Gentlemen: is It is recommended that the City of Southlake enter into a Community Facilities I Agreement with the owners of the Hilltop Acres Addition to assure the adequacylofthecommunityfacilities. Such an agreement would be similar to that of the Southlake or Dove Estates and would contain the following points: 1. 6-Inch water line be extended from Dove Road to the perimeter of the addition. In such a case the city would have a certain obligation as well as the developers f 2.4-Inch water mains installed in the interior of the addition.f i 3. All streets would be paved under the same criteria as the Southlake i Estates. 4. At least two 6" fire hydrants would be installed within the close proximity to the area to assure adequate fire protection. 5. Street signs meeting the City of Southlake's criteria. 6. Street lights located at the proper intervals would be installed. Ifthe City Council concurs in the recommendation that the Community Facilities Agreement should be entered into, our office in coordination with the City Secretary, would prepare the proper documents and submit them to the owners of the property as well as the city for their signatures. M. Gordon, seconded by Gail Hargadine and passed that the zoning application of Howard Thrasher be approved requesting a change in zoning from Ag District to L District on land described by metes and bounds.in ZA-72-5, consisting of two acres, more or less. Love-Henry $ Associates, Inc., the Developer, hereby agrees to install water facilities to serve the lots as shown on the attached Exhibit "A", all in accordance with plans and specifi- cations to be prepared by the Developer's engineer and approved by the City. Further, Love-Henry $ Associates, Inc., agrees to complete this installation, at its own cost and in accordance with.Ordinance No. 170, within five years from the date of the signing, by both parties; of this agreement. Prior to commencing work the Contractor to whom the Developer awards the contract for such work shall furnish a maintenance bond in favor of the City of Southlake covering the facility to be constructed against defects in materials and/or workman- ship for a period of one year after completion of the facility and its acceptance by the City. The Contractor may, at his option, post a "blanket maintenance bond" in the amount of. Ten Thousand ($10,000.00) Dollars in favor of the City covering all water facilities constructed by his in the City against defects in materials and/or workmanship for a period of one year after acceptance by the City. The Contractor shall also furnish to the City a performance bond and payment bond in an amount equal to one hundred per cent (100%) of the contract price, conditioned upon the faithful performance of the contract and upon payment of all persons supplying labor or furnishing materials to the project. B. The City of Southlake hereby agrees to issue two building permits for said lots upon the signing, by both parties, oflithis agreement. C. It is further agreed and understood that the.Developer shall be responsible for all construction cost, materials and engineering,and that upon completion and acceptance the City shall own, operate and maintain the said water facility, subject to the applicable maintenance agreement and bonds in connection therewith. D. It is further agreed and understood that all supply mains and distribution mains installed within a developer's platted and filed area of development must extend to the borders of its development as required for future extension of the City's system regardless of whether or not such extensions are requiredforservicewithintheareaofdevelopment. 1. 9 3` II. STREETS AND DRAINAGE: Fes, A. Love-Henry & Associates, Inc., hereby agrees to construct streets including gutter and drainage facilities to the lots as shown on the attached Exhibit "B", all in accordance with the plans and specifications to prepared by the Developer's engineers and approved by the City. Further, Love-Henry $ Associates, Inc.,agrees to complete this construction at its own cost, within five years from the date of the signing, by both parties, of this agreement. Love-Henry $ Associates, Inc., agrees: 1. Fkva;=(S) street lights will be installed by the Developer, as shown on Exhibit "B", with Developer responsible for electricitycostsuntilacceptancebytheCity. 2. No construction will begin on the subgrade treatments, pavement or Sumer within the limits of any street included herein, and as shown on Exhibit "B", prior to the installation of all underground utilities, including service lines. 3. All utility lines will be placed underground. 4. No work will begin on any street included herein.prior to the paving contractor's execution and delivery of a one year maintenance bond to the City of Southlake for the.repairing and/or reconstruction in whole or in part of said streets. The surety will be a surety company duly authorized to do business in the State of Texas and acceptable to the City Council. The Contractor shall also furnish to the City a performance bond and payment bond in an amount equal to one hundred (1000 per cent of the contract price, conditioned upon the faithful performance of the contract and upon paymentofallpersonssupplyinglabororfurnishingmaterialstothe project. The Contractor shall furnish to the City satisfactorycarriageofinsuranceinaccordancewiththeCity's standard requirements of contractors doing work for the City. S. It is further agreed and understood by the parties hereto that uponacceptancebytheCity, title to all facilities and improvementsmentionedhereinaboveshallbevestedatalltimes.in the City ofSouthlake, and Developer hereby relinquishes any right, title,,orinterestinandtosaid.facilities or any part thereof. C. On all facilities included in this agreement for which the Developerawardshisownconstructioncontract, the Developer agrees to followthefollowingprocedures: 1. To employ a construction contractor who is approved by the Cityandwhoisqualifiedinallrespectstobidonpublicprojectsofsimilarnature. 2. To require the Contractor to furnish to the City payment,performance and.aaImsenam0e bonds in the name of the City foronehundred (100%) per cent of the contract price pf the facility,said bonds to be furnished before work is co'mended. 3. To secure approval by the City of any and all partial and finalpaymentsto, the Contractor, said approval is made, in accordancewithrequirementsofthisagreement, and is not to constituteapprovalofthequantitiesonwhichpaymentisbased. 4. To delay connections of buildings to service lines of watermainsconstructedunderthiscontractuntilsaidwatermainsandservicelineshavebeencompletedtothesatisfactionoftheCity. IV. SEWERS: It is understood and agreed that sewer facilities shall be constructedinsuchamannerastocomplywithallthefollowingminimumrequire-ments: Health Department requirements, Tarrant County, Texas; StateDepartmentofHealth, State of Texas Requirements, Texas Water QualityBoardregulations, State of Texas, and any applicable City ordinancesconcerningsewerfacilities. 3. 4s.;»A The attached Exhibits A and B are made a part hereof for all intents and purposes.
