Agenda Item #1 Call to Order: Lewis Miltenberger, called the meeting to order at
6:36p.m.
Agenda Item #2 Approval of the Minutes.
The minutes of the September 26, 2002 Regular Zoning Board of Adjustment meeting
were deemed approved by the Acting Chair as presented.

Agenda Item #3 Administrative Comments
Planner Ben Bryner stated that the next meeting will be January 16, 2003
Agenda Item #4 ZBA Case # 401 Special Exception Use Permit.
Special Exception Use permit Ordinance No. 480, Section 44.12 (4) permitting the
construction of accessory buildings located in the front yard. The applicant is requesting
to construct a detached barn located in the front yard.
The location is 880 Harbor Court, being legally described as Lot 6, Huse Homplace, and
being approximately 3.876 acres.
Ben Bryner, planner, reported that sixteen (16) notices were sent to property owners
within 200 feet and there were three responses in favor of the request.
In response to questions from the board Ben Bryner stated that the building does meet
code and that the only issue is that it is located in front of the residence and that the
applicant will obtain a certificate of occupancy. Ward Flora, 880 Harbor Court,
Southlake, Texas, the applicant, requested the special exception use. He apologized for
not going through the proper channels for having the building erected. He was under the
impression that the builder would take care of the permitting issues. In response to the
boards questions the applicant stated that the building has been up since the Summer of
2000 and there is no plumbing. The building is used to store bicycles and a tractor. The
city became aware of the issue by a city inspector who was on site to oversee the drilling
of a well on the property.
Acting Chairman Miltenberger opened the public hearing at 6:48 p.m.
No one from the audience came forward to speak in favor or in opposition to this item.

The findings were stated by Acting Chairman Lewis Mitenberger.
A motion subject to the findings was made to approve ZBA Case # 401 as presented.
