REGULAR MEETING OF THE CITY COUNCIL
July 16, 1974
The City Council of the City of Southlake, Texas, met in regular
session in the Council Chamber of City Hall, at 667 North Carroll
Avenue in Southlake on Tuesday, July 16, 1974, with the following
members present:
W. 0. Nunn, Mayor Pro Tem
Billy Joe Knox, Councilman
Sam Davis, Councilman
James Winfrey, Councilman
Absent: Wade Booker, Mayor
R. D. Drummond, Councilman
Also present: W. D. Campbell, City Attorney
Police Chief D. R. Hughes
Fire Chief R. P. Steele
Craig Eaton, Planner.
Guests: Kathy Wincovitch and Cliff Davidson of
the Tarrant County Planning Department.
Mayor Pro Tem Nunn called the meeting to order at 7:30 P.M. The
invocation was given by Councilman Knox.
The minutes of the last regular meeting were approved as read.
ZA-74-4: was opened for discussion. Mr. Tommy Eidson made a com-
prehensive presentation to the Council of the request for PUD
zoning on the large tract of land in the Childress Survey described
in the application. In the discussion that followed, the City
Attorney advised the Council that the City's zoning ordinance for
PUD District requires a development plan, the extent of detail of
same being the Council's perogative and if Council is satisfied
with the plan as presented by Mr. Eidson it could be incorporated
in the ordinance by reference. Craig Eaton suggested that approval
for zoning purposes gives no right to the developer to obtain build-
ing permits but he can come back at a later date with final agree-
ments and plat all subject to Council review. The City Attorney
further advised that the general notes on the plan can be stipulated
in the ordinance as binding the developer to develop as shown on the
plan and that any major change requested later would require a new
zoning request. Following discussion, the Council indicated its
willingness to accept the plan incorporating it in the ordinance,
whereupon, Councilman Davis moved to pass ORDINANCE NO. 161-59,

changing the zoning on land described therein from Ag District
to PUD District; seconded by Councilman Winfrey. Councilman Davis
and Councilman Winfrey voted "For"; Councilman Knox abstained,
stating his reason for abstaining from the vote was because of a
lateral interest. The motion carried. (Ordinance No. 161-59 is
attached hereto and made a part hereof.)
The City Attorney pointed out that the planner had recommended
higher density. Following other remarks, Craig Eaton advised
the Council that there are various tools to curb land speculation
to some degree and may be considered in the updating of the
current zoning ordinance.
Colon Sweet addressed the Council regarding the denial of a
bui ing permit for Eugene Compton on the basis of the land being
subdivided prior to the filing of an approved plat. Discussion
followed concerning what relief could be granted to Mr. Compton.
Mr. Eaton suggested the owners of the land join together in filing
a plat without the City requiring street standards. Following
additional discussion, Councilman Knox moved that Eugene Compton
be allowed a building permit for a house to be moved onto his
property and placed on a permanent foundation, withholding the
certificate of occupancy until such time as the necessary require-
ments to meet the City's subdivision ordinance are complied with;
seconded by Councilman Davis. Motion passed unanimously.
Aubrey Smith, having arrived late, was now invited to address the
Council. He stated why he did not feel he was in violation of ordinance
No. 204, (Junk Cars) having received a warning from the Police
Department regarding same. Following discussion, Mr. Smith said
he would try to remove the one vehicle without an engine by August lst
and would get the other one relocated to comply with the ordinance.
Fire Department report was given by Chief Steele. He asked the
Council -oyster cut-off switches for Unit No. 3002 and Unit
No. 3003, costing about $50. Councilman Winfrey suggested that
this request be put in the upcoming budget since they are not of
an emergency nature. Chief Steele then made a progress report on
Unit No. 3003.
Police De artment report was given by Mayor Pro Tem Nunn who
a vc~ise there were no current problems.
Water Department report was given by Councilman Davis. He advised
that the 2 ground storage tank has been cleaned out and water
put back in and that the investigation of the paint problem is
still in process.
Citizens Advisory Ad Hoc Committee was appointed for Capital
Improvements Planning an updatin the zoning ordinance composed
of the following members; Mitchell Zampikos, Lloyd Wolf, Lottie

