REGULAR MEETING OF THE CITY COUNCIL
June 18, 1974
The City Council of the City of Southlake, Texas, met in regular
session in the Council Chamber of City Hall at 667 North Carroll
Avenue in Southlake on Tuesday, June 18, 1974, with the following
members present:
Wade Booker, Mayor
W. O. Nunn, Mayor Pro Tem.
Billy Joe Knox, Councilman
R. D. Drummond, Councilman
Sam Davis, Councilman
James H. Winfrey, Councilman

Mayor Booker called the meeting to order at 7:30 P.M. The invoca-
tion was given by Councilman Nunn.
The Minutes of the last regular meeting were approved as read.
ZA-74-3: For the benefit of those in attendance at this public
hearing, the Mayor read aloud the recommendation for approval by
the Planning and Zoning Commission of the "L" District (Light
Commercial) zoning request by the Presbyterian Church on 11.04
acres of land described in said application by metes and bounds.
The Mayor announced that this public hearing was open for
discussion. Mrs. Virginia Clow was present representing the
Presbyterian Church and informed the Council that they were
requesting the zoning in order to control the deed restrictions
on the property. (Acting City Secretary left the room at this
point to get the ZA-74-3 file and returned immediately.) Mrs.
F. J. Schnitzer was present and asked the Council questions
regarding this zoning. Councilman Knox questioned access to
the property from White Chapel Blvd. Mr. Craig Eaton of Carter
and Burgess suggested that the owner be required to show a
50 foot easement on the Southerly portion of the property.
Councilman Davis moved that ZA-74-3 be tabled until the plat
was corrected to show said easement; seconded by Councilman Knox.
Councilman Winfrey moved that ZA-74-3 be tabled until the next
regular council meeting. Mayor Booker informed him it would
depend on when the owner got the plat corrected. Whereupon
Councilman Winfrey withdrew his motion. The Mayor called for
a vote on the original motion to table ZA-74-3. Motion passed
unanimously.

Citizen Scottie Sutton appeared before the Council requesting
a building permit to construct a guest house containing 960
square feet to be built on the front portion of his property.
The City Attorney explained what was permissible under our
ordinance. Discussion followed. Councilman Davis moved that
the request be denied; seconded by Councilman Knox. Motion
passed unanimously. Mr. Sutton was advised he may appeal his
case to the Board of Adjustments.
Water Department report was given by Councilman Davis. He
informed the Council that the Johnson Road work is almost
completed and the work on Continental Blvd. has been started
and should be completed in approximately two weeks.
Police Department report was given by Councilman Nunn. He
informed the Council that he had nothing additional to the
report turned in by Chief Hughes.
Fire Department report was given by Councilman Knox. He informed
the Council that everything was in good working condition at this
time and that Arnold Welding Company was nearing completion on
the tank for the new truck. Chief Steele informed the Council
that the tank would be sent out for painting after Arnold
Welding completed it. Councilman Knox reported that the Fire
Department made $625 from the fish fry, and the money had been
spent on items for the new truck. All receipts will be turned
over to the City office for auditing purposes. He also advised
the Council that the receipts for the fund raising projects
would be turned over for auditing.
ZA-74-4: Requesting a change in zoning from AG to PUD District
by William D. Tate, Tr. was set for public hearing on July 16,
1974 by the Mayor. Mayor Booker read aloud the Planning and
Zoning Commission's recommendation for approval.
Councilman Nunn moved that a 10% cost of living wage increase
be granted to all full time Police Department employees and
full time City Hall employees, retroactive to June 1, 1974;
seconded by Councilman Knox. Motion passed unanimously.
Councilman Knox moved that the bills presented be approved for
payment as listed on Exhibit A attached to these Minutes;
seconded by Councilman Nunn. Motion passed unanimously.
Mayor Booker proposed that the Council reconsider the fines
set for traffic violations. Discussion followed. The following
fines were recommended:
Expired MVI Sticker $10.00
Drivers License Restriction 15.00
Stop Sign - same fine - 20.00
Dim Lights - same fine - 15.00
Defective Equipment 10.00

Councilman Knox moved that the above recommended fines for
traffic violations be effective as of this date on all out-
standing tickets with no disposition made on them; seconded
by Councilman Drummond. Motion passed unanimously.
There being no further business, the meeting adjourned.

At the regular meeting of the Planning and Zoning Commission
held at City Hall, Tuesday, June 11, 1974, it was moved by
C. M. Gordon, seconded by David Moak and unanimously approved
by the Commission that the request by William B. Tate, Tr.
for "PUD" District (Planned Unit Development) zoning on 124
acres, more or less, out of the John Childress Survey, Abstract
No. 254 be recommended for approval. Letter from Carter and
Burgess, Inc. regarding comments and analysis attached.

Subject: Zoning Case ZA-74-4, "Signature Estates" P.U.D.
Gentlemen:
At your request our office has reviewed the Land Use Plan of "Signature
Estates" as submitted by Mr. Tommy Edison and Mr. William D. Tate, Jr.
Having offered some suggested improvement changes to the plan, which the
petitioners have agreed to make and have made, we find the plan to be
technically correct and in general harmony with the City's "Comprehensive
Plan."
The maximum allowable development density designated by the City's Com-
prehensive Plan for the area in which the project is located is estab-
lished at 3.5 dwelling units per acre. The density proposed by the
petitioners, as noted on their land use plan, is 4.18 dwelling units
per acre, reflecting a total yield of 517 units. This represents 84
more units than the maximum allowable 433 dwelling units.
The major streets (i.e. principal and secondary collectors) shown on the
plan are in concurrence with the City's "Thoroughfare and Circulation
Plan."
An 8" water main is available at the eastern edge of the property along
Burney Lane to supply the project. A central sewage treatment plant is
also proposed by the petitioners to accommodate the total development.
Roadway paving and related support facilities are to be executed in con-
formance with the City's governing standards, as expressed by the peti-
tioners to our office. No definitive development timetable has yet been
established by the petitioners; therefore, such an analysis cannot be
entertained at this time.
As specific plans for the high density residential areas, commercial and
recreational areas evolve, it is recommended that such plans, along with
the land plats, be brought to the attention of the Planning and Zoning
Commission for review and approval prior to the issuance of building
permits.

The Land Use Plan, as submitted, appears to provide for a diversity of
housing types and, consequently, price ranges for both sales and rental
units, coupled with supportive convenience shopping facilities and rec-
reational amenities. The plan's concept seems well organized and workable.
In view of the unusual topographic restraints of the site, of which a
substantial land area is affected by the Corps of Engineers' flowage
easement for Lake Grapevine; the extent of tree cover which the petition-
ers have expressed a sincere interest to our office to protect and preserve;
plus the high cost amenities package provided for in the plan such as a
small private golf course with clubhouse, recreation areas, pedestrian
linkages, etc., it is therefore our opinion, based on the petitioners will-
ingness to cooperate with the City and not requesting reduction of develop-
ment standards, along with the type of amenities planned, that these factors
are a suitable and appropriate trade-off for the higher residential density
they have requested. Market conditions at the time of actual development
could in fact yield a lower overall density than the maximum requested.
In view of the aforedescribed comments and analysis, it is recommended
that the plan as submitted be approved as a "Planned Unit Development"
zoning district.
