PUBLIC NOTICE
Public notice is hereby given that a Petition for Disannexation
pursuant to Section 10. A, Article 970a, Vernon's Annotated Civil Statutes of Texas,
as amended, will be presented to the City Secretary of the City of Southlake,
Texas, by a majority of the qualified voters and owners residing within
that certain area of land described by metes and bounds in that certain annexation
petition filed June 15, 1965, and officially annexed to the City of Southlake,
Texas, pursuant to its Ordinance No. 132, adopted on the 6th day of
July, 1965; that pursuant to Section 10. C of Article 970a, Vernon's Annotated Civil
Statutes of Texas, as amended, a true copy of said petition is attached
hereto, marked Exhibit "A, " describing the area to be disannexed as shown
on plat attached to said petition; and that said petition for disannexa-tion, marked
Exhibit "A, " is attached to this Notice and made a part hereof for all
purposes in the posting of this Notice in three public places in the territory to
be disannexed and in publishing this Notice in one issue of a news-paper of
general circulation serving the territory to be disannexed in accord-ance with
the provisions of Article 970a, Section 10. A & C of Vernon's Annotated Civil Statutes

COUNTY OF TARRANT. ¢
j'TO THE MAYOR AND CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS:
ilWHEREAS, certain tracts of land in Tarrant County, Texas, were de-
i1scribed by metes and bounds in that certain annexation petition filed June 15,
1965 and officially annexed to the City of Southlake, Texas, pursuant to its
ance No. 132, adopted on the 6th day of July, 1965, and
WHEREAS, the undersigned owners, inhabitants and qualified voters of
all of said territory desire that the same be detached from the boundaries of
said City of Southlake, Texas;
NOW THEREFORE, contesting the validity of the hereinabove described
annexation and also protesting the annexation of said territory, we the under-
signed owners, inhabitants and qualified voters of the hereinafter described
territory, hereby request and petition, give notice as required by law and
state the grounds relied upon to sustain such request and petition for disannex-
ation of the land hereinafter described as follows, to-wit:
All that certain tract of land situated in Denton and Tarrant
County, Texas, and being 45 acres out of the D. DOUTHIT
Survey, and 15 acres out of the R. D. PRICE Survey, more
fully described by metes and bounds as follows:
BEGINNING at a stake in the N. line of the D. DOUTHIT
SURVEY 93 1/2 varas West of its NE corner;
THENCE West 262-19/100 varas to a stake in said North line;
THENCE S. 950 varas crossing the S. line of said DOUTHIT
SURVEY, in all 1200 varas a stake;
THENCE E. 355-69/100 varas to a stone;

A plat of said land showing its location with respect to the City of South-
Make, Texas, is attached hereto marked EXHIBIT "A".
By signing our names to this petition for disannexation of the above de-
scribed property heretofore annexed to the City of Southlake pursuant to Ordi-
nance No. 132, adopted on the 6th day of July, 1965, we do hereby certify that
we are owners and inhabitants of the above described territory and are quali-
fied to vote for members of the State Legislature.
That as grounds sustaining this request and petition for disannexation,

it is represented and will be shown the Mayor and City Council of the City of
Southlake, Texas, that the annexation of the above described territory under
Ordinance No. 132, adopted on the 6th day of July, 1965 is subject to disannex-
ation under and by virtue of Article 970a, Section 10, Vernon's Annotated Civil Statutes
of Texas, as amended, in the following particulars, to-wit:1.
In that the petition upon which said annexation was effected, was fraudulently
procured by means of false representations that the City of South-lake
would provide governmental and proprietary services, substantially equiv alent
to the standard and scope of governmental and proprietary services fur-nished
by the City of Southlake, Texas in other similar areas as required by law;
2.
That the annexation was solicited by the City Officials of Southlake,Texas,
and was not made upon a voluntary petition by the property owners in accordance
with the law;3.
That upon the territory embraced in the hereinabove described an-nexation
there are fewer than one (1) occupied residence or business structure for
every two (2) acres of such territory and fewer than three (3) occupied residences
or business structures on anyone (1) acre of such territory, being therefore
such territory that should be detached from the corporate limits of the
City of Southlake in accordance with Article 973 of Vernon's Annotated Civil Statutes
of Texas;4. That
the territory annexed pursuant to Ordinance No. 132 was an-nexed to
the City of Southlake purely for taxation purposes; that the same was unsuitable for
city purposes; and that the City of Southlake did not intend to use the same
for city property within the time required by law;5. That
the City of Southlake, Texas has failed to comply with Article 970a, Section
10, Vernon's Annotated CivilStatutes of Texas, as amended, in the following respects,
to-wit:a. Assessing and
levying taxes against said property without pro-viding any serviceable
city facilities;b. In that
the City of Southlake, Texas has not provided the area in question with fire
protection;2-

lo c. In that the City of Southlake has failed to install water
lines substantially equivalent to the standard and scope of water line services
fur-nished by the City of Southlake in other areas of such City having
characteris-tics of topography, patterns of land utilization, and population density
similar to that of the particular area in question, annexed as hereinabove set forth

described.d. In that the City of Southlake fraudulently obtained dedication
of roads constructed by the undersigned owners with the required iron ore
rock core tests, which have been approved by Southwest Laboratories, Ft.
Worth,Texas, and thereafter the City of Southlake refused completio of said
roads with County approved hard surface known as double penetratio hot top
two inch hard

ss<WHEREFORE, the undersigned owners, inhabitants and
qualified voters of the hereinabove described territory respectfully request of the
City Council and Mayor of the City of Southlake, Texas, that all of said land
be detached from the boundaries of said City of Southlake, Texas; that this
re-quest and petition be approved and granted whereby all of said land
aforemen-tioned and described by metes and bounds in said Ordinance No. 132
be 'detached from the corporate limits of the City of Southlake, Texas, by
proper proceeding, resolution and ordinance disannexing said land and
repealing Ordinance No. 132 adopted on the 6th day of July, 1965, and that the
Official Map and Boundaries of the City of Southlake, Texas, as heretofore
adopted be amended so as to detach the aforementioned territory from the said
City of Southlake,

1.
TEAT, the property hersinabove described being adjacent and conti-
guous, to the city limits of Soutblake, Texas, be and is hereby
annexed and brought within the corporkte limits of said City and
is hereby made an integral part thereof.
2.
TgAT," the owners and inhabitants of the area herein annexed be en
titled to all of the rights and privileges of other citizens and
property owners of said City and be bound by all of the acts and
ordinances made in conformity thereto, now in fall force and effect
and that which may be hereafter adopted.
3.
THAT, the official map and boundaries of the City of Southlake,
Texas, as heretofore adopted and amended, be and is hereby amended
so as: to include the aforementioned territory as part of the City
of Southlake, Texas.
4.
THAT, in accordance with Section IV-4 of Ordinance No. 161, the land
made the basis of this annexation proceeding is hereby zoned "AG"
District.
THIS Ordinance shall become effective from and after its passage
and approval.

WHEREAS, the City Council of the City of Southlake,
Texas, did pass and approve Ordinance No. 203,
wherein provision is made for the appointment of
members to the Planning & Zoning Commission; And,
WHEREAS, an appointment must be made to fill the
unexpired term of N. B. Hight who relinquished his
position; And,
WHEREAS, an appointment must be made to appoint a
member to take the place of Lloyd Wolf whose term
