Levrier, Alternate #2 & Chairman Mike Sandlin MEMBERS ABSENT: Ron Troy, John Smart, & Susan Johnson, Alternate 41 STAFF PRESENT: Ben Bryner, Planner; Mardenna Gullinese, Secretary. Agenda Item 41 Call to Order: The Zoning Board of Appeals meeting for January 10, 2002 was called to order at 6:38 p.m. by Chairman Mike Sandlin. Agenda Item #2 Approval of the Minutes: The minutes of the December 13, 2001 meeting were deemed approved by the Chair as presented. Motion: Reynal Second: Miltenberger Ayes: Reynal, Miltenberger, & Sandlin Nays: 0 Abstain: Levrier Vote: 3-0-1 to approve Agenda Item #3 Administrative Comments. There were no administrative comments. Agenda Item #4 ZBA Case 9383 Variance Case ZBA-383, Variance to Ordinance No. 480-179, Section VIII requiring specific distances for minimum setbacks. The applicant is requesting a variance to allow construction of a residential home to encroach up to a maximum ten (10) percent of the required setbacks. The address of the proposed new construction is 417 Marshall Rd., being legally described as Lot 21, Block 2, Kirkwood Hollow, and being approximately 0.51 acres. Cadence Homes requested to have Case #383 tabled until the next scheduled meeting. Agenda Item # 5 ZBA Case #384 Special Exception Use Case ZBA-384, Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size of one acre for the use of an on-premise septic tank and subsurface drainage field. The applicant is requesting a variance to allow construction of a residential home with on-premise septic tank and subsurface drainage field on a lot being less than one acre. Zoning Board of Adjustment Meeting page 2 January 10, 2002 Location being legally described as Tract 15 of the H.A. Throop Survey, Abstract No. 1273, and being approximately 0.95 acres. Owner/Applicants are Robin Amerine, Deborah Johnson, & TimBohannon. Ben Bryner, planner reported that eight (8) notices were sent out, with one (1) response in favor of the request. Public Hearing Eric Willoughby, agent for the sellers, was present to request a variance. There was no other person wishing to speak in favor of, or opposition to, the request. Public Hearing Closed The findings were stated by Mike Sandlin. A motion subject to the findings was made to approve ZBA Case #384 as presented. Motion: Miltenberger Second: LeVrier Ayes: Reynal, Miltenberger, LeVrier, & Sandlin Nays: none Vote: 4-0-0 to approve. Agenda Item #6 Meeting Adiourned A motion was made to adjourn the meeting.
