Aliceanne Wallace, City Secretary 24 CITY OF SOUTHLAKE REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 17, 1976 The City Council of the City of Southlake, Texas met in regu- lar session in the Council Chamber of City Hall, 667 North Carroll Avenue in Southlake on Tuesday, February 17, 1976 with the following members present: Billy Joe Knox, Councilman W. 0. Nunn, Councilman James H. Winfrey, Councilman Ben H. Berry, Councilman Absent: Wade Booker, Mayor Sam Davis, Mayor Pro Tem. Staff members present: Police Chief D. R. Hughes Water Superintendent W. G. Cline William D. Campbell, City Attorney. Also present: Members of the Planning & Zoning Commission: R. W. Mussina, Chair- man, C. M. Gordon, and Gail Hargadine. The first order of business was the selection of an acting Mayor Pro Tem. Councilman Winfrey moved that Councilman Billy Joe Knox act as Mayor Pro Tem for this meeting; seconded by Council- man Berry. Motion passed unanimously. Acting Mayor Pro Tem Knox called the meeting to order at 8:10 P.M. The invocation was given by Councilman Nunn. The Minutes of the last regular meeting were approved as read. A request for the postponement of the scheduled public hearing on the proposed zoning ordinance was made to the Council by Citizen Martin Hawk who stated his reasons for such request. Discussion followed. It was the feeling of the Council that the public hearing should be held March 2, 1976 as planned and advertised. Councilman Winfrey stated he personally would not vote on the zoning ordinance before the Planning & Zoning Commission makes its recommendation. ORDINANCE NO. 226: an ordinance providing for the installation and regulation by the Texas Highway Department for flashing sig- 25 nals at the school crossing on State Highway 114 at its intersec- tion with Carroll Avenue was unanimously passed and approved on motion by Councilman Winfrey; seconded by Councilman Nunn. (Said Ordinance attached hereto and made a part hereof.) RESOLUTION NO. 76-4: containing the Mayor's order for a general election to be held April 3, 1976, for the purpose of electing Municipal Officers and information pertaining thereto was unani- mously passed and approved on motion by Councilman Nunn; seconded by Councilman Berry. (Said Resolution attached hereto and made a part hereof.) LIBRARY FUNDS were next discussed by the Council. Councilman Winfrey moved to accept the $2100 from Tarrant County for use in the school library for the benefit of the citizens in our municipality; seconded by Councilman Berry. Motion passed unani- mously. An Ordinance regulating signs was next considered by the Council. Following discussion, the matter was tabled to the March 2nd meet- ing. FIRE DEPARTMENT REPORT: Harry Bradley was introduced to the au- dience as the Department's new Assistant Fire Chief. Councilman Winfrey reported 37 fire calls were answered this past month and he commended the volunteers for their efforts. He cautioned the audience not to throw lighted smoking material out of car windows because of the danger of possible fire. POLICE DEPARTMENT REPORT was given by Councilman Nunn who brought to the Council's attention two requests for expenditure of funds: 1. Purchase of a Citizen Band radio for the new patrol car at an approximate cost of $129 less 10%. 2. Repair to the rear end of the 1975 patrol car for an approx- imate cost of $225. Councilman Berry moved that the Citizen Band radio be purchased; seconded by Councilman Nunn. Motion passed unanimously. Council- man Winfrey moved that the 1975 patrol car be repaired; seconded by Councilman Berry. Motion passed unanimously. WATER DEPARTMENT REPORT was given by Mr. W. G. Cline who stated everything was in working order. The City Secretary asked per- mission from the Council to have Carter & Burgess, Inc., prepare a written description of the water department's service area, in- formation which must be supplied to the Public Utility Commission of Texas, if the written description prepared in the office is not Regular Council Meeting - 2/17/76 - Page 2 of 3 26 accepted by the commission. Mayor Pro Tem Knox asked that if Carter & Burgess, Inc., must be used to please supply a cost fig- ure to him. The January Building Report was handed to the Council. The City Secretary advised Larry Senn was attending the third session of schooling for his certification. The Council was advised that the County has requested payment of $415 for culverts installed on Burney Lane. Councilman Winfrey moved that such payment be made to them; seconded