Item 4E - MemoCITY OF SOUTHLAKE Item 4E MEMORANDUM October 21, 2025 To: Alison Ortowski, City Manager From: Lauren LaNeave, Interim Director of Public Works Subject: Resolution No. 25-041, supporting the application of the City of Southlake to decertify a portion of Certificates of Convenience and Necessity (CCN) No. 10101 for water service with the Public Utility Commission of Texas, revising the service area boundary to remove portions overlapping the Town of Westlake. Action Requested: Resolution No. 25-041, supporting the application of the City of Southlake to decertify a portion of Certificates of Convenience and Necessity (CCN) No. 10101 for water service with the Public Utility Commission of Texas, revising the service area boundary to remove portions overlapping the Town of Westlake. Background Information: The City of Southlake holds Certificate of Convenience and Necessity (CCN) Number 10101 that grants Southlake the exclusive right and obligation to provide water service within the CCN boundary. A portion of this boundary extends within the Town of Westlake limits. The Town of Westlake's CCN does not currently extend into this area. A new residential development (Solana Hills) located between Sam School Road and State Highway 114 within the Town of Westlake was recently approved, and Westlake has requested this adjustment so they may provide water service in the area. Westlake staff reached out to Southlake staff earlier this year to discuss transfer of service area from Southlake to Westlake. Southlake is obligated to provide water service within our CCN, but we currently have no customers in this area. Transfer of service area requires Southlake to decertify the CCN area to be transferred so that Westlake can amend their CCN service area. Revisions to the CCN boundary will align with Southlake City limit boundary. Southlake staff and the City Attorney have reviewed the application and boundary adjustments and recommends approval of the resolution to amend and decertify the Page 1 of 3 Item 4E CCN area located within Westlake Town limits. Westlake's consultant will submit the applications jointly to the Public Utilities Commission of Texas so they can be processed at the same time. Financial Considerations: Approval of this resolution has no financial implications. NOW THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTHLAKE, TEXAS, THAT: The City Council of the City of Southlake hereby supports the filing of an application to decertify said portion of Certificates of Convenience and Necessity in Tarrant County, Texas with the Public Utility Commission of Texas.
