Agenda Item #1 Call to Order: Mike Sandlin, Chairman, called the meeting to order
at 6:35 p.m.
Agenda Item #2 Approval of the Minutes.
The minutes of the June 27, 2002 Regular Zoning Board of Adjustment meeting were
deemed approved by the Chair as presented.

Vote: 3-0-2 to approve
Agenda Item #3 Administrative Comments.
Planner Ben Bryner stated that the next Zoning Board of Adjustment meeting would be
on August 29, 2002.
Chairman Sandlin moved case #398 to the front of the agenda.
Agenda Item # 5 ZBA Case # 398 Variance.
Per the applicant's written request, the board voted to table ZBA Case # 398 until the
August 29, 2002 Board of Adjustment meeting.

Vote: 4-0 to table.
(Mr. Miltenberger reclused himself from this case.)
The Board requested that more detailed, information be submitted on this case.
Agenda Item #4 ZBA Case # 397 Variance.
Variance to Ordinance No. 480, Section 33.5 (a) restricting the overall height of a church
building when attaching a spire/steeple on or above the roof level of the building from
exceeding fifty (50) feet. The applicant is requesting a variance to allow construction of
a cross on top of the proposed church resulting in a total building height of seventy (70)
feet.
The location is 2121 E. Southlake Boulevard, being legally described as Lot 1, Block 1,
Gateway Church Addition, and being approximately 13.675 acres. The owner is Gateway
Church, the applicant is WD Partners, Current Zoning is "CS" Community Service
District and the Land Use Category is Office Commercial.
Ben Bryner, planner, reported that seventeen (17) notices were sent to property owners
within 200 feet and there was one (1) response in favor of the request and one (1)
response undecided.
Scott Windle, WD Partners, 2350 Valley View, Dallas, Texas, representing the applicant,
requested the variance, and answered questions from the board. He stated that the cross
would be most visible from people traveling west on E. Southlake Boulevard.
Chairman Sandlin opened the public hearing at 6:51:20 p.m.
No one from the audience came forward to speak in favor or in opposition to this item.
Chairman Sandlin closed the public hearing at 6:51:50 p.m.
The findings were stated by Chairman Sandlin.
A motion subject to the findings was made to approve ZBA Case # 397 as presented.

Agenda Item #6 ZBA Case # 399 Special Exception.
Case # 399 Special Exception Use permit per Ordinance No. 480, Section 44.12 (3)
permitting the construction of accessory buildings or structures of a size or aggregate size
greater than that permitted under the accessory building requirements of the zoning
district in which the property lies. The applicant is requesting to construct a detached
garage and carport that total approximately one thousand one hundred twenty-five
(1,125) square feet of floor area.
The location is 1602 Pheasant Lane, being legally described as Lot 2, Block 1, Hillwood
Estates, and being approximately 1.01 acres. The owner/applicants are Terry Mitchell
Builders, Inc. The Current Zoning is "SF-IA" Single-Family Residential District and the
Land Use Category is Low Density Residential.
Mr. Bryner, Planner, reported that thirteen (13) notices were sent to property owners
within 200 feet and there were three responses (3)' ifI favor to the request
Terry Mitchell, 1610 Pheasant Lane, Southlake, Texas, requested a variance and
answered questions from the board. Mr. Mitchell stated that the accessory building
would be constructed with the same design and materials of the house.
Chairman Sandlin opened the public hearing at 7:03 p.m.
There was no one wishing to speak either in favor of or in opposition to the request.
Chairman Sandlin closed the public hearing at 7:04 p.m.
The findings were stated by Mr. Sandlin.
Subject to these findings a motion was made to approve the special exception use
requested in ZBA Case # 399.
