THAT, the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said City and be bound by all of the acts and ordinances made in conformity thereto, now in full force and effect and that which maybe hereafter adopted. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 1. That the Mayor of said City has heretofore duly and timely filed, in accordance with the law, a Budget for said City covering the fiscal year running from October 1, 1976, to September 30, 1977, that due and timely public notice that a public hearing on such Budget would be held on August 17, 1976, was given and made in accordance with the law and within the time limits set forth by law; that such public hear- ing was held in accordance with the law on August 17, 1976; and that it was the opinion and judgment of the City Council that such Budget which is attached hereto be, and same is hereby, in all things approved and that same is proper and correct. 2. That said Budget is here and now, and hereby in all things, approved and adopted, and it shall be effective as of October 1, 1976. 3. That this Ordinance is hereby declared to be an emergency measure which shall have and take effect from and after its present reading for the reasons that the fiscal year commences October 1, 1976, and fixing the rate and levy of taxes for the year 1976 must be had prior to October 1, 1976, and after approval and adoption of this Budget; it is for the im- mediate preservation of public property and business, and provides for the daily operation of all municipal departments and lays a predicate for the appropriation of money to defray current and other expenses. Sweet, Councilman 7 September 1976 Hon. Council of the City of Southlake: I submit the 1977 Budget with the thought in mind that the citizens of Southlake do not wany any increase in their taxes. Therefore, the pro- posed Budget which has been prepared maintains the same level of city services. Even so, it was no easy task to absorb rapidly rising costs and still not increase taxes. To do what has been done calls for sacrifices. Department Heads were not granted the additional personnel nor all the additional equipment they would have liked to have had, and it is a great personal disappointment that future capital improvements have not been included. Our city has always had a balanced budget and has always operated "in the black". I firmly believe this tradition must be carried on and humbly request that inconveniences be borne for the sake of sound fiscal management. That the tax so levied and assessed shall be apportioned to the follow- ing accounts and funds in the amounts set forth: GENERAL FUND: $ 0.50 GENERAL OBLIGATION BOND INTEREST & SINKING FUND .15 Total Levy $ 0.65 Collections of the taxes levied shall be deposited to the credit of each of the above accounts and funds in their proportionate share of the total levy after taking into consideration a 2% uncollectible factor which is to be accounted for in the General Fund. 3. That the taxes provided for herein are in accordance with appropriate State statutes. 4. Ad Valorem Taxes levied by this Ordinance shall be due and payable on TO THE CITY OF SOUTHLAKE, TEXAS To the Honorable Mayor and Members of the City Council of Southlake, Texas, GREETINGS: The undersigned, William D. Graue, of Dallas County, Texas, herein- after called Petitioner, represents as follows: 1. That William D. Graue is the owner of record of a tract of land out of the John Childress Survey, Abstract No. 254, in Tarrant County, Texas, more particularly described by metes and bounds as follows: Beginning at an iron pin in the North right-of-way line of Burney Lane, same point of beginning being 25.01 feet, more or less, East of the East right-of-way line of Carroll Ave- nue and 60 feet North to point of beginning; THENCE from point of beginning North 0° 24 min. West 407.3 feet to a point; THENCE North 89° 47 min. East 400 feet to a point; THENCE South 0° 24 min. East 407.18 feet to a point in the North right-of-way of Burney Lane; THENCE South 89° 46 min. West 400 feet to the point of BEGINNING, containing 3.74 acres of land, more or less. A plat of said land showing its location with respect to the boundary of the City of Southlake, Texas, is attached hereto marked "Exhibit A". 2. That the land described in Exhibit A hereto attached is less than one-half mile in width; that less than three qualified voters reside thereon, and same is contiguous and adjacent to the City of Southlake, Texas. 3. The Petitioner agrees that if this request for annexation be granted, said land shall become a part of the City of Southlake, Texas, and the said land and any future inhabitants thereof shall be entitled to all rights and privileges of other citizens of the City of Southlake, and shall be bound by the acts and ordinances of said City now in effect and as here- after enacted. WHEREFORE, the Peitioner respectfully requests that this Petition for Annexation to the City of Southlake of the land described in the attached Exhibit be granted. WITNESS the signature of Petitioner duly acknow d ed as re ed for deeds. William D. Graue October 1, 1976, and shall become delinquent on the first day of Feb- rurary, 1977. Payment of such tax is due in one full installment. 5. If the tax is unpaid after February 1, 1977, such tax will become delinquent and penalty and interest will attach and accrue as pro- vided by the Statutes of the State of Texas including Articles 1060a and 7336, V.A.T.C.S. 6. In the event the taxes become delinquent and in the event such delinquent taxes are referred to any attorney for collection, an additional amount of ten per cent (10%) of the total amount of tax, penalty and interest then due shall be added as collection costs and paid by the taxpayer. 7. Taxes herein levied and uncollected shall be a first, prior, and superior lien against the property, and the said lien shall be superior and prior to all other liens, charges and encumbrances, and such lien shall attach to personal property with the same priority as to real property. 8. The lien provided herein shall be attached as of January 1, 1976. 9. Should any section, provision or clause of this ordinance be declared by a court of competent jurisdiction to be invalid,the same shall not affect the validity of this Ordinance as a whole or any part thereof other than the part so declared to be invalid. 10. This Ordinance shall become effective from and after the date of its approval and adoption as provided by law.
