NOW, THEREFORE, know all men by these presents, the undersigned,
DAN HOWELL and wife, MARGUERITE HOWELL., hereinafter called the "undersigned",
owner of the real property situated in TARRANT County, Texas, and being lore
particularly described by motes and bounds in the attached Exhibit "A" which
is incorporated herein by reference for all purposes, has caused said property
to be platted into tracts as shoran on the plat recorded in Volume Page
Deed Records, Tarrant County, Texas, which plat is also incorporated herein by
reference for all purposes.
For the purpose of assuring the orderly and uniform development of the
above-described property to be known as BRIARWOOD ESTATES, PHASE I, an Addition to the
city of Southlake, Tarrant County, Texas, and in order to carry out a general plan
of development for the benefit of each and every purchaser of a tract in BRIAa4OOD
ESTATES, PI-LASE I, the following restrictions upon the use of said property are
hereby established; and the land shown on the attached Exhibit "A" and as more
particularly platted into tracts on the plat referred to in the paragraph above,
is held and shall be conveyed subject to the reservations, restrictions and
covenants hereinafter set forth above.
The administration of the restrictions and covenants established hereby r
shall be by DAN HOWELL, or in the event of his incapacity, his assignee, or in
the event of his death, his heirs. When all ownership in BRIA-RdOOD ESTATES,
Phase I by DAN HG4ELL or his heirs shall cease, the administration of these
restrictions and covenants shall become the responsibility of the individual
owners of BRIARWOOD ESTATES, PHASE I.
I. DEFINITIONS
A "corner tract" is one which abuts on more than one street.
The words building line" as used herein, means the line designated
as "building line" on the recorded plat or as otherwise indicated herein by the
undersigned. In case of conflict between the recorded plat and this restrictive
covenant, the restrictive covenant shall control.
The word "street" as used herein shall include any street, drive,
road, land or public way shown on the recorded plat of the Addition.
U. USE OF LAND
No building, structure, land or premises shall be used and no
building or structure shall hereafter be erected, constructed, reconstructed
or °_.tered, except for one or more of the following uses:
a. Apothecary.
b. Auto parking for passenger cars only.

c. Barber and beauty shops.
d. Book or stationery stores or newstands.
e. Camera shop and photograph studios.
f. Clinics (Medical or Dental).
g. Florists, retail sales only.
h. Medical, surgical or dental laboratories.
i. Offices, business or professional.
j. Signs and billboards on the ground are prohibited, but signs
may be erected on buildings provided they are fastened flat against the wall,
or erected on the roof. Signs on the roof shall not extend beyond the building
wall, nor shall any sign have a height of more than six (6) feet.
k. Bakery, retail sales only.
1. Blueprinting or photostating.
m. Candy, cigars and tobaccos, retail sales only.
n. Cleaning, dyeing and laundry pickup station but no actual work
to be done on premises.
o. Delicatessen shops.
p. Drug store, retail sales only.
q. Greenhouses (commercial).
r. Grocery store, retail sales with no more than two (2) checkout stands.
s. Jewelry stores and optical goods.
t. Piano and musical instruments, retail sales only.
u. Plumbing shop, retail sales only.
v. Restaurant with drive-in facilities.
w. Seed store.
x. Wearing apparel including clothing, shoes, hats, milinery and
accessories.
y. Model homes that meet the construction requirements of
Paragraph III.

III. COI:STRUCTION CF BUIL.DI iGS
The exterior walls of any buildings constructed on these commercial
tracts shall be a minimum of 70% solid or veneered masonary or similar construction.
This area is not to include glazed openings. Any metal building
construction is prohibited.
Buildings. All building plans shall be submitted to DAN liv-WELL
for review and approval. The plans shall include material specifications, the
proposed elevations, and the location of the building on the lot.OW

Electrical Service: Electrical service to each tract stall be
underground from the overhead primary power line poles as installed by the
utility company.1
Fences: The construction of fences on any tract shall comply with
all applicable ordinances of the City of Southlake, Texas. However, no fence
shall extend toward the street beyond the front of the building.
IV. BUILDING SET-BACK USES
Except as hereinafter set forth, no Commercial structure shall
be erected or permitted to remain on any Commercial tract nearer than fifty (50)
feet from the front, rear or side boundary lines of any tract. No out-buildings
of any type shall be constructed or permitted to remain nearer than fifty (50) feet
from any boundary line of any tract.
The undersigned reserves the right to change in writing any
property and/or building lines shown on the recorded plat of the addition as
long as the undersigned holds legal title to such tract; and the undersigned
further reserves the right to make such changes with respect to building lines
with the consent of the owner of the property involved after the undersigned has
parted with title to such property. In no event shall such building lines be
changed so as to bring them nearer than fifty (50) feet to any street without
consent of the adjoining property owners.
The undersigned reserves an exclusive easement on, over and under
the property designated on the recorded plat of the Addition by the term
easement" for the purpose of constructing and maintaining or permitting the
construction and maintenance over and under any residential tract of pipelines,
conduits, telephone, telegraph and electric light polns and such other equipment
necessary to the supply of any public utility service or drainage facility.i
Fences, walls and hedges, but no building or structure of any other character,
may be erected or maintained on the easements shown on the recorded plat of the
Addition, provided (1) that such fences, walls and hedges do not interfere in any
way with the use of such easement by public utilities then utilizing or hereinafter
wishing to utilize the same, 2) that the rights of the owners of such fences,
walls and hedges shall be subordinate to the rights of such public utilities,
and (3) that such: public utilities, may at any time without liability to the owner
of any such fence, wall or hedge where the removal of same is incidental to the
performance of public service operations. The undersigned shall have the right
to vacate the easement appurtenant to any residential tract provided such vacation
shall not prevent access by utilities then occupying any easement to any residential
tract shown on the recorded plat of the Addition.

