Betty Rhodes, Acting City Secretary 72 CITY OF SOUTHLAKE, TEXAS REGULAR MEETING OF THE CITY COUNCIL June 4, 1974 The City Council of the City of Southlake, Texas, met in regular session in the Council Chamber of City Hall at 667 North Carroll Avenue in Southlake on Tuesday, June 4, 1974, with the following members present: Wade Booker, Mayor W. 0. Nunn, Mayor Pro Tem Sam Davis, Councilman James H. Winfrey, Councilman Absent: Billy Joe Knox, Councilman R. D. Drummond, Councilman Also present: William D. Campbell, City Attorney Q,erald Lemons, Carter & Burgess Representative Bill Bell, Carter & Burgess Representative D. R. Hughes, Police Chief Mayor Booker called the meeting to order at 7:30 P.M. The invoca- tion was given by Councilman Nunn. The Minutes of the last regular meeting were approved as corrected. Mayor Booker announced that the public hearing was now open for discussion regarding a proposed budget for spending the revenue sharing funds for the fifth entitlement period, July 1, 1974 through June 30, 1975 in the amount of $7,110. No citizen was present to speak at this hearing. Councilman Nunn stated that at the meeting he attended regarding the spending of revenue sharing funds, it was recommended that the cities spend their funds on what was best for community development. Discussion followed. Mayor Booker announced the public hearing was now closed. Councilman Winfrey moved that Resolution No. 74-16: Calling for adopting a budget of $7,110 or spending revenue sharing funds for the fifth entitlement period, July 1, 1974 through June 30, 1975 in the following manner: City Hall Expansion - $7,110; seconded by Councilman Davis. Motion passed unanimously. (Said resolution attached hereto and made a part hereof.) Resolution No. 74-17: Calling for authorizing $3,000 exemption on residence homesteads for persons 65 years of age or older on City ad valorem taxes was passed and approved on motion by Councilman Winfrey; seconded by Councilman Nunn. Motion passed unanimously. (Said resolution attached hereto and made a part hereof.) 73 j Mr. Jerald Lemons of Carter and Burgess appeared before the Council to make a report on the Texas Water Quality Board Public Hearing he attended in Austin. He informed the Council on the steps necessary to apply for a federal grant for a sewer system. He also informed the Council that Southlake has a "priority listing' with the Texas Water Quality Board. Mr. Bill Bell of Carter and Burgess advised the Council that if the City of Southlake got invited to submit an application for grant money he would advise them to do so in order for the City to be ready to go on the TRA main when it was extended through this area. The Council thanked Mr. Bell and Mr. Lemons for their report. The final plat of Jellico Estates Subdivision was presented to the Council with the letter of approval from the Planning and Zoning Commission, subject to certain changes on the plat. Mr. Lemons questioned the drainage easement not shown on the plat. Mayor Booker explained that this had been an unrecorded plat and the City was trying to get it corrected. Mayor Booker advised the Council that the final plat had been received with corrections made as per the Planning and Zoning Commission's recommendations. Councilman Nunn moved that the bills presented be approved for payment as listed on Exhibit A attached to these Minutes; seconded by Councilman Davis. Motion passed unanimously. In accordance with the Open Meetings Law, the Mayor called for a closed session following the regular meeting in order to discuss personnel matters. MAYOR & COUNCIL: Gentlemen: At the regular meeting of the Planning & Zoning Commission held Tuesday, May 28, 1974, David Moak moved that the Final Plat of Jellico Estates be accepted provided the plat be changed to show front building line to be 75' and side building line to be 15' so as to agree with restriction covenant #3 and that the surveyor date the plat; seconded by Eleanor Kasper. Hargadine 75 RESOLUTION NO. 74- 16 WHEREAS, the Federal Government has allocated $7,110.00 to the City of Southlake for the fifth entitlement period, July 1, 1974 through June 30, 1975 under the Revenue Sharing Program; And WHEREAS, the City Council of the City of Southlake has held public meetings to determine the expendi- ture of these funds; Now, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS; That the following budget of $7,110.00 is hereby adopted: City Hall Expansion - $7,110.00 PASSED AND APPROVED this day of June, 1974. ~IA&X~~7L Mayor ATTEST: Act ng City Secretary 7 6 RESOLUTION NO. 74=17 A RESOLUTION AUTHORIZING $3,000.00 EXEMPTION ON RESIDENCE HOMESTEADS FOR PERSONS 65 YEARS OF AGE OR OLDER ON CITY AD VALOREM TAXES WHEREAS, the Constitution of Texas was amended by a vote of the electorate of the State of Texas on November 7, 1972; and, WHEREAS, part of such amendment was the addition of sub- section (b) to Section 1-b of Article 8 of the Texas Constitution which amendment permits the governing body of a political sub- division to exempt not less than $3,000.00 of the assessed value of residence homesteads of persons 65 years of age or older: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 1. That pursuant to Article VIII. Section 1-b(b) of the Texas Constitution, $3,000.00 of the assessed value of residence homesteads of persons sixty-five years of age or older, shall be exempt from City of Southlake ad valorem taxes when taxes are levied for the year 1975, and all subsequent levies, as approved by the City Council, upon the homestead right owners' compliance with the following requirements: (a). An owner of t'he residence homestead right shall be 65 years of age or older as of January 1, of the applicable tax year. (b). An owner of the residence homestead right shall submit to the Tax Assessor-Collector of the City of Southlake before April 30, 1975 and before each April 30 of subsequent years, an affidavit accompanied by adequate proof that the owner of said residence k--- + .J b.~ 4 - .._~I- - L - - - - ~ - . . The initial exemption cl-aim shall be accompanied by adequate proof of age but subsequent renewals of the exemption may be made by affidavit only if the Tax Assessor- Collector does not desire additional proof; (d). A claimant for such tax exemption for any particular taxable year shall also meet all other lawful qualifications determined and prescribed by the City Council of the City of Southlake for such exemption. 2. That any person who makes a false affidavit in claiming a homestead exemption shall be subject to all penalties and interest charges which accrue for lack of payment of taxes, and all other appropriate criminal penalties. 3. Such tax exemption shall only apply for the particular taxable year for which the applicant properly applies and qualifies. PRESENTED AND PASSED on this* day of June, 1974, by a vote of .
