public hearing at 8:01:25 p.m. Jim Dawson, 1300 Concord Avenue, Southlake, Texas still sworn in asked the board to clarify a single structure and accessory structure. Vice-Chairman Standerfer addressed the question and Mr. Dawson was satisfied with his response. Acting-Chairman Waldman closed the public hearing at 8:03:10 p.m. Acting-Chairman Waldman reopened the public hearing at 8:07:59 p.m. allowing Mr. Rothmeier to answer questions for the Board. Acting-Chairman Waldman closed the public hearing at 8:10:21 p.m. Vice-Chairman Standerfer made a motion to approve ZBA case # 501 as presented with the following stipulations that this is a denial of the request to consider the house, garage, and breezeway as a single structure, the garage and breezeway constitute an accessory structure. Furthermore, requiring the columns in the breezeway not be metal and the construction match the roof, masonry, and stonework material as the house and garage.