by Councilman Nunn. Motion passed unanimously. The Council was informed of the General Assembly Meeting of NCTCOG to be held February 25, 1976. Councilman Berry and Councilman Nunn advised they would attend to represent our City. Councilman Winfrey moved that the bills presented be approved for payment including the invoice on the new patrol car; seconded by Councilman Nunn. Motion passed unanimously. EXHI,B~T A to page 24 ORDINANCE NO. ~a AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED 11j7y BETWEEN THE STATE OF TEXAS AND THE CITY OF SOUTHLAKE FOR THE INSTALLATION, CONSTRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY SIGNAL PROJECT(S) IN THE CITY OF SOUTHLAKE PROVIDING FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF S011THLARF. SECTION 1. That the certain agreement dated Z~ -7 /74 between the State of Texas and the City of Southlake I , for the installation, con- struction, existence, use, operation, and maintenance of certain highway traffic signal(s) in the Ci y of Southlalroe , be and the same is hereby approved, and s hereby authorized to execute said agreement on behalf of he C #y of Southlake and to transmit the same to the State of Texas for appropriate action. SECTION 2. W I T N E S S E T H: WHEREAS, by virtue of a Municipal Maintenance Agreement entered into by the City and the State, the State has been authorized to maintain certain highway routes within the City; and WHEREAS, from time to time the City has requested the State to install traffic signals on certain highways within the City; and WHEREAS, the State under the provisions of Minute Order 70179, dated July 31, 1975, has authority to install, maintain and operate traffic signals when requested to do so in cities of 15,000 population or less according to the latest Federal Census; and WHEREAS, the City has a population of less than 15,000 according to the 1970 Federal Census. A G R E E M E N T NOW, therefore, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter.set forth, it is agreed as follows: AGREEMENT (TRAFFIC SIGNAL - TYPE B) 11-75-701 D-18T 1-4 1. This Agreement shall apply to all highway traffic signal installations approved by both the State and the City, the City's approval being indicated by signature of the on the plan title sheet for such installation. Highway traffic signal installations made a part of this Agreement shall contain on the title sheet the following statement: "The City hereby consents to the construction of this highway traffic signal as to location and manner of construction as indicated on these plans, said in- stallation being a part of "Agreement (Traffic Signal - Type B), dated 2. The State will furnish the necessary funds for the actual construction, prepare plans and specifications, install said highway traffic signal(s), supervise construction, and upon completion of construction, will furnish the power and operate and maintain said highway traffic signal(s). 3. The City hereby consents to the construction of the highway traffic signal(s) by the approval of the location and manner of construction as shown on plans and described in specifications. 4. The City will exercise no control whatsoever over the operation, mainte- nance, use or existence of the highway traffic signal(s) without written authority from the State Department of Highways and Public Transportation. 5. The State shall have the authority to make such changes in the design and operation of the highway traffic signal(s) as it may deem necessary and advisable to promote the safe, convenient, and orderly movement of traffic. 6. The City will be responsible for the police enforcement required for securing obedience to the highway traffic signal(s). The Mayor of the City of Southlake, Texas, at a regular meet- ing held this date, does hereby order an election of officers of the City of Southlake to be held on Saturday, April 3, 1976, for the purpose of electing Councilmen, for a term of two years, from April 3, 1976, or until their successors are duly elected and qualified. Candidates for the offices of Councilmen for Place 3, 4 and 5 receiving the highest number of votes for such office and such places shall be elected for a term of two years. 