Dear Hr. Campbell:
I am enclosing a copy of the recorded Deed Restrictions
requiring underground utilities in Dove Estates.

Venture vehemently oppose any above ground utilities i n the
subdivision.
The City of Southlake has had calls from at least six
to eight homeowners opposing any type of above ground
utilities. My understanding from the City of Southlake is
you did not get permission from the Mayor to do such but he
simply stated that he didn't care.
One of the builders in the subdivision who is under
contract for ten lots is also a licensed electrician. He
assures me that the breaks and underground electrical lines
can be found by using a resistance type method to locate and
repair the breaks. We certainly have no objection to you
digging up any of your easements or coming on the property
to repair this thing. In fact, as of today, I am drawing
contracts in excess of twenty lots to be developed the first
part of next year. I feel sure any investment you make in
repairing the underground utilities will rapidly be repaid
by the new construction in the area. I also received a
phone call last night of another builder wanting to close on
another six to eight lots before the beginning of the year
which would bring the total somewhere between 28 and 30 lots
to be closed and built on in the first quarter of 1983. Of
course, all these builders want and expect underground
utilities from Tri-County.

You expressed a concern as to the development time of
the first developer. As you can see by the number of.
contracts which I will be happy to copy to hear your
counsel, we are moving forward at a very rapid pace and hope
to have the entire subdivision developed within a two year
period, if not sooner.
If you do not wish to go along with the Deed
Restrictions as enclosed,I would only have two
alternatives:
1. A lawsuit wherein substantial damages could be shown
for damages to trees as well as lost of sale lots.
2.Perhaps contracting with Texas Power and Light and
having you release your easements to them.
obviously we would prefer to stay with you and work
with you in every manner possible to an expedient
development and conclusion of this problem. Please notify
me or have your attorney or your superior notify me of your
decision as soon as possible so that we may take appropriate
action.
