2004-11-11 i REGULAR ZONING BOARD OF ADJUSTMENT City of Southlake 1400 Main Street, Southlake, Texas Southlake, Texas 76092 MEETING DATE: November 11, 2004 MEMBERS PRESENT: Donald Coonan, Vice-Chairman; Darrell Faglie; Rick Stacy; Robert Hudson, Alternate ; Michael Waldman, Alternate #3; and Danny Mayer, Alternate #4. MEMBERS ABSENT: Lewis Miltenberger, Chairman; John Smart; and David Lambert, Alternate #2. STAFF PRESENT: Ben Bryner, Planner; Jennifer Gonzales, ZBA Secretary. Agenda Item #1 Call to Order: Vice-Chairman Coonan called the meeting to order at 6:28:25 p.m. Agenda Item #2 Approval of the Minutes: The minutes of the October 28, 2004 Regular Zoning Board of Adjustment meeting were deemed approved by Vice-Chairman Coonan as presented. Motion: Stacy Second: Faglie Ayes: Hudson, Coonan, Faglie, Waldman, Mayer, Stacy Nays: None Vote: 6 - 0 to Approve Agenda Item #3 Administrative Comments: Mr. Bryner, planner, announced because of Thanksgiving Holiday the November 25 meeting will be cancelled. The next possible meeting date will be on December 16, 2004. Staff will contact members if this meeting is necessary. Vice-Chairman Coonan read the meeting format outline. Agenda Item #4 ZBA Case # 439, Special Exception Use Permit for family quarters and an accessory building of a size greater than permitted in the zoning district Variance to the maximum impervious coverage: Special Exception Use Permit per Ordinance No. 480, Section 44.12 (1), permitting family quarters and Special Exception Use Permit per Ordinance No. 480, Section 44.12 (3), permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies. The applicant is requesting to construct an accessory building of approximately one thousand two hundred (1,200) square feet for the purpose of a family quarter. The property is located at 1449 Sunshine Lane, being legally described as Lot 2, Sunshine Place Addition, and being approximately 3.0 acres. Mr. Bryner reported that eleven (11) notices were sent to property owners within 200 feet and one (1) response was received. The applicant, James Wisniewski, 1449 Sunshine Lane, Southlake, TX, presented this item to the Board and answered questions. Viec-Chairman Coonan opened the public hearing at 6:40:43 p.m. No one in the audience came forward to speak. Vice-Chairman Coonan closed the public hearing at 6:40:52 p.m. A motion was made to approve ZBA-439 as presented. Motion: Faglie Second: Hudson Ayes: Waldman, Stacy, Hudson, Faglie, Coonan Nays: None Vote: 5 - 0 to Approve Agenda Item #5 ZBA Case # 440, Variance to the maximum impervious coverage: Variance to Ordinance No. 480, Section 21.5 (k) requiring a maximum impervious coverage not to exceed seventy (70%) percent of the total lot area. The applicant is requesting to have a maximum impervious coverage of approximately eighty (80%) percent. The property is located at 1695 E. Southlake Boulevard, being legally described as Lot 1R, Block 1, Miron Addition, and being approximately 0.51 acres. Mr. Bryner reported that eleven (11) notices were sent to property owners within 200 feet and two (2) responses were received. The applicant, Gary Miron, 1695 E. Southlake Boulevard, Southlake, TX, presented this item to the Board and answered questions. Vice-Chairman Coonan opened the public hearing at 6:53:06 p.m. No one in the audience came forward to speak.