Billboards, etc: The construction or maintenance of billboards,
poster boards, or advertising structures of any kind on any part of any tract
is permitted as described in Paragraph III. One professional sign not exceed-
ing one (1) square foot, and one sign of not more than five (5) square feet
advertising the property for sale or rent are also permitted. Signs used by
a builder or developer to advertise the property during construction and sales
periods are permitted.

No trailer, mobile home, basement, tent, shack, garage, barn or
otherout-building erected or placed on any Commercial tract shall at any time
be used as a residence, temporarily or permanently, nor shall any structure of
a temporary nature be used as a residence.
No radio, television towers or aerial wires shall be maintained
on any tract that does not contain a commercial structure, and no commercial
towers for that purpose shall be constructed. Any such proposed structure shall
have the approval of DP.N HOWELL.
Dan Howell may include restrictions, other than those set out
herein, in any contract or deed to any tracts without otherwise modifying the
general plan above outlined, and such other restriction or restrictions shall
inure to the benefit of and bind the respective parties in the same manner as
though they had been expressed herein.
The restrictions herein set out shall be referred to, adopted
and made a part of each and every contract and deed executed by and on behalf of
the undersigned conveying Commercial property or any part thereof to all such
intents and purposes as though incorporated in full therein; and each such
contract and deed shall be conclusively held to have been so executed, delivered,
and accepted upon the expressed conditions herein stated.
All the restrictions, covenants, resolutions, liens and charges
appearing herein, as well as those appearing in any contract, deed, or other
conveyance to or covering any part of this property, shall be construed together.
If any one of the same shall be held to be invalid or for any reason is not
enforced, none of the other provisions shall be affected or impaired thereby,
but shall remain in full force and effect.
In the event of any dispute over the proper interpretation of any
of the provisions of this instrument, the determinations of DAN HOWELL shall be
final and binding on all interested parties.
VI. GENERAL PROVISIONS OF ENFORCEMENT
Right to Enforce: The restrictions herein set forth are imposed
upon each Commercial tract for the benefit of each and every other Commercial tract
and shall constitute covenants running with the land, and shall inure to the bene-
fit of and be binding on the undersigned, its successors and assigns, and each
and every purchaser acquiring any interest in any part of such land, and their
heirs and assigns. All persons acquiring any of the land covered by these restric-
tions shall be taken to agree and covenant to conform to and observe all such
restrictions as to the use of said land. No restrictions or covenants herein

set forth shall be binding on any corporation, person or persons except in respect
to breaches committed during the time such corporation or person owns or had an
interest in said land or part thereof. The undersigned, its successors and assigns,
and the owner of owners of any part of such land or any interest therein acting
jointly or separately, shall have the right to sue for and obtain an injunction
preventing the breach of, or to enforce the observance of, the restrictions and
covenants above set forth in addition to the ordinary legal action for damages;
and the failure of any one or all of such persons to enforce any of the restric-
tions or covenants herein set forth at the time of its violation shall in no
event be deemed a waiver of the right to enforce them as to any and all other
Commercial tracts and owners; nor shall the failure of the undersigned to enforce
any such covenants, conditions, or restrictions give rise to any cause of action 1
against it by any other person.
Right to Assign: The undersigned may assign or convey by appropriate
instrument to any person or corporation any of the rights, reservations, easements
and privileges herein reserved by it, or in any deed or written instrument herein
authorized, whereupon such person or corporation shall succeed to the assignor's
rights and be bound by its obligations. And in like manner and upon the same
conditions, such assignee or any subsequent assignee may assign the same.
Duration: All of the restrictions and covenants herein set forth
shall continue and be binding upon-the undersigned, its successors and assigns, and
all parties claiming through, or under it for a period of twenty-five (25) years
from the date this instrument is filed for record purposes in the office of the
County Clerk for Tarrant County, Texas, and shall automatically be extended there-
after for successive periods of ten (10) years each, provided, however:, that at
any time within five (5) years prior to the expiration of the first twenty-five
ear period, or within five years prior to the expiration of any ten year period
thereafter, the owners of the legal title to the Commercial tracts having at the
time more than fifty percent (50%) of the area shown in the exhibit attached
hereto and covered by this dedication, may provide for the release of any or all
of the tracts hereby restricted, from any one or more of said restrictions and
covenants at the end of the first twenty-five year period or at the end of any
successive ten year period, by executing and acknowledgingra proper agreement in
writing for such purpose and filing the same purposes
as then required for the recording of land instruments.
