AN ORDINANCE PROHIBITING THE FIRING OR DISCHARGE OF CERTAIN FIREARMS WITHIN THE CORPORATE CITY LIMITS OF SOUTHLAKE, TEXASD, REGULATING AND PROHIBITING THE FIRING, SHOOTING, DISCHARGING OF CERTAIN FIREARMS, AIR GUNS, AIR RIFLES AND AIR PISTOLS IN CERTAIN PLACES WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF SOUTHLAKE, TEXAS, PROVIDING FOR A PENALTY FOR VIOLATIONS A REPEALER CLAUSE AND AN EFFECTIVE DATE AND A SEVERABILITY CLAUSE. WHEREAS the City of Southlake, Texas, has increased in population since the enactment of the existing firearms ordinance to a population size that requires more control of firearms and other weapons of like nature the City Council of the City of Southlake deems it necessary and expedient to replace such existing ordinance with an ordinance of a more restrictive nature, and therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section One: It shall be unlawful for any person to fire, shoot or otherwise discharge within the corporate limits of the City of Southlake, Texas, any firearm of any kind or nature having a rifled bore or bore containing refling. Section Two: It shall be unlawful for any person to fire, shoot or otherwise discharge a firearm or pistol having a muzzle velocityof700feetpersecondofanynaturewithinthecorporatelimitsof the City of Southlake, Texas. Section Three: a)It shall be unlawful for any person to shoot,fire or otherwise discharge any rifle, shotgun, pistol or firearm of any nature within the corporate limits of the City of Southlake, Texas, when the projectile or solid object being discharged or propelled therefrom is a slug. b) For the purposes of this ordinance a "slug" is defined as any solid object, projectile or bullet upon which are contained riflings, and which can be fired, shot or discharged from a shotgun. Section Four:a)It shall be unlawful for any person to fire,shoot or otherwise discharge a shotgun within 500 lineal feet of anypublicstreet, highway or roadway or within 1000 lineal feet of anybusinessorresidentialstructureoranyschool, public or private, or of any occupied structure, within the corporate limits of the CityofSouthlake, Texas. b) For the purpose of subsection a) of this Section Four, the lineal distances prescribed shall be the shortest distance or distances by straight line between the public street, highway,roadway, business or residence structure, public or private school or any occupied structure and the point or location of the firing,shooting or discharging of the shotgun. Section Five:a)It shall be unlawful for any person to shoot,fire or otherwise discharge any air rifle or air pistol of anydescriptionornamethatoperatesbymeansofcompressedair, compressed gas, springs or any other means which is capable of discharging shots, pellets or any solid object at a velocity in excess of three hundred 300) feet per second, within 500 lineal feet of any public street, highway or roadway or within 1000 lineal feet of any business or residential structure or any school, public or private, or of any occupied structure, within the corporate limits of the City of Southlake, Texas. b) For the purpose of subsection a) of this Section Five, the lineal distances prescribed shall be the shortest distance or distances by straight line between the public street, highway,roadway, business or residence structure, public or private school or any occupied structure and the point of location of the firing,shooting or discharging of the air rifle or air pistol. Section Six: a)It shall be unlawful for any person to possess,shoot or ignite any "cannon cracker" within the corporate limits of the City of Southlake, Texas. b) For the purpose of this ordinance, a "cannon cracker" is defined as any combustible package of a length of two inches or more and of a width at the widest point of one inch or more, and containing explosive materials. Section Seven: Any police officer, peace officer, or other public officer authorized by legal authority or statute to carry afirearmshallbeexemptfromtheprovisionsofthisordinancewhen the act committed which would otherwise be a violation is within the scope or exercise of any official conduct or duty. Section Eight: Any person who violates any provision of this ordinance shall be guilty of a Class C misdemeanor, and uponconviction, shall be punished by a fine of not less than Ten 10.00)Dollars nor more than Two Hundred 200.00) Dollars. Each violation of a section of this ordinance and each individual act violative of the provisions of this ordinance shall be a separate and distinct offense hereunder punishable by fine as set forth above. Section Nine: Should any section of this ordinance be declared by the Courts to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any partthereof, other than the part so declared to be unconstitutional orinvalid. Section Ten: Repeal of Conflicting Ordinances: All ordinances or parts of ordinances in direct conflict with any of the provisionsofthisordinanceareherebyrepealedinsofarasthesameareindirectconflictwiththeprovisionshereof; however, any ordinancerequiringorcontainingamorestringentordetailedprovisionshallremaininforcetosuchextent. COUNCILPERSON z z PAGE:3 INDEX After extensive discussion, motion Latta x x was made to deny the permit requested Loris x on the grounds of increasing and McCombs x x magnifying traffic conditions. Motion was approved. A request was made by James Martin REQUEST asking for a variance to City FOR VARI. Ordinance No. 278, concerning the ANCE TO requirements for 75% masonary for ORDINANCE commercial structures. Mr. Martin NO. 278 made his request on the grounds that he was in the process of complying with building codes in order to obtain a building permit when the ordinance was passed. Mayor Sparger read a letter from City engineer, Eddie Cheatham, concerning the most current request for a build- ing permit. The letter stated that the plans were in compliance with building codes, except for minor modifications. Mr. James Martin was present and answered questions for the Council. Latta x x After discussion, motion was made Loris x x and approved to deny the request. McCombs x A report was given on the progress of the facilities project. The Department reports were discussed by Council. Approval was given for the purchase Latta x x of a radar unit and camera for Loris x the Police Department as per FY83 TcCombs x x Budget.
