City Secretary CITY OF SOUTHLAKE REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 4, 1975 The City Council of the City of Southlake, Texas, met in regu- lar session in the Council Chamber of City Hall, 667 North Carroll Avenue in Southlake on Tuesday, November 4, 1975, with the following members present: Wade Booker, Mayor Sam Davis, Mayor Pro Tem James H. Winfrey, Councilman Ben H. Berry, Councilman Absent: W. 0. Nunn, Councilman Billy Joe Knox, Councilman Staff members present: William D. Campbell, City Attorney Fire Chief R. P. Steele Police Chief D. R. Hughes Guests present: Members of the Carroll High School Senior Class. Mayor Booker called the meeting to order at 7:30 P.M. The invo- cation was given by Councilman Berry. The Minutes of the last regular meeting were approved as read. ZA-75-6: The request of Avonell and Joe Wolf for a special alco- holic use on their property located at 3280 E. Northwest Parkway. The Mayor invited those present at this public hearing to speak either for or against this request. No one asked to be heard, whereupon Councilman Winfrey moved that Ordinance No. 161-67 be passed and approved as recommended by the Planning & Zoning Com- mission. Councilman Davis then asked to see a copy of their re- commendation and also asked Mr. Wolf the exact location of the store. Further questions were asked of Mr. Wolf by the Council. The motion was then seconded by Councilman Davis, and passed unani- mously. (Ordinance No. 161-67 is attached hereto and made a part hereof.) Mayor Booker proclaimed November 7, 8, 10, and 11 to be "Buddy Poppy Week". He announced that Councilman Winfrey is commander of the newly chartered VFW Post here in Southlake. The Building Inspector's Report was given by the City Secretary 176 in the absence of Lawrence Senn. The Council was pleased with the format of the report.submitted and at the fact that build- ing permits have increased. The Council was advised of the expenses incurred by the exten- sion of North Carroll Avenue: $175 for culverts, $250 for mov- ing the fire hydrant, and the possibility of expense for moving the pole bebnging to Brazos. The Mayor advised the Council that the rate increase by General Telephone has now been accepted by Grapevine and is in effect as of November 1st. (The increase is 21%. It was agreed at an earlier Council meeting that the City Council of Southlake would accept whatever increase the City of Grapevine accepted.) Councilman Davis moved that the bills presented be approved for payment; seconded by Councilman Berry. Motion passed unanimously. (See attached list.) Mayor Booker reported to the Council on furnishing fire protec- tion in the Trophy Club Estates area, outside the city limits, in exchange for their furnishing a new fire truck to the City. He asked the Council for approval to write this proposal in a letter. So moved Councilman Winfrey; seconded by Councilman Davis. Motion passed unanimously. Councilman Winfrey informed the Council that one of the Police vehicles was in need of repair and moved that same be fixed; seconded by Councilman Davis. Motion passed unanimously. Councilman Davis moved that approval be given for the purchase of gloves for use in the Fire Department at an approximate cost of $35; seconded by Councilman Winfrey. Motion passed unanimously. The Mayor greeted the Carroll High School Seniors who were present at the meeting and thanked them and others present for attending. The Mayor then closed this portion of the meeting for the further discussion of possible land acquisition. Upon reconvening, Council- man Winfrey moved that negotiations be entered into for the pur- pose of acquiring a seven acre tract of land located along White Chapel Blvd. near Well Site #2; seconded by Councilman Berry. Motion passed unanimously. There being no further business, the meeting ad' rned. Mayor ATTEST; City Secretary I I 1A /-7r- ORDINANCE NO. 161-67 AN ORDINANCE AMENDING ORDINANCE NO. 161 OF THE CITY OF SOUTHLAKE, TEXAS BY GRANTING AN ALCOHOLIC BEVERAGES SPECIFIC USE PERMIT TO AVONELL WOLF ON A PART OF 1.5 ACRES OF LAND OUT OF THE T. EASTER SURVEY, ABSTRACT 458, IN TARRANT COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF, PROVIDING FOR A TEMPORARY CHANGE IN OFFICIAL ZONING MAP, AND PROVIDING FOR THE TERM AND CONDITIONS OF SUCH PERMIT, AND PROVIDING