Agenda Item #1 Call to Order: The Zoning Board of Adjustments meeting for February 28, 2002 was called to order at 6:34 p.m. by Acting Chairman, John Reynal Agenda Item #2 Approval of the Minutes: The minutes of the February 14, 2002 meeting were deemed approved by the Chair as presented. Motion: Smart Second: Troy Ayes: Reynal, Smart, & Troy Nays: 0 Abstain: LeVrier Vote: 3-0-1 to approve Agenda Item #3 Administrative Comments. There were no administrative comments. Agenda Item # 4 ZBA Case 9386 Special Exception Use Case ZBA-386, Special Exception Use permit per Ordinance No. 480, Section 44.12 (3) permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies. The applicant is requesting to have an accessory building with a total area of approximately one thousand one hundred (1,100) square feet. Location: 1815 Red Wing Ct., being legally described as Lot 72, Block 8, Myers Meadow Phase 3, and being approximately 0.37 acres. Owner / Applicants: James & Eileen Kingsley. Current Zoning: "NRPUD" Non-residential Planned Unit Development District. Ben Bryner, planner, reported that fifteen (15) notices were sent out, with two (2) responses in favor of the request, and one (1) undecided. Public Hearing Homeowner, James Kingsley, was present to request a Special Exemption Use permit. There was no other person wishing to speak in favor of, or opposition to, the request. Azenda Item #5 ZBA Case #387 Special Execption Use Case ZBA-387, Special Exception Use permit per Ordinance No. 480, Section 44.12 (3) permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies. The applicant is requesting to have accessory buildings with a total area of approximately one thousand four hundred fifty-eight (1,458) square feet. Location: 1416 Laurel Lane, being legally described as Lot 4, Block 1, Laurelwood Park Addition, and being approximately 1.00 acre. Owner / Applicant: G.A. Feris Current Zoning: "SF-IA" Single Family Residential District Land Use: Low Density Residential. Ben Bryner, planner, reported that nine (9) notices were sent out, with two (2) responses in opposition to the request. Public Hearing Applicant, G.A. Feris, asked to table the request until the next regularly scheduled meeting. Azenda Item #6 ZBA Case #388 Special Exception Use Case ZBA-388, Special Exception Use permit per Ordinance No. 480, Section 44.12 (3) permitting the construction of accessory buildings or structures of a size or aggregate size greater than that permitted under the accessory building requirements of the zoning district in which the property lies and Special Exception Use permit per Ordinance No. 480, Section 44.12 (1) permitting a family quarters. The applicant is requesting to have accessory buildings with a total area of approximately one thousand two hundred (1,200) Ben Bryner, planner, reported that seven (7) notices were sent out, with zero (0) responses in to the request. Public Hearing Homeowner, Gregory Fuller, was present to request a Special Exemption Use Permit There was no other person present to approve of, or in opposition to the request.
