MEMBERS ABSENT: Lewis Miltenberger; John Smart; Frank Cornish, Alternate #2; Vacant, Alternate 77- STAFF PRESENT: Ben Bryner, Planner II; Dianna Brawner ZBA Secretary. Agenda Item # 1 Call to Order: Chairman Standerfer called the meeting to order at 6:33:43 p.m. Agenda Item # 2 Approval of the Minutes: The minutes of the November 15, 2007 Regular Zoning Board of Adjustment meetings was not approved and Michael Waldman entered a motion to table the acceptance of the minutes until the next meeting January 10, 2008. Motion: Waldman Second: Muller Ayes: McSweeney, Jain, Waldman, Muller, Standerfer Nays: None Abstain: None Vote: 5-0-0 to Approve Agenda Item # 3 Administrative Comments: Mr. Bryner, Planner 11, announced the next scheduled meeting will be January 10, 2008. Deputy Director, Dennis Killough announced tonight is Ben Bryner's last meeting he will preside over, he has accepted a position with the City of Abilene as their Planning Program Administrator. On behalf of the Board and the City of Southlake, Mr. Killough extended his appreciation of Ben's seven years of dedication. Agenda Item #4 ZBA Case #535, Variance to minimum lot width. Case ZBA # 535, Variance to Ordinance No. 480, Section 10.5 (g) requiring a minimum lot width of three hundred (300) feet. The applicant is requesting to create a new lot that will have a lot width of approximately two hundred seventy-two (272) feet. The property is located at 1640 & 1680 N. Peytonville Avenue, being legally described as Tract 3B1 and a portion of Tract 3B, situated in the J. Childress Survey Abstract No. 253, and being approximately 5.00 acres. Mr. Bryner reported that nineteen (19) notices were sent within 200 feet with four (4) responses, Thomas & Karen Murphy, 1303 Plantation Dr., Southlake, TX opposed, Kurt & Melinda Fullmer, 1300 Post Oak Trl., Southlake, TX undecided, T.W. & Debra Glosser, 1800 Sleepy Hollow, Southlake, TX in favor, Ralph J. & Malora J. Nimergood, 1305 Plantation Dr., Southlake, TX opposed. The applicant Kelly Mulholland, 7413 Emerywood Lane, Ft. Worth, Texas once sworn in, presented items to the Board and answered questions. Chairman Standerfer opened the public hearing at 7:09:19 p.m. Ralph Nimergood 1305 Plantation Dr., Southlake, Texas spoke in opposition, concerned of the drainage effects with relation to the surrounding properties and the creek that flows through these two properties. Mr. Nimergood was also concerned about road access in and out for emergency vehicles. Michael Bustamante 1501 Plantation Dr., Southlake, Texas spoke in opposition, concerned of drainage into the creek. Neil Wheatley 1301 Plantation Dr., Southlake, Texas spoke in opposition, concerned of overdeveloping the property and the effects this would have on the wildlife. Tom Murphy 1303 Plantation Dr., Southlake, Texas spoke in opposition, concerned of overdeveloping the property and how that would affect the drainage and the creek. Kristen Jain entered a motion to approve ZBA Case # 535 as presented.