2. For the purpose of said election, the entire City of Southlake is hereby constituted one voting precinct and said election shall be held at one polling place, to-wit: City Hall, 667 North Carroll Avenue, between the hours of 7:00 A.M. and 7:00 P.M. on the afore- mentioned date, and the following persons are hereby appointed as election officers: Elsie McAlister, Presiding Judge Kathryn Tate, Alternate Presiding Judge and the Presiding Judge at such election shall appoint no more than three clerks, with the rate of pay for the Presiding Judge at $2.00 an hour and a like amount for the Alternate Presiding Judge; and the rate of pay for the clerks fixed at $1.50 per hour. 3. No person shall be eligible for the office of Councilman un- less he is a qualified elector of the City of Southlake and has resided in the City for six months next preceding the election at which he is elected. 4. Any eligible and qualified person may have his name printed upon the official ballot as an independent candidate for the offices herein provided for by filing his sworn application with the Mayor i not later than Midnight, March 3, 1976. The application shall state the specific office being sought by the applicant and that the applicant is eligible and qualified under the Laws of the State of Texas, to become a candidate for and hold the office being sought, if elected. 5. Any other candidate for either of the offices herein pro- vided for may have his name printed upon the said ballot on ap- plication to the Mayor, such application to be furnished by the City Secretary and the same contain the signatures of five per- cent (5/) of the qualified voters of the City of the entire votes cast in the City at the last general election. 6. The names of all those who have filed their sworn applica- tion to have their names printed on the official ballot as candi- dates shall be posted by the City Secretary in a conspicuous place at her office for the inspection of the public for at least ten days before she orders the ballots to be printed. All objec- tions shall be made within five days after such posting, all written notices filed with the City Secretary setting forth the grounds of objections. In case no such objection is filed within the time prescribed, the regularity or validity of the application of no person whose name is so posted, shall not thereafter be con- tested. The City Secretary shall preserve in her office for a period of two years all applications, notices of objections and other related matters. 7. Any person eligible to the offices herein provided for who has filed his sworn application in accordance with the provisions of this resolution shall have his name printed on the official ballots. Any such person may cause his name to be withdrawn at any time before the official ballots are printed by filing in writing with the City Secretary a request to that effect over his signature, duly attested to by a Notary Public. No name so with- drawn shall be printed on the ballots. Not later than ten days before the City General Election, the City Secretary shall have the official ballots printed. 8. The ballots to be used in said election shall be prepared in the manner and form in the Election Code of the State of Texas. 9. All qualified voters within the meaning of the Constitution and Laws of the State of Texas, shall be entitled to vote at such election. 10. Voting by absentee ballot in said election shall commence on March 15, 1976, at the office of the City Secretary, 667 North Carroll Avenue; voting by absentee ballot shall close at five o'clock P.M., March 30, 1976. 11. The election officers above named shall make and deliver the returns of said election in triplicate, one being retained by the Presiding Judge, one delivered to the Mayor of the City and one copy with ballot boxes and all election supplies shall be delivered to the City Secretary of the City, the ballot box containing the signature stubs from ballots used in said election shall be delivered to the District Court of Tarrant County, Texas, and other ballot boxes and election records and supplies shall be preserved by the City Secretary in the proper office as by law provided. The City Council will meet at 7:30 P.M. on April 5, 1976, for the purpose of canvassing said ballots. 12. The Mayor is hereby directed to give notice of said election which shall be signed by the Mayor and City. Secretary and shall state the purpose of the election, and the Police Chief shall post a properly executed copy of the election proclamation at the pol- ling place herein provided and two copies at two other public pla- ces within the City. Such notices shall have attached thereto a certified copy of this Resolution. 