Clariday, Bob Pasley and Elsie McAlister on motion by Councilman
Knox; seconded by Councilman Winfrey. Motion passed unanimously.
The Mayor Pro Tem directed that the Board of Adjustments meet
here August 6, 1974, at 7:30 P.M. to consider the appeal of Scottie
Sutton for a building permit.
August 20, 1974, 7:30 P.M. was announced by the Mayor Pro Tem as
the date of the public hearing on the proposed 1975 Budget.
The bills as listed on the attached exhibit were approved for
payment on motion by Councilman Knox; seconded by Councilman Davis.
Motion passed unanimously.
The City Secretary was authorized to purchase a desk and chair as
budgeted under "Capital Outlay" for use in the City office at an
approximate cost of $475 on motion by Councilman Knox; seconded
by Councilman Davis. Motion passed unanimously.
Councilman Winfrey moved that the Water Department purchase a
chlorinator as budgeted under "Capital Outlay" at an approximate
cost of $1,200; seconded by Councilman Davis. Motion passed
unanimously.
Resolution No. 74-21, renewing the City's membership in the Southern
Building Congress for 1975, was unanimously passed and approved on
motion by Councilman Winfrey; seconded by Councilman Knox.
At this point, the Mayor Pro Tem called a brief recess and gave the
City Attorney permission to leave.
On reconvening, the Council held a short work session on the 1975
Budget. The City Secretary briefly outlined the anticipated
revenues and explained that the departmental requests are in their
original forms as presented by the department heads. The Mayor
Pro Tem suggested the Council take time to study the proposals and
then have another work session.
There being no further business, the meeting adjourned.

AN ORDINANCE AMENDING ORDINANCE NO. 161 OF
THE CITY OF SOUTHLAKE, TEXAS BY CHANGING
ZONING CLASSIFICATION OF 123.66 ACRE TRACT
OF LAND OUT OF THE JOHN CHILDRESS SURVEY,
ABSTRACT NO. 254, SITUATED IN TARRANT COUNTY,
TEXAS, AND IN DENTON COUNTY, TEXAS, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED
HERETO AND MADE A PART HEREOF, FROM "AG" (AGRI-
CULTURE) DISTRICT TO ZONING CLASSIFICATION "PUD"
(PLANNED UNIT DEVELOPMENT) DISTRICT, PROVIDING
FOR CHANGE IN OFFICIAL ZONING MAP, AND PROVIDING
EFFECTIVE DATE OF AMENDMENT.
WHEREAS, an application to change zoning has been filed and a public
hearing conducted and all other prerequisites complied with under applicable law
concerning a requested change in zoning:biassification-' n(:,conneefi one-*ith::;the
property described on Exhibit "A" attached hereto and made a part hereof;
NOW THEREFORE, Be it ordained by the City Council of the City of
Southlake, Texas:
SECTION 1. The certain Ordinance No. 161 passed by the City Council of the City
of Southlake, Texas, January 7, 1969, and being the "Comprehensive Zoning Ordi-
nance" is hereby amended insofar as the property described on Exhibit "A" attached
hereto and made a part hereof is hereby changed from the zoning classification of
"AG" (AGRICULTURE) District to zoning classification "PUD" (PLANNED UNIT DEVELOP-
MENT) District subject to compliance with all matters provided for and in the
development plan attached hereto and made a part hereof as Exhibit "B".
SECTION 2. The official zoning map created by said Ordinance No. 161 is
hereby amended to include the zoning change made by this ordinance in
connection with the property described on Exhibit "A" attached hereto and
made a part hereof.
SECTION 3. The said Ordinance No. 161, except as officially amended by prior
ordinance amendments and this ordinance No. 161-59, remains in effect in all
other respects as originally passed.
This ordinance shall take effect upon its passage.

WHEREAS, the City Council of the City
of Southlake, Texas, deems it to be to
the best interest of the City to contin-
ue its membership in the Southern Build-
ing Code Congress for the regulation of
all construction within the corporate
limits of the City; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, THAT:

The City's membership in the Southern Building Code
Congress for the year from August 16, 1974, to August
16, 1975, be renewed.
2.
The dues for same in the sum of $40 be paid for out of the
General Fund.