FOR THE CONDITIONS PRECEDENT TO THE EFFECTIVE DATE OF THE AMENDMENT. WHEREAS, an application for an Alcoholic Beverages Specific Use Permit has been filed and a public hearing conducted and all other prerequisites complied with under applicable law, except those specifically provided hereafter, concerning an Alcoholic Beverages Specific Use Permit in connection with the property described on Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, be it ordained by the City Council of the City of Southlake, Texas: SECTION 1: That certain Ordinance No. 161 passed by the City Council of the City of Southlake, Texas January 7, 1969, and being the "Comprehensive Zoning Ordinance" is hereby amended insofar as the property described on Exhibit "A" attached hereto and made a part hereof may be used by Avonell Wolf for purposes described in an Alcoholic Beverages Specific Use Permit and such use is granted as a temporary zoning change subject to the following conditions: A. Such land shall, at the time the permit is issued, have an effective zoning classification permitting the specific use in connection with alcoholic beverages. B. Such permit is issued for a period not to exceed one year as specified on Exhibit "B" attached hereto and made a part hereof. C. Such permit authorizes the use defined on Exhibit "C" attached hereto and incorporated herein and such use is the same use approved by the Texas Alcoholic Beverage Commission. ~:P?LICATI~?N IJO. Such permit shall be issued in accordance with the provisions of this ordinance at the time applicant receives approval for a similar permit or license from the Texas Alcoholic Beverage Commission. E. Such permit shall be conditioned on compliance with all the terms of Section VII.4 of Ordinance 161 of the City of Southlake, Texas, and any other specific conditions, if any, set forth on Exhibit "D". SECTION 2: The official zoning map created by said Ordinance No. 161 shall be amended to include this temporary zoning change when the same becomes effective. SECTION 3: The said Ordinance No. 161, except as officially amended by prior ordinance amendments and this Ordinance No. 161-67 remains in effect in all other respects as originally passed. This ordinance shall be effective upon passage but the Alcoholic Beverages Specific Use Permit must be issued before April 1, 1976 or the right to receive such permit under this ordinance shall cease. Such building being located on a 1.5 acre tract of land more particularly described on Exhibit A-2 attached hereto and incorporated herein, but such area covered under such Alcoholic Beverages Specific Use Permit being only the portion of the building outlined in red on Exhibit A-1. EXHIBIT "B Such Specific Use Permit shall be initially issued for a period of one (1) year from date of issuance. EXHIBIT "C" The Alcoholic Beverages Specific Use Permit issued to Avonell Wolf herein is for sale of beer for off-premises consumption. EXHIBIT ""D" Additional specific condition of issuance is the remodeling of structure to elinimate any passageway between buildings as described on Exhibit "A". - 173 P R O C L A M A T I O N WHEREAS, the annual sale of Buddy Poppies by the Veterans of Foreign Wars of the United States an organization chartered by the Congress, has been officially recognized and endorsed by the President of the United States and the Veterans Admini- stration; and WHEREAS, the proceeds of this worthy fund-raising campaign are used exclusively for the benefit of disabled and needy vet- erans, and the widows and orphans of deceased veterans; and WHEREAS, the basic purpose of the annual sale of Buddy Poppies by the Veterans of Foreign Wars is eloquently reflected in the desire to "Honor The Dead By Helping The Living"; Now THEREFORE, I, WADE BOOKER, Mayor of the City of Southlake, Texas, do hereby recognize the patriotic merits of this cause by urging the citizens of this community to contribute gener- ously to its support through the purchase of Buddy Poppies, on the days of November 7, 8, 10, and 11 set aside for the distri- bution of these symbols of loyalty in this city. I urge all patriotic citizens to wear a Buddy Poppy as mute evidence of our gratitude to the men of this country who have risked their lives in defense of the freedoms which we continue to enjoy as American citizens.
