An agreement between the City of Southlake and the Developer
of Lakewood Acres Phase II III for the installation of
certain community Facilities within and to service an addition
Lo the laity of Southlake, Tarrant County, Texas.

A. It is agreed and understood by the parties hereto that
the Developer shalt employ a civil engineer licu"sed
to practice in the `Mate of Texas for the des i tan and
preparation of the plans and specifications for the
construction of all facilities covered by this
agreement.
B. The City of Sonthlake hereby agrees to withhold all
hui Idirig permits for said lots or parcels 1111 i l
completion and acceptance of useable increments of
all facilities listed in this agreement.
All suh rade of street must be complete.
C. All of the facilities listed in Paragraph 11 of this
agreement will be constructed within three 31 years
from the date of the signing by both parties of this
agreement. Before work is commenced, a Developers
Completioia Bond will he furnished in favor of the
City of Sou thIake for an cuuournt e(1ua1 to the value
OF the construction of the facilities listed herein
and will be forfeited should the Developer default on
any of articles of this agreement.
1. In lieu of I Completion Bond the Developer may
present to the City of Southlake an irrevocable
letter of Credit from a State or National lending;
institution guaranteeing an amount to he on deposit

or a line of credit in an amount equal to 110%
of the value of the construction cost of all the
facilities listed herein, connecting such amount
to completion of such facilities. Such letter of
credit must be accompanied by an escrow agreement
with the lending institution acting as an escrow
agent providing for the release of such monies
by the lending institution only upon the written
approval of the City. Such letter of credit shall
contain a forfeiture clause.
D. Prior to commencing work, the Developer shall furnish
either a Maintenance Bond in favor of the City of
Southldke or proof of an escrow deposit along with an
executed by an officer of the State or National
Banking depository covering all facilities to be
constructed against defects in materials and/or
workmanship and against all repairs and/or reconstruction)
for a period of one 1) year after completion of
all facilities and their final acceptance by the City.
Such maintenance bond or escrow deposit shall be in
an amount equal to 13%of the total cost of
all facilities.
l:. It. is further agreed and understood by the parties
hereto that upon acceptance by the City, title to
all facilities and improvements mentioned herein
above shall be vested at all times in the City of
Southlake, and the Developer hereby relinquishes
any right, title or interest in and to said facilities
or any part thereon.
F. On all facilities included in this agreement for
which the Developer awards his own construction
contract, the Developer agrees to the following
procedure:
1. To employ a construction contractor who is
approved by the City and is qualified in all
respects to hid on public projects of a similar
nature.
To secure approval by the City of any and all
final payments to the contractor. Said
approval is made in accord ance with the
requirements of this agreement and is not to
constitute approval of the quantities on which
payment is based.
3. To delay connection of buildings to service
lines of water mains constructed under this
contract until said water mains and service
limes have been completed to the satisfaction
of the City.
G.1'he developer will mow, and otherwise maintain, the
aesthetics of all land and lots which have not been
sold, built on, and occupied. Should the Developer
fail in this responsibility, the City may contract
for this service and bill the Developer for the cost.
11. The form of any letter of Credit or escrow will be
submitted to the City Attorney for approval.
1, Any surety company through which a bond is written
shall he a surety company duly authorized to do
business in the State: of Texas and shall be acceptable
to the City Council.
II, FACILITIES:
A. ON-SITF WATER:
1. l'ire Developer hereby agrees to install water
facilities to service lots as shown on the final plat
for the Lakewood Acres Phase II&IIAddition
to the city or Southlake. Water facilities shall
include ahle to support fire
hydrants and fire hydrant instal lat ion. t'hese are
to be installed within a SOD' radius. these
facilities will he installed in accordance with plans
and spec i f i cations to be prepared by the Developer's
enginccr and approved by the City. Further, the
Developer agrees to complete this installation at
its own cost and in accordance with Ordinance No. 170.
2. It is further agreed and understood that the Developer
shall he responsible for all construction costs,
maleriAls, and engineering and Developer's Paragraph 1.
3. The Devc l upu r he rchy agrees to construct the
necessary drainage facilities within the addition.
T'hese facilities shall he in accordance with the
plans and specifications to he prepared by the
Devu I ope r' s engineers, approved by the City and
made a part of the final pint. The Developer

prior to complying with all bonding requirements
as set forth above. The Paving Contractor
shall furnish to the City satisfactory carriage
of insurance in accordance with the laity's
standard requirements of contractor doing work for
the City.

A. It is understood and agreed that Septic Disposal Facilities
shall he constructed on each lot by the lot purchaser or
builder in such a manner as to comply with all of the
following minimum requirements: health Department require
n ents, Tarrant County, T'exas; State Department of Health,
State of Texas requirements, texas Water Qua 1 i ty Board
regulations, State of Texas, and any applicahle City