1974 BOARD OF EQUALIZATION OATH OF OFFICE
We, the undersigned, members of the Board of Equal-
ization of the City of Southlake, Tarrant County, Texas, for
the year A. D. 1974, do solemnly swear that in the performance
of our duties as members of such Board for said year, we will
not vote to allow any taxable property to stand assessed on
the Tax Roll of said City for said year for any sum which we
believe to be less than its true market value, or if it has no
market value, then its real value; that we will faithfully en-
deavor, as members of said Board, to have each item of taxable
property which we believe to be assessed for said year at less
than its true market value or real value, raised on the Tax
Roll to which we believe is its true cash market value, if it
has a market value, if not, then its real value; and that we
will faithfully endeavor to have the assessed valuation of all
property subject to tax within said City stand upon the Tax
Roll of said City for said year at its true cash market value,
or if it has no market value, then its real value. We further
solemnly swear that we have read and understand the provisions
contained in the Constitution and Laws of this State relative
to the valuation of taxable property, and that we will faith-
fully perform such duties as required by us under the Consti-
tution and Laws of this State.

TAX EQUALIZATION BOARD MEETING
July 27, 1974
The annual meeting of the City of Southlake Tax Equalization
Board convened at 9 o'clock A.M. in the Council Chamber of
City Hall, 667 North Carroll Avenue, Southlake, Texas, with
the following members present:

The City Secretary swore in the Board Members in accordance
with Article 7215 of Vernon's Civil Statutes. Mr. M. E. White-
side, City Tax Assessor for Southlake, failed to appear because
of illness. The following citizens appeared before the Board:
J. L. Clow - He questioned the value of land being raised again
as it was raised last year. Having been satisfied as to the
assessment being in line with other property owners, he acqui-
esced in the Board's ruling that the assessments stand. (A-706,
Tract 9B and A-2003, Tract 2D.)
Mrs. Walter Brumbalow - She felt the assessment to be too high.
The Board explained that the City Council has now passed a $3,000
exemption for those over 65 which will provide some relief on the
1975 taxes and that the value placed on the land was fair and
comparable. (A-18, Tract 1A.)
Mrs. E. E. Taylor - She stated that the raise in value is not
justified, that the actual value has not risen as much pro-
portionately. The Chairman pointed out that the property was
not assessed at its true value to begin with; hence, the cur-
rent assessment is fair and should stand. So ruled the Board.
(A796, Tract 3A and 3C.)
Mrs. George Burnett - She asked for consideration in lowering
the va ue o er property. The Board ruled the value to be
proper. (A-706, Tract 8.)
Bruce McCombs - Discussion was had on what seemed to be an ex-
cessive value on the house. After due consideration, the Board
ruled the total value of the property to be set at $7,000 tax-
able instead of $14,300. (A-899, Tract 2B3A.)
Mt. and Mrs. Bill Stowe - They wanted to be sure their value
was fair in comparison with their neighbors. Having been assured

of same, they agreed with the Board the assessment was proper
(A-591, Tract 2J.)
Joseph Moore - He questioned the large jump in value. It was
pointed out that the house had been remodeled by the previous
owner and just now placed on the rolls at its increased value;
but that the value placed on his land was out of line with his
neighbors. Therefore, the Board set the total taxable value at
$4,850 instead of $5,350. (A-1049, Tract 1A.)
Robert L. Garner - He questioned the value placed on his new house
and stated his neighbor's house is about equal in size but valued
lower. The Board was in agreement that the value of the house was
fair but that his neighbor's was too low. The Board took into con-
sideration the barn on his property being excessively valued and
reduced same from $3,500 to $1,040, making his total taxable value
at $21,840 from $23,600. (A-18, Tract 2L.)
Richard Finney, representing Tri-County Electric Co-operative,
questioned the fairness of value in the amount of $85,000 on lines
and poles. It was shown that Lone Star Gas had a like amount. He
acquiesced in the Board's ruling that the value stand as assessed.
Fred H. Branan's letter to the Board was. read aloud wherein he
stated the value placed on his land was too high. The Board ruled
the value was fair. (A-300, Tract 1.)
The Board recommended that the Tax Assessor check his present
assessments in the Chivers Survey, Abstract 300 and surrounding
areas.
There being no other citizens approach the Board and there being
no further matters before it, Mr. Popkins moved to adjourn; sec-
onded by Mrs. Nunn. All were in favor; the motion passed unanimously,
whereby the meeting did adjourn and the business at hand ended for
this year, 1974, sine die.
