An agreement between the City of Southlake, called (the City) and RAMM DEVELOPMENT,

INC., called (the Developer) for the installation of certain community facilitieswithinandtoservicelotsinSummerplac;e Addition, an addition to the City ofSouthlake, Tarrant County, Texas, as recorded In Volume 288-82, page 18 as revisedbyinstrumentinVolume388-96, page 53 of the Plat Records of Tarrant County, Texas;such facilities to include:
All items covered in Sections I, IT, III, and IV of the Community Facilities AgreementforSummerplaceAdditionaspreviouslyexecutedbyTownhouseDevelopmentCompany, Inc.,and approved during the Regular City Council Mg,~eting on October 3, 1972, with thefollowingmodificationsofSectionIV.
REVISED SECTION IV. SANITARY SEWERS:
A. Developer will install a waste water, treatment plant of not less than25,000 gpd to serve the previously installed collector system, completewithconnectionandoutfall :pains.
1. Performance Bond in the amount of one hundred percent (100%) of thecontractpricewillbepostedbytheDeveloper.
2. Developer will obtain the required Waste Control Order from theTexasWaterQualityBoard.
3. The City will operate the waste water treatment plant after it hasbeenconveyedbyproperlegalinstrumenttotheCity, and approved for
operation by the Texas Water Quality Board.
4. The Developer is granted the right to recover a pro-rata share oftheinitialplantcostsifthecoll,ction system is extended beyond9~1.CX~
the boundaries of Summerplace Addition, for the purpose of using anyexcesscapacitynotrequiredbysaidaddition.
The amount of rebate will be calculated in accordance with the formula
provided on the Exhibit "A" attached hereto and made a part hereof.The City will be obligated to make payments to the Developer monthlyduringeachyearwithintheseven (7) year period from date of this
agreement out of any tie-on fee collections by the City for connectionsoutsideofSummerplaceAdditionwhichwillbeusingpartoftheexcess
capacity of the waste water treatment plant not required by said addition.The City shall not be obligated further to the Developer after seven (7)years from the date of this agreement.
B. It is understood that Building Permits for residences on the lots withintheadditionwillbeissued, but actual occupancy of any residences
shall not be allowed until a Certificate of Occupancy is issued; and,Certificates of Occupancy will be withheld by the City until the wastewatertreatmentplanthasbeeninstalledandapprovedforoperationby theTexasWaterQualityBoard.
This instrument is to be recorded in the Deed Records of Tarrant County,Texas as notice of its provisions in connection with the Time CertificatesofOccupancyofresidenceswhichwillbeissuedinconnectionwiththelotsinsaidSummerplaceAddition.
An instrument in writing will be recorded in the said Deed Records of
Tarrant County, Texas, when the waste water treatment plant has been
installed and approved for operation by the Texas Water Quality Board.SIGNED this 5 'day of'

are the water tap fees.
EXHIBIT"A"
Southlake-RAMM Development-$ummerplace Addition)
For the purpose of the rebate formula the value of a
unit was derived by using an average family consisting of
3/4 people using 100 gallons of water per person per day with
the capacity of the waste water treatment plant being_Z&r896-t5 poo
gpd or-7-3-"units". Summerplace Addition would comprise 42
Zunits"with the excess capacity being 31 "units".
A "unit" shall equal 1/73 of the initial cost of the said
waste water treatment plant. The agreed initial plant costs
shall be the lower of the following amounts:
1) actual cost, or (2) 44&,19iS.98.
Each residence outside of Summerplace Addition using the
treatment plant shall be considered a "unit" and upon collecting
the tie-on fee, the City shall set aside one "unit" of funds
as defined above to be paid to Developer under Section IV..A.4..

the citizens of our community be given every encouragement
to protect their health and enviroment;

die in fires caused by smoking and destroy $95 million in
property;
WHEREAS, medical technology has proven that
cigarette smoking aids in causing numerous diseases and deaths,
NOW, THEREFORE, I, MARTIN P. HAWK, MAYOR of the
City of Southlake, Texas, by virtue of the authority vested in
me, do hereby proclaim November 17,1977 as GREAT AMERICAN
SMOKEOUT DAY, and call upon all citizens to give the American
Cancer Society their fullest cooperation and support as they
ask Americans to join with them in pledging a day of freedom
from cigarette smoking.

RESOLUTION 77-40
wHFX AS, the City Council of Southlake, Texas, after public hearings,
desires to endorse the presentation of a proposal through the mayors'
Council of Tarrant County in connection with improvements to a portion of
Peytonville Road, under the Tarrant County Consortium program under
Title I. of the Housing and Commmity Development Act of 1974,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOLMU AKE, TEXAS, THAT,
1. The City Council of Southlake, Texas does hereby endorse the presentation
to the Mayors' Council of Tarrant County of a proposal concerning the widening
and paving of the South portion of Peytonville Road between Continental Avenue
and Southlake Boulevard in the City of Southlake, Tarrant County, Texas; and,
2. That the City Council understands and agrees that in connection with such
program any funds not expended for specifically approved projects will revert
to the Ccmmmity Development Contingency Fund.

WHEREAS, the City of Southlake has deter-
mined through advice of FinanciAl and En-
gineering Consultants that the proposed
Sewer System pursued through Steps 1 and 2
of a Grant would not be economically feasible
to build and operate, AND,
WHEREAS, further pursuit of the Grant would
entail a considerable expeniture of City
Funds for another study, system redesign
rework of application, and a bond election,
NOW,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT,
I.
Further pursuit on the Sewer System under the current Grant
is not economically feasible, that all effort be discontinued
on this particular System and Grant.4nd that all involved
Parties/Agencies be so notified.
