2006-09-28 REGULAR ZONING BOARD OF ADJUSTMENT City of Southlake 1400 Main Street, Southlake, Texas Southlake, Texas 76092 MEETING DATE: September 28, 2006 MEMBERS PRESENT: Vice-Chairman Greg Standerfer; Michael Waldman; John Smart; Kristin Jam, A ternate #1; Frank Cornish, Alternate #2; Brook Bramley, Alternate # 3; Anita McSweeney, Alternate #4. MEMBERS ABSENT: Chairman Lewis Miltenberger; Danny Mayer; STAFF PRESENT: Ben Bryner, Senior Planner; and Dianna Brawner, ZBA Secretary. Agenda Item # 1 Call to Order: Vice-Chairman Standerfer called the meeting to order at 6:30:18 p.m. Agenda Item # 2 Approval of the Minutes: The minutes of the September 14, 2006 Regular Zoning Board of Adjustment meeting were deemed approved at 6:30:47 p.m. by Vice-Chairman Standerfer as presented. Motion: Jain Second: Waldman Ayes: Bramley, Jain, Vice-Chairman Standerfer, Waldman, Cornish, Smart Nays: None Abstain: McSweeney Vote: 6-0-1 to Approve Agenda Item # 3 Administrative Comments: Mr. Bryner, Senior Planner, announced the next meeting will be on October 12, 2006. Agenda Item #4 ZBA Case #493, Special Exception use Permit for an accessory building of a size greater than permitted and Variance to the permitted height. Case ZBA-493, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (3) permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies and a Variance to Ordinance No. 480, Section 34.2(e) requiring an accessory building no greater than one story of fourteen (14) feet in height. The applicant is requesting to construct an accessory building of approximately on thousand eight hundred (1,800) square feet making the total square footage for accessory buildings to be approximately two thousand two hundred (2,200) square feet with the proposed accessory building having a height of approximately twenty (20) feet. The property is located at 2407 Florence Road, being legally described as Lot 3, J.J. Freshour No. 521 Addition, and being approximately 3.93 acres. Mr. Bryner reported that ten (10) notices were sent within 200 feet of property and one (1) response Mike Kaiser, 2306 Hillside Court, Southlake, Texas in favor. A response was also received at the meeting: Matt Randall, 2391 Florence Road, Southlake, Texas in favor. Vice-Chairman Standerfer read the meeting format outline. The applicant Roger Haverkamp, 2407 Florence Road, Southlake, Texas presented items to the Board and answered questions. Vice-Chairman Standerfer opened and closed the public hearing at 6:40:45 p.m. Vice-Chairman Standerfer swore in John Spencer contractor for Mr. Haverkamp to answer questions for the Board at 6:47:42. Michael Waldman made a motion to approve ZBA case # 493 Variance as presented subject to removal of the present storage building. Motion: Waldman Second: Smart Ayes: Vice-Chairman Standerfer, Waldman, Cornish Nays: Jain, Smart Abstain: None Vote: 3-2-0 Motion Does Not Carry Mr. Cornish left the meeting at 7:09:28 and returned at 7:12:22. After much additional discussion a new motion was not made ZBA Case # 493 Variance did not pass. Mr. Smart left the meeting at 7:15:08. Agenda Item #5 ZBA Case #494, Special Exception Use Permit for portable buildings. Case ZBA-494 Special Exception Use Permit per Ordinance No. 480, Section 44.12 (7) for portable buildings. The applicant is requesting to place one temporary portable building at Bethel Methodist Church of Southlake for Sunday school classrooms. The applicant is requesting to place one (1) portable building at Bethel Methodist Church to meet their current needs for Sunday school space. Approval of a portable building shall be on a temporary basis only and shall be for a maximum period of three (3) years subject to renewal for an additional one (1) year period. The property is located at 190 S. White Chapel Boulevard, being legally described as Lot 4, H. Granberry No. 581 Addition, and being approximately 0.96 acres. Mr. Bryner reported that seven (7) notices were sent with no (0) responses received. The applicant Chuck Hallett, 6504 Horseshoe Bend, Colleyville, Texas presented items to the Board and answered questions. Vice-Chairman Standerfer opened and closed the public hearing at 7:25:29 p.m. . Kristin Jain made a motion to approve ZBA case # 494 Variance as presented. Motion: Jain Second: Bramley Ayes: Jain, Vice-Chairman Standerfer, Waldman, Cornish, Bramley Nays: None Abstain: None Vote: 5-0-0 to Approve Agenda Item #6 Meeting to Adjourn A motion was made to adjourn the meeting.