13. Said election shall be held and conducted in accordance with the laws of the State of Texas for the holding of general elections for state and county offices except as otherwise provided by Chap- ter 2, Title 28, of the Revised Civil Statutes of Texas. By approving and signing this Resolution, I, Wade Booker, Mayor of the City of Southlake, Texas, officially confirm as my action all matters recited in this Resolution which by law come within my jurisdiction. Cualquier otro candidato por uno u otro de los oficios aqui dentro proveido a puede tener su nombre imprimido en la dicha balota a la aplicacion al Alcalde, tal aplicacion sera proporcionado por el Secretario de la Ciudad y el mismo con- tendra las signaturas de cinco porcentaje (5/) de los votantes calificados de la Ciudad de los votos enteros depositados en la Ciudad a la eleccion general pasado. 6. Los nombres de todos los que han puesto en fila sus ap- licaciones jurados tendran sus nombres imprimidos en la balota oficial como candidatos fijados pro el Secretario de la Ciudad en un lugar evidente de su oficina para la inspeccion del pu- blico por to menos diez dias antes de ordenar imprimir las, balotas. Todas objeciones se haran dentro de cinco dias despues de que tal fijando, todas noticias escritas puestos en fila con el Secretario de la Ciudad poniendo adelante las causas de ob- jeciones. En caso de que no tal objecion ester en fila dentro del tiempo prescribido, la regularidad o validez de la aplicacion de ninguna persona cuyo nombre no ester fijado, no sera disputado despues, El Secretario de la Ciudad preservara en su oficina por un periodo de dos anos todas aplicaciones, notificaciones de ob- jeciones y otros asuntos relacionados. 7. Cualquier persona eligible a los oficios aqui dentro proveido a que ha puesto en fila su aplicacion de acuerdo con las pro- visiones de esta resolucion tendra su nombre imprimido en las balotas oficiales. Cualquier persona puede causar que su nombre sea retirado a cualquier tiempo antes de que las balotas oficiales estan impremidos por poniendo en fila en escritura con el Secre- tario de la Ciudad una peticion a ese efecto encima de su signa- tura debidamente dado fe de por un Notario Publico. Ninguna nombre asi retirado sera imprimido en las balotas. No mas tarde que diez dias antes de la Eleccion General de la Ciudad, el Secretario de la Ciudad tendra balotas oficiales imprimidos. 8_ Las balotas usadas en dicha eleccion seran preparadas en la manera y forma del Codigo de Eleccion del.Estado de Tejas. 9. Todos los votantes calificados dentro del significado de la Constitucion y Leyes del Estado de Tejas seran dado derecho de votar a tal eleccion. 10. Votando por balota en ausencia en dicha eleccion comengora en el 15 de Marzo, 1976, en la oficina de el Secretario de la Ciudad, 667 Carroll Avenida del norte; votando por balota en ausencia concluira a las cinco de la tarde, el 30 de Marzo, 1976. 11.E Los oficiales de eleccion nombrados arriba haran y entre- garan los resultados de dicha eleccion en triplicado, uno retenido por el Juez Presidiendo, uno entregado al Alcalde de la Ciudad y una copia con las ca as electoriales y todas las provisioner de eleccion seran entregados a e1 Secretario de la Ciudad, la caja electorial conteniendo los frapentos de las signaturas de las balotas usadas en dicha eleccion seran entregadas al tribunal del Distrito de Tarrant County, Tejas, y otras cajas electoriales y anotacionesy,-provisiones de la eleccion seran conservados por e1 Secretario de la Ciudad en la propia oficina como esta pro- veido por ley. El ayuntamiento se reunira a las siete y media de la tarde el 5 de Abril, 1976, por la intencion de '.inspeccion dicha balotas. 12. El Alcalde es por esto ordenado de dar por el noticia de dicha eleccion que sera afirmado por el Alcalde y por el Secre- tario de la Ciudad y declarara la intencion de la eleccion, y el Jefe de Policla fijara una copia justamente finalizado de la proclamacion de eleccion al lugar de votar aqui dentro proveldo y dos copias a dos otros lugares publicas dentro de la Ciudad. Tal noticias tendran aficionados al mismo una copia certificada de esta Resolucion. 13. Dicha eleccion tendra lugar y conducido de acuerdo con los leyes del Estado de Tejas para tener las elecciones generales para los oficios de estado y "county" excepto por los propor- cionado en Capitulo 2, Titulo 28, de los Estatutos Civiles Re- visados de Tejas. Aprobando y firmando esta Resolucion, Yo, Wade Booker, Alcalde de la Ciudad de Southlake, Tejas, oficialmente confirmo que mi accion- en todos los asuntos recitados en esta Resolucion que por la ley viene dentro de mi jurisdiccion.
